On December 13, 1994, the Planning Commission reviewed a proposed
agricultural split of 160 acres for Grace Kuznia and Otto Ped. The
property is the estate of their parents and was to be equally split
between Ms. Kuznia and Mr. Ped.
The originally proposed boundary line caused some setback encroachments
and even bisected a grain bin. After considerable discussion and
negotiation, an alternative solution was presented that accomplished
the division and eliminated the encroachment issues.
The Planning Commission recommended approval of the division as revised
on December 9, 1994 .
Recommended Action: MOTION to adopt A RESOLUTION APPROVING THE
AGRICULTURAL DIVISION OF THE PEED ESTATE FOR GRACE KUZNIA AND
OTTO PED.

A RESOLIITION APPROVING T8E RIIZNIA/PED AGRICITLTIIRAL SIIBDIVISION
WHEREAS, the City of Rosemount has received a request from Ms .
Grace Kuznia, Administratrix of the estate of Adolph and Bertha
Peed, property owners, to subdivide approximately 160 acres into
two equal parts and described as follows:
Parcel A:
The Southwest Quarter (SW1,�) of Section 29, Township 115, Range
18, Dakota County, Minnesota; EXCEPT the west 85 acres thereof.
Together with that part of the west 87.5 acres of the Southeast
Quarter {SE1,�) of Section 29 , Township 115, Range 18, Dakota
County, Minnesota which lies westerly of the following described
line: Beginning at a point on the north line of said Southeast
Quarter (SE1,�) distant 165 .31 feet east of the northwest corner
thereof; thence southwesterly to a point on the south line of
said Southeast Quarter (SE1,�) distant 57.31 feet east of the
southwest corner thereof, said line there terminating.
Containing 80 . 763 acres .
Parcel B :
That part of the west 87.5 acres of the Southeast Quarter (SE1�)
of Section 29, Township 115, Range 18, Dakota County, Minnesota
which lies easterly of the following described line: Beginning
at a point on the north line of said Southeast Quarter (SE1,�)
distant 165 .31 feet east of the northwest corner thereof; thence
southwesterly to a point on the south line of said Southeast
Quarter (SE1�) distant 57.31 feet east of the southwest corner
thereof, said line there terminating. Containing 80 .763 acres.
WHEREAS, the resulting two agrieultural parcels may be conveyed
by metes and bounds description; and
WHEREAS, the Planning Commission reviewed this request at their
December 13, 1994 Regular Meeting and has recommended approval of
the Kuznia/Ped Agricultural subdivision; and
WHEREAS, the agricultural subdivision as requested meets minimum
ordinance standards and subdivision requirements for an
agricultural subdivision.
NOW, THEREFORE, BE IT RESOLVED, the City Council of the City of
Rosemount hereby approves the Kuznia/Ped subdivision subject to:
1) proposed division line identified with PID No. 34-02900-010-
50 (4992 145th Street East) as described in the 12/9/94
survey separating parcels A and B; and
2) approval of the agricultural division proposal by the Dakata
County Platting Commission; and
� 3) modification of the existing mineral extraction permit for
restriction of mining activities to Parcel A and, further,
that any related mining activities occurring on Parcel B
will require separate City Council approval with easements,
as needed.

TO WHOM IT MAY CONCERN:
NOTICE IS HEREBY GIVEN, the City Council of the City of Rosemount will hold a public
hearing to consider the item listed belo�v on Tuesday, January 17, 1995 in the Council
Chambers of the City Hall, 2375 145th Street West, beginning at 8:00 p.m. or as soon
thereafter as possible. The public hearing pertains to a 160-acre parcel of property generally
located south of County Road 42 (145th Street) approximately 1.5 miles east of State Trunk
Highway 52 and legally described as follows:
Part of the West 87.5 acres of the Southeast Quarter (SEi/�) and the
east 75 acres of the East Half of the Southwest Quarter(Et/a of SW1/.�)
subject to highway easement over North 50 feet all in Section 29,
Township 115, Range 18. �
The purpose of this hearing is to consider a request from the property owners for a division of
160 acres of property located in the Agriculture District into two 80-acre parcels.
Persons wishing to speak on the I<uznia/Ped Agricultural Subdivision request are invited to
attend this public hearing on Tuesday, January 17, 1995 at 8:00 p.m. Formal written
comments will also be accepted prior to the meeting date. Please forward all comments and .
inquiries to the Plannuig Division of the Community Development Department.
