On January 19, 1995, acting on behalf of the said City, I posted at the City Hall, 2875
145th Street West, and deposited in the United States Post Office, Rosemount,
Minnesota, a copy of the attached notice of a Public Hearing far consideration of the
Wensmann Seventh AdditionPUD, preliminary plat, and rezonings, enclosed in sealed

NOTICE IS HEREBY GIVEN, the City Council of the Citv of Rosemount will hold a public
hearing on Tuesday> February 7, 1995 in the Council Chambers of the City Hall, 2375 145t1i
Street West, begizuung at 8:00 p.m. or as soon thereafter as possible.
The puipose of this hearing is to receive public input anci comments on the proposed
Wensmann Seventli Acidition Residential Planned Unit Development, preliminary plat, and
rezonings. The proposed subdivision pertains to propertv located on the south side of County
Road 42 betrveen Wensmann SiYth Addition and Diamond Path, legally described as follows:
The Northwest Quarter (NW'/�) of Section 31, To�vnship 115, Range 19, Dakota
County, Minnesota, e:ccept the east 1,273.96 feet thereof; and e:ccept the south
1,613.00 feet thereof. Subject to County Road No. 42 and C.S.A.H. No. 9 (Dadd
Road), and also subject ta any easeinents of record, if any.
The purpose of tlus hearing is to consider the PUD, preluninarv plat, and rezoning froin AG
Agriculture to R-1 Single Family Detached (for 31 detached housing units), R-2 Single Fainilv
Attached (for 51 townhouse units), and PUB Public/Quasi-public (i.9-acre mini park)
portions of the aUove described property. The 23.3-acre tract of land is designated Urban
Residential (UR) in the City of Rose�rcvunt Cvmprelce��sive Ga�ic�e Pl��i: Updctte 2000. The
developer is proposing a mixed housing type PUD coinbuung 31 detached single family lots
with 51 attached townhouse units and a "mini park".

Reviews.
The proposed Wensmann Seventh Addition combines 30 single family
lots with 51 single level townhouses. A residential Planned Unit
Development is appropriate because of the multiple parcels created,
variety of housing type, and three different zoning districts that
will be created. The public hearing concerns the PUD, preliminary
plat and rezoning. It is anticipated that the entire seventh
addition will be developed in one phase. Therefore, a single final
plat will be reviewed to complete the subdivision process and
create the parcels for rezoning. The proposed zoning will be R-1
Single Family Residential Detached, R-2 single Family Attached (for
the townhouses) and PUB Public/Quasi Public for the park. The
property is currently zoned Agriculture and has a Comprehensive
Guide Plan land use designation of Urban Residential . No
commercial uses are proposed.
The Planning Commission reviewed the PUD and preliminary plat on
January lOth and 24, 1995, and recommended approval of the PUD,
preliminary plat and rezoning. This process reduced the number of
variances from 16 to 7. The development blends the patterns set by
Wensmann Sixth Addition, and the Fifth Addition. Existing street
connections influence the design and circulation. Traffic from the
townhouses will move east and west along December Trail and should
not impact 151st Street. The Developer will be asked to ma.ke a
payment to the City for their share of future Diamond Path
improvements. The city engineer has more discussion on this
subject as a separate agenda item.
Recoamnended Action: MOTION to adopt A RESOLUTION APPROVING THE
WENSM.�INN SEVENTH ADDITION PLANNED UNIT DEVELOPMENT AND
PRELIMINARY PLAT AND SETTING OUT THE CONDITIONS FOR FINAL PLAT
APPROVAL.

TO WHOM IT MAY CONCERN:
NOTICE IS HEREBY GIVEN, the City Council of the City of Rosemount will hold a public
hearing on Tuesday, February 7, 1995 in the Council Chambers of the City Hall, 2375 145th
Street West, beginning at 8:00 p.m. or as soon thereafter as possible.
The purpose of this hearing is to receive public input and comments on the proposed
Wensmann Seventh Addition Residential Planned Unit Developinent, preliuninary plat, and
rezonings. The proposed subdivision pertains to property located on the south side of County
Road 42 bet�veen Wensmann Sixth Addition and Diamond Path, legally described as follo�vs:
The Northwest Quarter (NW'/�) of Section 31, Township 115, Range 19, Dalcota
County, Minnesota, e,ccept the east 1,2%3.96 feet thereof; and except the south
1,613.00 feet thereof. Subject to County Road No. 42 and C.S.A.H. No. 9 (Dodd
Road), and also subject to any easements of record, if anv.
The purpose of this hearing is to consider the PUD, preluninary plat, and rezoning fromAG
Agriculture to R-1 Single Family Detached (for 31 detached housing units), R-2 Single Family
Attached (for 51 townhouse units), and PUB Public/Quasi-public (I.9-acre mini park)
portions of the above descriUed property. The 233-acre tract of land is designated Urban
Residential (UR) 'vn the City of Rosemount Co�rcpreheresive Guicle Pl�tit: Up�late 2000. The
developer is proposing a mixed housing tvpe PUD coinbuung 31 detached single faitiily lots
with 51 attached townhouse units and a "mini park".

rezonings are invited to attend this ineeting on Tuesday, Februarv 7, 1995 at 8:00 p.m.

ADDITION PLANNED IINIT DEVELOPMENT AND PRELIMINARY PLAT
AND SETTING OIIT THE CONDITIONS FOR FINAL PLAT APPROVAL
WHEREAS, on City of Rosemount has received a concept Planned Unit
Development (PUD) and preliminary plat for the following legally
described property:
The Northwest Quarter (NWl,�) of Section 31, Township
115, Range 19 , Dakota County, Minnesota, Except the
East 1, 273 .96 feet thereof; and except the South
1, 613 .00 feet thereof. Subject to County Road No.
42 and C.S.A.H. No. 9 (Dodd Road) , and also subject
to any easements of record if any.
WHEREAS, on January 24, 1995 the Planning Commission of the City
of Rosemount recommended approval of the 9�ensmaaa Seveath
Addition Plaaaed Uait Development and Preliminary Plat; and
wIiEREAS, the proposed rezoning from AG Agriculture to R-2 Single
Family Residential, R-2 Single Family Residential Attached, and
PB Public/Quasi-Public is in conformance with the Comprehensive
Guide Plan; and

with the City Zoning and Subdivision Ordinance; and
WHEREAS, on February 7, 1995 the City Council held a public

Rosemount hereby approves the Wensmann Seventh Addition Planned
Unit Development and Preliminary Plat, subject to:
1. the grading and utilities plan must be approved and accepted
by the city engineer and that the grading plan be modified to
include berms along the Diamond Path right-of-way;
2 . a cul-de-sac or "hammer head" turnaround must be provided at
the eastern terminus of the private street parallel to County
State Aid Highway (CSAH) 42 as approved by the fire marshal;
3 . no parking will be allowed on the private streets;
4. execution of a planned unit development and master
subdivision development agreement that:
a. approves the six (6) lot dimension variances and the
private street setback variance to CSAH 42 with the PUD
conforming with all other zoning ordinance standards in
effect at the time of execution;
b. requires a homeowner' s association agreement and
declaration of covenants that secures the maintenance of
common areas, driveways, and private streets; and
c. establishes driveway locations on lots fronting cul-de-
sacs and corner lot driveway locations as specified by
the city engineer.

6. the landscape plan be refined to enhance screening at the

5. OLD BUSINESS - Wensmann Seventh Addition Residential Planned Unit Development, i
Preliminary Plat and Rezoning.
On January 10, 1995, the Planning Commission tabled action relative to the development plan,
preliminary plat and rezoning for Wensmann Seventh Addition because of the large number of
conditions attached to the recommendation of approval as well as a high proportion of lot
dimension variances. The preliminary plat and landscape plan have been revised in response
to issues and reduce the number of variances.

The preliminary plat has been revised to realign the intersection of December Trail and
Daybreak Avenue in response concems identified by the City Engineer. Additional benefit
was to reduce the number of lot variances from 15 to 6. These enhancements occurred at the
cost of a single family lot.

Elimination of all lot area variances as well as the reduction of multiple variances in several
situations enhances the flexibility of building and reduces the previously identified limitations.
The other aspects of lots with proposed variances have been increased to compensate for the
variances. All of the lots with width variances have been increased in area and or depth.

Other concerns regarding the plat have been addressed as well. The lots on either side of the
townhouse entry drive have been increased to 90 foot widths from 80 ft and sideyard setbacks
are indicated on the plat at 20 feet as opposed to ten. As a result, the distance fmm house to
adjacent driveway is 40 feet as compared to the typical corner lot separation of 45 feet from
house to curb. �
Engineering specifications for turn-around design were provided but not incoiporated into the
revised plat. The specs have been reviewed by the Fire Marshall and the City Engineer.
Resolution of the turn-around in a form acceptable to City Staff will remain as a recommended
condition of approval of the plat.
LANDSCAPING
The landscaping plan has been extensively revised to respond to the four previously stated
concerns of:
1. additional screening along CSAH 42;
2. additional screening within the common areas separating differing housing types;
3. additional screening to protect housing and traffic from headlight glare;
4. enhanced landscaping in the private entry drive adjacent to the single family homes.
The required number of trees is 89 and the number provided is 240 not including ornamental
trees and shrubs. The addition of these materials effectively enhances the aesthetics and
screening needs of the PUD with one minor exception. Planning staff is concemed that
additional screening should be provided at the intersection of the private streets adjacent to
County Road 42. Given the overwhelming amount of landscaping provided staff would
suggest trading off with other materials indicated in common open spaces.
PHASING AND FINAL PLAT ISSUFS
The PUD will be built in one phase with the approval of a final plat. If the Developer chooses
multiple phases instead, than a final plat will be required for each phase accompanied with a
development agreement. The development agreement assaciated with final plat approval will
resolve the following issues:
1. Temporary cul-de-sacs and participation (or escrow of funds) in the development of
Diamond Path (County Road 33);
2. Easements for drainage, utilities and trails;
3. Construction of public improvements such as sidewalks and trails;
4. Securities for public improvements and landscaping; and,
5. The amount and form of park dedication.
The final plat will define the various lots, outlots and street right-of-way to be recorded at the
County. This process also provides the ability to assign appropriate zon.ing classifications to
the components of the PUD.
RECOMMENDATIONS
Two motions are requested, the public hearing has been set for the City Council meeting on
February 7.

Mr. Herb Wensmann is requesting approval of a residential planned unit development that
combines townhouses with single family detached houses. The 5I single level townhauses
and 31 single family lots is a continuation of the development pattern established by
Wensmann Sixth Addition along the south side of CSAH 42, west of Shannon Parkway.
BACKGROUND:
The original concept for the Seventh Addition was reviewed by the Planning Commission on
September 27, 1994. A motion to recommend approval of the concept was adopted with
four conditions:
1) the proposed density for the townhouse clusters are offset by the open space contiguous to
the Wensmann Sixth Addition and the revised open space location as submitted by the
developer in response to Park and Recreation Committee concerns;
2) approval of the utility and grading plans by the City Engineer and a determination that
existing infrastructure is capable of serving the development;
3) implementation of Planning Commission and Planning Staff recommendations for
development of the residential PUD with limited variance to lot dimensional standards;
and
4) final development plan modification to reduce the number of variances�vhere practical
solutions exist.
DISCIJSSION:
The PUD has been extensively modified since the last review. The number of townhouses
has been reduced to 51 from 75 and the single family lots increased to 31 from 19. The 1.6
acre park (1.9 acres combined�vith the Si�cth Addition} has been revised to respond to Park
and Recreation Committee concerns.
I�ey modifications include the addition of single family lots north of December Trail,
reorientation of the park land to�vards December Trail with separation from CSAH 42
resulting from a row of to�vnhouses. In addition, the to�vnhouses closest to CSAH 42 have a
private street and garages separating the d�velling units from the road�vay.

Thirty four common parking areas have been indicated on the preliminary plat which was a
previous concern. This number is in addition to the space provided in front of each double
garage. The minimum requirement for parking is two per dwelling unit. The revised plan
provides 2.5 times in excess of the minimum parking required at approximately 5 spaces per
unit. The Planning Commission may wish to discuss possible zoning text amendments
regarding enhancement of parking standards at a future meeting to ensure that other
developments have sufficient common parking.
The other outstanding issue relates to lots that need variances. The PUD is designed to
integrate with existing streets, neighborhoods, highways and undeveloped but existing right-
of-ways on all sides. There is also a transition of housing types from townhouses in the north
to single family in the south. The Wensmann Fifth Addition allowed 75 foot wide lots as
part of the PUD. Lot depth and corner lot criteria have been created or expanded since the
Fifth Addition as well. The result is that 30 of the 31 lots meet all of the standards that
applied to the Fifth Addition. The exception is lot 9, blocic 2 which is approximately 67 feet
wide at the front yard setback line. The lot increases in width lilce a "pie shape" towards the
rear yard because it fronts on a cul-de-sac.

The lots with multiple variances have the most limitations and may result in variance

Lot 6, Block 1 has area and width; Lots S and 10, Block 2 have width,
depth, and area issues; Lot 9, Block 2 has width and depth on one side.
Accordingly, Lot 6, Block 1 and Lots 5 and 10, Block 2 should have house "foot prints°
showing how house design will eliminate hardships needed to grant variances. The Planning
Commission may find it appropriate to add Lot 9, Block 2 to this list.
The private street along CSAH 42 should be setback 30 feet instead of 20 as shown. Given
the bituminous trail, only 12 feet is available for landscaping. Twelve feet is insufficient
depth for earth berms. A large hedge is the only practical solution for vegetative screening in
the space allowed. If this approach is acceptable, it could be augmented�vith plant groupings
in the front yards of the to�vnhouse clusters on the south side of the private street.
REZOIVING:
The property is currently in the Agriculture District with a Comprehensive Guide Plan land
use designation of Urban Residential. The appropriate zoning classification for the single
family lots is R-1 Single Family Detached Residential and R-2 Single Family Attached
Residential for the townhouses. The park area should be rezoned to PUB Public or Quasi
Public.
CONCLUSION: '
The PUD has been modified in response to Park and Recreation Committee and Planning
Commission concerns. If the Planning Commission fells that the variances are warranted,

then Planning Staff feels that the PUD is ready to be forwarded to the City Council with a
positive recommendation for public hearing and review with conditions. The list is a lang
one, but revisions can be made prior to the Council review. The attached memo from Bud
Osmundson and Doug Litterer outlines public works and engineering issues and conditions
that will be covered either through revisions or specification in the development contract.
RECOMMENDATION:
MOTION to recommend approval of the Wensmann Seventh Addition rezonings from
Agriculture to R-1 Single Family Detached and R-2 Single Family Attached Residential and
PUB Public and Quasi Public;
MOTION to recomm.end approval of the Wensmann Seventh Addition preliminary plat and
planned unit development subject to:
1. A temporary cul-de-sac or street connection to Dodd Blvd/Diamond Path be constructed
at the western terminus of Diamond Path;
2. Easements for drainage and utilities, and trails must be shown on the plat;
3. The grading plan should be revised to include bernns along the Diamond Path and CS.AH
42 right-of-ways were ever possible as well as proposed contours matching established
grades in Wensmann Second, Fifth and Sixth Additions;
4. Building setbacks should be increased for lots 1, block 3, and lot 10, block 4 adjacent to
the private entry driveway into blocks 5,6 and 7;
5. Turning radius must be increased to 25 feet for emergency vehicle movements on the
private street;
6. A cul-de-sac or alternative turnaround facility acceptable to the Fire Marshall must be
provided at the eastern terminus of the private street adjacent to CSAH 42;
7. No parking will be allowed on the private streets;
8. The right of ways for all streets must be a minimum of 60 feet in width;
9. Entzy monuments nnust not interfere with sight triangle criteria;
10. A homeowners association agreement and declaration of covenants will be necessary to
secure the maintenance of common areas driveways and private streets,
11. Demonstrations showing how all lots needing variances can be developed so that no
hardships will be created resulting in future variance expectations;
12. Landscaping should be enhanced in the follo�ving areas:
a) along CSAH 42;
b) in the common areas that separate differing housing types;
c) to screen housing and traffic from headlight glare;
d) in the townhouse private entrance for separation from the houses on Lot 1, Block 3
and Lot 10, Block 4; and
e) all corner lots must have one boulevard tree per frontage.
13. Park Dedication will include the 1.6 acres �vith the remai�cung balance in the form of cash
contribution. The park land�vill be graded and seeded with the development; and
14. A sidewallc�vill be constructed along the north side of December Trail and an eight-foot
�vide bituminous trail tivill be constructed along CSAH 42.
15. The development's share of the cost of improving Diamond Path shall be escro�ved in an
amount acceptable to the city engineer; and

The following is a review of the preliminary plat, grading, and utility plans for Wensmann
7th Addition by Engineering and Public Works. It is recommended that the Developer's
engineer make an appointment with City staff to review the street and utility plans before
going any further with those plans.
Sanitarv Sewer
The proposed layout shows sewers for the addition flowing southerly to the existing 8 inch
sanitary sewer pipe in the Daybreak Avenue right-of-way. 7his existing 8 inch pipe is
stubbed out to the border of Wensmann 5th Addition with the proposed Wensmann 7th
Addition. Making this connection at Daybreak Avenue is consistent with overall plans for
the Wensmann Additions.
Minor changes for the final construction plans would be limiting manhole offsets from the
centerline of the street to three feet or less and maintaining at least a 10 foot separation
between the sewer and water mains.
Watermain
The proposed watermain is somewhat consistent with the Comprehensive Water System
Plan for the City. The preliminary utility plan shows connections to existing 8 inch
watermains at three locations. One is along the southerly right-of-way of County 42 at the
easterly border with Wensmann 6th Addition. The second is within the right-of-way of
December Trail at the easterly border with Wensmann 6th Additian. The third 8 inch
connection is within the right-of-way of Daybreak Avenue at the southerly border with
Wensmann 5th Addition. In addition to the three connections to 8 inch watermains, the
developer proposes a connection to an existing 12 inch watermain with a 8 inch
watermain. This connection would be along vacant right-of-way for County 33 at the
southerly border with Wensmann 5th Addition.

A major change that staff feeis is necessary is a connection between watermain north and
south of County 42. The Comprehensive Water System Plan for the City proposed this
connection taking place about 800 feet east of the intersection of County 42 and Diamond
Path with 12 inch main. In addition, a segment of watermain running roughly north-south
through the addition needs to be 12 inches in diameter. A segment of 8 inch watermain
could be increased to 12 inch watermain with the City paying the additional cost for the
increase in line diameter. The City would also fund the entire cost of constructing a 12
inch watermain from about the Dodd Boulevard and Delft Avenue intersection south
through County 42 right-of-way to the proposed Wensmann 7th Addition.
Minor changes for the final construction plans would be the elimination of some of the
bends, adding gate valves and hydrants, and adjusting gate valve and hydrant locations
where required. The watermain should stay within the paving limits of the street.
DrainaQe
According to the Comprehensive Western Rosemount D;ainage Study and reviews of the
Wensmann 6th Addition, all of this addition and approximately 6 acres of Wensmann 6th
Addition will drain to the south-southwest. Land area to the west (Apple Valley & Diamond
Path ROW) and portions to the south (in Wensmann 5th) should also be considered as
draining through Wensmann 6th since contours on the preliminary grading plan indicate
this drainage pattern.
All storm drain facilities from this proposed addition will flow to an existing 36 inch storm
drain pipe that currently ends within the right-of-way of Daybreak Av. at the southerly
border with Wensmann 5th addition. The 36 inch line eventually outfalls to the south of
152nd St. into the existing Wensmann Addition Pond adjacent to Diamond Path at the
western boundary of Rosemount.
A major change needs to be done with the�4 inch storm sewer thatwas stubbed out to the
west at the border with Wensmann 6th Addition at December Trail. The 24 inch storm
sewer will have to be continued into this proposed addition. Bulkhead work will need to
be done to the existing storm sewer at the intersection of December Trail and Danville
Avenue.
Any mainline storm sewer should stay within the limits of the street paving whenever
possible. All catch basins shall have a two foot sump.
Streets
The proposed streets within the subdivision that would be of public domain are the
December Trail extension, Daybreak Av. extension, and the two cul-de-sacs to the south
of December Trail. December Trail is the obvious through street.

The alignment of Daybreak Av. with December Trail shall be changed so that it is a 90
degree angle. The streets will need to be built to current City standards of 32 feet face to
face. The 34 feet back to back shown on the plans is not adequate. The streets will need
concrete curb & gutter, a 60 foot right-of-way, and a 25 foot radius at intersections. The
entrance to the cul-de-sacs needs a 60 foot right-of-way instead of the 54 foot right-of-way
shown on the plans. The City requires a 120 foot diameter right-of-way on cul-de-sacs
with a 45 foot face to face diameter on cul-de-sacs. Staff is not sure what "BF" stands for
in the cul-de-sac dimensions shown in the plans.
Staff is currently checking with the County on their plans for constructing an extension of
County 33 (Diamond Path) within their right-of-way as shown on the preliminary plans.
The intersection point of December Trail with Diamond Path must be approved by the
County Highway Department. If Diamond Path is not extended to at least December Trail,
provisions will have to be made for a temporary cul-de-sac at the western end of
December Trail. The Developer will be responsible for one half a residential street
equivalent assessment for Diamond Path, whether or not it is constructed at this time, per
the assessment policy.
The driveways for L1, B4 and L1, B1 shall be located as far east as possible. The
driveways for L2, B1; L6, B1; L5, 62; L10, B2 shall be located on the cul-de-sacs. The
driveway for L7, B1 shall be located on Daybreak Avenue.
Sidewalk nesds to be continued along the north side of December Trail from Wensmann
6th Addition. Bike path needs to be continued along the County 42 right-of-way on the
north side of the addition.
The private streets will be the total responsibility of the Developer, but must meet the Fire
Marshal's recommendations for emergency vehicle requirements.
Any street lighting in the proposed addition falls within the service area of Dakota Electric.
The Developer is responsible to work with Dakota Electric on the design and payment for
the lighting.
Easements
We recommend that the proposed sanitary sewer and watermain facilities have easements
to our satisfaction be dedicated through the platting process. The City would then
continue its past practice of owning the watermain and sanitary sewer within the
easements up to the curbstop or shut-off valve for each individual townhome. Then the
� Developer or eventual owner of each lot or the townhome association would be
responsible from that point to the actual structure.

The storm sewer into and out of the right-of-way along the proposed December Traii also
requires addressing. My recommendation is to have the City responsibie for storm drain
within the right-0f-way line. From that point it would be the responsibility of the Developer
and eventually the townhome association. This would be very similar to a commercial or
industrial lot where a connection point is provided outside the right-of-way. The ownership
and therefore the maintenance of the storm drain is the responsibility of the private owner.
Staff also requests the trail easement along the south side of County 42 be extended from
Wensmann 6th Addition through #he proposed Wensmann 7th Addition; and that #his
easement be shown on all plats and street and utility plans.
Larger easements on lot lines in the single family residential lots will be required where
public utilities are located.
