Review, Engineering, and Count . On March 7, 1995 the City Council conducted a public hearing regarding the Mallard Pond Administrative Plat for two lots and an outlot. Action was tabled, however, because of a recorded lot split that had occurred in 1988, generally in the vicinity of the two lots. The plat has been modified to include appropriate references to the 1988 lot division that shows up on 0utlot A. Essentially, the two lots that are being platted erase the division line that previously divided them. In addition, the lots now include easements requested by the city engineer. The Planning Commission have discussed and recommended approval of the subdivision at their meeting on February 14, 1995 . The lots comply with agricultural density and dimensional standards which eliminates any need for a rezoning. : Percolation tests have been performed for the vacant lot. CITY OF ROSEbiOUNT DAKOTA COUNTY, MINNESOTA RLSOLIITION 1995- A RSSOLIITION APPROVING THE blALLARD POND ADMINISTRATIVB PLAT �SEREAS, on March 7, 1995 the City Council of the City of Rosemount held a public hearing and approved :the administrative plat for Mallard Pond subject to conditions; and D+TSEREAS, the developer, Winkler Development, has made application for approval of the agricultural subdivision for Mallard Pond; and WSEREAS, the Planning Commission of the City of Rosemount reviewed the final plat on February 14, 1995 and has recommended approval of the Mallard Pond subdivision. NOL�1, THEREFORE, BE IT RESOLVED, the City Council of the City of Rosemount hereby approves the Mallard Pond agricultural subdivision subject to: 1) dedication of easements for drainage and ponding as required by the city engineer on Lots l and 2, Block l and Outlot A; 2) approval by the Dakota County PTatting Commission including : the dedication of five feet of half right-of-way as required; and 3) Park Dedication in the form of two units of cash contribution at the rate established by the current fee resolution; and 4) Geographic Information Systems (GIS) contribution for two units at the rate established by the current fee resolution. Mr. Bart�I'uikier, owner of approximately 170 acres of land in the Abariculture district east of Bacardi Avenue and north of Counry Road 38 is requesting approval of a plat that would result in two residential lots of fifteen and five acres, and an outlot of approximately 150 acres. The 15 acre lot contains an existin� house that would be for saie. The five acre lot is vacant and ava7able for sale. The outiot may be subdivided for residential use in the future, preferably if or when sewer and water is avaiiable. The property is not anticipated to be available for inclusion into the Metropolitan Urban Service Area (11�NSA) until after the year 2013 accordin; the Comprehensive Guide Plan. RESID�DEVELOPNiEN'T ISSUES - Both lots conform to current standards for lots in the Agriculture District. Both have or exceed 300 feet of frontage on Bacardi Avenue. The maximum density requirement is met at the one dwellin� unit per 10 acres. The properties will have private septic systems and wells. The existina contoun are shown • on the preliminary site plan with proposed primary and altemative locations. The aiternative drain field location for lot 1 should be moved north, away from a low area that functions as a drainaae course. A wetland separates the two lots and house sites. An easement for ponding should be _ required over the ordinary hiah water elevation for the wetland. The same will be required for the la�e. The Dakota County Plat Commission has reviewed the plat and requires an additional five feet of right-of-way from the property that fronts County Road 38 on the south. This contnbutes towards the czoss-section nerdeci for a two lane rural hiahway per County guidelines. The house on lot 2 was built several years ago with the 170 acres under single ownersiup. Consequendy, the driveway extends south onto the out3ot where a maintenance shed is located, before connecting to Bacardi Avenue. The driveway has b�a modified in response to a Planning Staff suggestion tbat it be reoriented so that the house does not depend on easements on adjacent parcels for access. Any remnant driveway that extends across the boundary line from lot 2 to the outlot will have Iegal non-conform.ing status within five feet on either side of the boundary line. Drainaae Easements The attached map shows ponding and utility & drainage easements required by the Cifij. Pfease show the required easements on the plat. The ponding e�s�ments were estabiished using peak elevations provided in the 1989 City of Rosemounf Drainage Pian. The utiiity & drainage easements were estabfished by field surveys and ti�e 1989 Cify of Ros�mount Drainage Plan. Note that this property contains Minnesota DNR numbered wetlands 320W, 321 W and 12W. Drain Field The proposed altemate drain field for proposed Lot 1, Blocic 1 is bisected by a 30 foot wide utility and drainage easement.
