RECOMMENDED ACTION: Motion to approve agreements with the Minnesota
Department of Public Safety for the use of the Criminal Justice Data Communications
Network and authorizing the Mayor and City Clerk to execute the agreements.
BACKGROUND
The State of Minnesota Department of Public Safety (DPS) maintains a data communications network
for the transmission of criminal justice data. This network is used by the Police Department and the
City’s Prosecuting Attorney as a secure connection for accessing various services of DPS and
transmitting data to DPS. This Joint Powers Agreement (JPA) was approved for the Police
Department in May 2016 for a five year period. A JPA is needed for the Prosecuting Attorney as well,
which is attached.
ISSUE
The criminal justice data network (CJDN) is utilized by law enforcement, prosecutors and the court
system to access several services offered by MN DPS. Each of the services previously had its own
separate agreement; the DPS is now streamlining its process by incorporating all the agreements into
this one master agreement.
The services include access to a number of data bases used regularly during the investigation and
prosecution of criminal activity. An agreement is currently in place for the Police Department. The
JPA to approve tonight is on behalf of the Prosecuting Attorney and is for a five (5) year period.
Cost for the services is included in the JPS Clause 3; there are no fees for this service beyond the costs
already paid under the JPS for the Police Department’s access. The amount is budgeted for annually
within the Police Department operating budget.
The agreement was prepared by City Prosecutor Daniel Fluegel.
RECOMMENDATION
Staff recommends that Council approve the agreement and authorize its execution.

RESOLUTION NO. 2017 - ______
A RESOLUTION APPROVING STATE OF MINNESOTA JOINT POWERS
AGREEMENTS WITH THE CITY OF ROSEMOUNT
ON BEHALF OF ITS CITY ATTORNEY
WHEREAS, the City of Rosemount on behalf of its Prosecuting Attorney desires to enter
into Joint Powers agreements with the State of Minnesota, Department of Public Safety, Bureau of
Criminal Apprehension to use systems and tools available over the State’s criminal justice data
communications network for which the City is eligible. The Joint Powers Agreement further
provide the City with the ability to add, modify and delete connectivity, systems and tools over the
five year life of the agreement and obligates the City to pay the costs for the network connection.
NOW, THEREFORE, BE IT RESOLVED by the City Council of Rosemount,
Minnesota as follows:
1. That the State of Minnesota Joint Powers Agreements by and between the State of
Minnesota acting through its Department of Public Safety, Bureau of Criminal Apprehension and
the City of Rosemount on behalf of its Prosecuting Attorney, are hereby approved. Copies of the
Joint Powers Agreement is attached to this Resolution and made a part of it.
2. That the City Administrator, Logan Martin, or his successor, is designated the Authorized
Representative for the Prosecuting Attorney. The Authorized Representative is also authorized to
sign any subsequent amendment or agreement that may be required by the State of Minnesota to
maintain the City’s connection to the systems and tools offered by the State.
3. That William H. Droste, the Mayor for the City of Rosemount, and Clarissa Hadler, the City
Clerk, are authorized to sign the State of Minnesota Joint Powers Agreements.
