Mr. Herb Wensmann is requesting approval for a residential planned unit development called Wensmann Sixth Addition. The request includes approval of the final development plan, preliminary plat, and rezoning. the 19 single famil�r lots will be rezoned from AG Agriculture to R-1 Single Family Residential Detached. The 87 townhouses will be rezoned from AG Agriculture to R-2 Single Family Residential Attached. The Planning Commission reviewed the concept on January ll, 1994 and on February 8, 1994 they recommended approval of the final development plan, preliminary plat, and rezonings. The proposal has also been reviewed by the Parks and Recreation Gommittee and modified as a result. The Comprehensive Guide Plan Land Use Designation is Urban Residential . As such, the proposal is in conformance with the Comprehensive Guide Plan and applicable zoning standards. After the public hearing is conduct�d, action on the rezaning should be tabled until a final plat is approved. The Planning Commission reviewed the Planned Unit Development (PUD) Concept on January 11, 1994. The proposal has been refined as a result of issues identified by the �, Planning Commission. The Planning Commission is asked to review the refined development plans and foiward a recommendation to the City Council. The City Council will conduct a public hearing to hear testimony relative to the development proposal, preliminary plat and rezoning. After the public hearing is closed, the Council will be able to take action on the PUD and preliminary plat. With approval af the preliminary plat, a finai plat will be reviewed by the Planning Commission. That the praposed density for the townhouse clusters be maintained in return for increased site amenities as requested by the Parks and Recreation Director; 2. That the City Engineer approve the concept utility and grading plans to verify that existing infrastructure is capable of serving the PUD; 3. That implementation of the ahovementioned recommendations as well as attention to issues identified by the Planning Commission will allow the residential FUD to be developed with variance to lot width standards as specified in the Zoning Ordinance; and 4. The site will be platted in conformance with the City of Rosemount Subdivision Ordinance as well as all constroction conforming with applicable building and fire codes. PUD REFnvEMEh�rs The Developer has made a commitment to the Park and Recreation Commission to dedicate additional land for park use in the anticipated future phase contiguous with the half acre parcel in the current phase. The Planning Department understands the proposed park dedication combination of eash and land to be acceptable to the Park and Recreation Commission. The Developer conducted a neighborhood meeting to discuss the development proposal. Six people from the neighborhood were in attendance as well as Councilmember Busho. Kelly Murray representing the Developer summarized the issues: "Major topics of concern were Danville Avenue not be�oming a cul de sac, when Dodd/Diamond Path would be extended, what we plan for the other property, and the prices of the townhomes. No real objections were raised.° As previously mentioned, a public hearing will be conducted by the City Council for the PUD,preliminary plat and rezoning. The lots along the western project boundary have been adjusted to address the lot-width deficiency issue. The proposed 151 st Street West has been shifted 5.8 feet north. As a result, the three interior lots are consistent in lot-width with the lots to the west. The corner lot is now 90 feet wide which should be sufficient to accommodate the required street-side yard setback without placing undue limitations or impose a need for variances on the lot. There is no change to the street design. Danville Avenue must connect to 151 st Street West for efficient traffic flow and dispersal through the area. Traffic as projected by the City Engineer would not sigruficantly increase along the effected section of Danville Avenue. This is because it does not align with through-streets to the south. Rather, the net impact will be to disperse traffic both north and south from Danville. Future street connections that will be built in connection with the Shannon Pond residential PUD to the south will further diffuse traffic flows in the area, thus relieving some pressure on 153rd Street West. The City has asked the County to include the Diamond Path improvements in their Capital Improvement Plan. The participation of Apple Valley is necessary for this project to *� = Wensmann Sixth Addition Final PUD Review February 8, 1994 Page 3 proceed. Apple Valley currently is not in support of the project which results in uncertainty far timing of the project. LANDSCAPING A landscaping plan has been develaped for both trees and foundation plantings. The proposed landscaping includes 368 deciduous, evergreen and ornamental trees. The proposed landscaping is more than four times the minimum ordinance required amount when compared to the combined with the proposed shrub beds and foundation plantings. GRADING AND UTII.ITIES Mr. Osmundson, City Engineer, is recommending modifications to the grading plan. It is the opinion of the Planning Department that minor revisions to the grading and utility plans that do not impact the overall design of the project can be resolved prior to the public hearing with the City Council. If the recommended changes have a si�cant unpact that results in changes to the design of the PUD, then the revised PUD should come back to the Planning Commission for further review. CONCLUSION Planning Staff believes that the Developer has responded to all of the identified issues with appropriate revisions to the PUD with the only exception being grading and utilities as mendoned above. Absent any significant changes to the design of the PUD, Planning Staff recommends that the PUD be forwarded to the City Council for public hearing and consideradon by Council. A development agreement will be prepared to secure developer installed unprovements and other issues including park dedication. RECONIlVIENDATION MOTION to recommend approval of the Wensmann Sixth Addition residential Flanned Unit Development to the City Council subject to the preparation and execution of a development agreement securing the Developer installed impravements, park dedication, giading and utility issues and compliance with all other applicable code requirements; - and - . Mr. Herb Wensmann of Wensmann Homes, Inc. is proposing to develop a 27.3 acre parcel for residential use combining attached and detached single farnily homes. The Proposal is called Wensmann Sixth Addition. The proposal is a scaled-down initiative to develop properry that was recently designated for urban residential use as a result of the Comprehensive Guide Plan Update 2000 process. The Planning Commission may recall the previous proposal that extended west from Sha.nnon Parkway to the westem boundary of Rosemount at the Diamond Path area, south of C.S.A.H. 42. The current proposal encompasses the approximate eastern half of the area subject of the mixed use proposal of last year. The land zs currently zoned Agricultural. PR CESS : Planned Unit Development (PUD) review is required because the project involves three different housing types that will be developed on separate parceis. The single family houses will be on separate lots, in the R-1 Single Family Detached Zoning District consistent with existing residential uses adjacent to the south. The attached single family houses will be developed in two styles of townhouses, maintained by se�arate associations on property that will be in the R-2 Single Family Attached Zoning District. The process is broken down into three major azeas: L CONCEPT REVIEW WITH TSE PLANNING COMIVIISSION; . 2. FINAL DEYELOPMENT (OF THE CONCEPT)REVIEW WITH THE pLA,NNING COMIVIISSION� AND 3. Single family lots backing up to the existin� singte famiIy lots to tl�.e sauth. The proposed lots nieet or exceed current lot area and depth standards. Lot width is consistent with standards of the adjacent single family development to the south. Given that this is an "infill" developmEnt, consistency with adjacent lot lines and right-of-ways is necessary for functional s+seet co;_nections and appropriate trans:tions between neighborhoods; and 2. Two types of townhouses arranged in two "clusters" will be developed on the north side of an east-west street that provides ac::ess to the single family houses. The eastem half will offer sin�le-level "rambter° snits in one cluster that will be marketed to "empty nesters". The westem half wilI offer two-level "sptits" in the other cluster that are typically purc :xsed by s�:�gles and couples. The new street will separate the townhouses from the single family units. ACCESS The new east-west street will extend from Shannon Parkway on the east to a temporary cul-de-sac at the westem property boundary. Danville Avenue would be extended from the south, and connect with the new east-west street. Only single-family houses would have frontage on Danville Avenue. The Developer has had neighborhood meetings in response to the previous public hearing. The neighborhood representatives requested that Danvilie Avenue terminate in a cut-de-sac. After reviewing the initial proposal, Staff recommended that Danville becom� a through-street for three reasons: 1. Danville Avenue provides the only north-south circulation into the development area between Sharu�on Parkway and anticipated Diamond Path in a central location; 2. Without the connection, the PUD would have only one access point (until future development occurs on the property to the west); and 3. Danville Avenue as a cul-de-sac would be in excess of ordinance standards for cuI-de-sac length at more than 800 feet resulting with added traffic pressure to 153rd Street. Long cul- de-sacs cause difficulties occasionally for public safety respanse as well as snow storage. No direct access is praposed to CSAH 42. The interior streets serving the two townhouse clusters wi11 be private and maintained by the associations. Easements will provide access rights and protect utilities. I1vFItASTRUCT[7RE IS �S A concept utility plan has been provided for review by the City Engineer to determine if capacity is available for the increased density. The density of the combined townhouse portion of the PUD is slightly below six dwelling units per acre. Therefore, the proposal fits within Metropolitan guidelines for urban residential and a Guide Plan Amendment is not necessary. , l Wensmanu Sixth Addition, Concept PUD Review January 11, 1994 Page Three The Parks and Recreation Commission have reviewed the PUD enncept and motioned to request that a mini-park be included in the PUD to provirle for an-site recreational amenities. This action i� the result of experi�nce with other attached and multi-family housing projects that have been built without or with limited on-site recreational amer.i�ies. Given the anticipated demographics of the projected townhouse owners, it would appear that play equipment would be undesirable for ±he single level townhouse cluster. Site amenities are being considered, however, with open space, landscaping, benches and trails in a °linear" amenity separating the two clusters. Additional consideration has been asked of the Developer for the two-level xownhouse cluster including pl3y equipment. There is potential for revisions that would provide open space arid othvr amenities along the western boundary of the clT.ister that could be assembled with future deaelopment on the adjacent land. A sidewalk will be installed on the nor`,.h side of the east-west street, thus providing pedestrian ! bike access to the trail on Shannon Parkway and access to Jaycee Park as a result. A fence will separate the single level townhouse cluster from the sidewalk. An eight foot wide bike/pedzstrian trail will be installed or. the south side of CSAH 42 as part of the County regional trail system. CONCLUS70NS The proposal provides a Iogical approach to the organization of the housing types with appropriate separation between the attached and deta.ched housing types. The proposed street system provides for efficient dispersal of traffic with little or no impact on the existing street system to the south. The proposed density will fall within urban residential standards as set forth in the Comprehensive Guide Plan. The largest issue appears to be the provision of "mini park" amenities as requested by the Park and Recreatio,i Commission. The amenities should justify the developer's ability to maintain the density of six dwelling units per acre for the townhouse clusters which provide for the needs of a unique mazket niche. xEca�rmArlorr MOTION to approve �,he Concept review for the Wensmann Sixth Addition Residential Planned Unit Development subject to the following considerations by the Plannina Commission: 1. Request for Plat Ap roval. The Developer has asked the City to approve a plat of land to be known as WFavslv�a�v�v S� Annrrlort (also referred to in this contract as the "plat"). The land is legally described as follows: The east 1273.36 feet of the Northwest Quarter (NWS'/a) of Section 31, Township 115, Range 19, Dakota County, Minnesota, except the south 50.00 acres thereof. Subject to County Road No. 42 and Shannon Parkway. 2. P.U.D. Approval. The City approved the Wensrnann Sixth Addition Planned Unit Development on March 2, 1994. 3. Conditions of Plat AD rp oval. The City hereby approves the plat on condition of 1) approval of a grading plan by the city engineer; 2) rezoning of the property from AG Agriculture to R-1 Single Family Residential Detached and R-2 Single Family Residential Attached; 3) Pazk Dedication in the cash amount of $57,'740.00 in combination with land dedication identified in the plat as Outlot A to the City; and 4) execution of a Subdivision Development Agreement. 4. Phased Development. The City may refuse to approve final plats of subsequent additions of the plat if the Developer has breached this Contract and the breach has not been remedied. Development of subsequent phases may not proceed until Development Contracts for such phases are approved by the Ciry. 5. Effect of Subdivision Ap roval. For two (2) years from the date of this Contract, no amendments to the City's Comprehensi�e Plan, except an amendment placing the plat in the current urban service area, or official controls shall apply to or affect the use, development density, lot size, lot layout or dedications of the approved plat unless required by sta.te or federal law or agreed to in writing by the City and the Developer. Thereafter, notwithstanding anything in this Contract to the contrary, to the full extent permitted by sta.te law the City may require compliance with any amendments to the City's Comprehensive Guide Plan, official controls, platting or dedication requirements enacted after the date of this Contract. 6. Development Plans. The plat shall be developed in accordance with the following plans. The plans shall not be attached to this Contract. The Developer shall obtain all necessary� permits from the Minnesota Pollution Control Agency (MPCA), Minnesota Department of Health (MDOI-�, and other agencies before groceeding with construction. The City sha11 provide field inspection to ensure an acceptable level of quality control to the extent that the Developer's engineer will be able to certify that the constructian work meets the approved City standards as a condition of City acceptance. The Developer or his engineer shall schedule a preconstruction meeting at a mutually agreeable time at the City Couneil chambers with all the parties concemed, including City staff, to review the program for the construction work. Within thirty (30) days after the completion of the improvements and before the security is released, the Developer shall supply the City with a complete set of reproducible "Record Plan" drawings. � Wensman6.dev Page 2 of 8 , .. 8. The letter of credit shall be for a term ending December 31, 1997. In the alternative, the letter of credit may be for a one (1) year term provided it is automatically renewable for successive one year periods from the present or any future expiration dates with a fmal expiration date of December 31, 1997, unless sixty (60) days prior to an expiration date the bank notifies the City that it elects not to renew for an additional period. The letter of credit shall secure compliance with the terms of this Contract and all fmancial obligations of the Developer under it. The City may draw down on the letter of credit without notice upon receiving notice that the letter of credit will be allowed to lapse before December 31, 1997. In the event of a default under this Development Contract by the Developer, the City shall furnish the Developer with written notice by certified mail of Developers default(s) under the terms of this Development Contract. If the Developer daes not remove said default(s) within two (2) weeks of receiving notice, the City may draw on the letter of credit. With City approval the letter of credit may be reduced once per year as financial obligations are paid and public improvements are completed to City's requirements. : 9. Tune of Performance. The Developer shall instali all required improvements enumerated in Paragraph 7 which will serve the plat by July 31, 1995. The Developer may, however, request an extension of time to the City. If an extension is granted, it shall be conditioned upon updating the security posted by the Developer to reflect cost increases and the extended completion da.te. 10. Grading Plan/5ite Grading. The Developer shall submit to the City a site grading and drainage plan for the entire plat acceptable to the City showing the grades and drauiage for each lot prior to installatian of the improvements. Site grading shall be completed by the Developer at its cost and approved by the City Public Works Director. Developer shall furnish the City Public Works Director satisfactory proaf of payment for the site grading work and shall submit a certifieate of survey of the development to the City after site grading, with street and lot grades. All impro�ements to the lots and the final grading shall comply with the grading plan as submitted and shall be the responsibility of the Developer. Wensman6.dev Page 3 af 8 ; !- All basement and/or foundation excavation spoil piles shall be kept completely off City right-of-way and shall be completely surrounded with an approved erosion control silt fence. The City also requires that approved erosion control fencing be installed around the perimeter of each lot at the tune of building permit issuance and remain in place until the lot is seeded or sodded. A twenty-foot opening will be allowed on each Iot for construction deliveries. 11. License. The Developer hereby grants the City, its agents, employees, officers and contractors a license to enter the plat to perform all work and inspections deemed appropriate by the City during the installation of publia improvements by the City. The license shall expire after the plat has been developed. 12. Erosion Control. Prior to site grading, and before any utility construction is commenced or building permits are issued, the erosion control plan, Plan B, shall be unplemented, inspected a.nd approved by the City. All areas disturbed by the excavation and backfilling operations shall be reseeded within 72 hours after the completion of the work in that area. Except as otherwise provided in the erosion control plan, seed shall be rye grass or other fast-growing seed suitable to the existing soil to provide a temporary ground cover as rapidly as possible. All seeded azeas shall be mulched and disc anchored as necessary for seed retention. The parties recognize that time is of the essence in controlling erosion. If the plat development does not comply with the erosion control plan and schedule or supplementary instructions received from the City, the City may take such action as it deems appropriate to control erosion, including those provisions listed in paragraph 10. The City will endeavor to notify the Developer in advance of any proposed action, but failure of the City to do so will not affect the Developer's or City's rights or obligations hereunder. If the Developer does not reimburse the City for any cost the City incurred for such work within thirty (30) days, the City may draw down the letter of credit to pay any costs. No development will be allowed and no building permits will be issued unless the plat is in full compliance with the erosion control requirements. 13. Planting and Seeding. Prior to the City allowing occupancy, the Developer shall plant one (1) two-inch caLiper deciduous tree on each street frontage of ea.ch lot and the Developer shall also sod the boulevards, all at its awn cost. 14. Clean un. The Developer shall clean dirt and.debris from streets that has resulted from construction work by the Developer, its agents or assig�ns. The City will inspect the site on a weekly basis and determine whether it is necessary to take additional measures to clean dirt and debris from the streets. After the Developer has received 24 hour verbal notice, the City will complete or contract to complete the clean-up at the Developer's expense, as per the conditions under Paragraph 12. 15. Ownership of Imnrovements. Upon completion and City acceptance of the work and construction required by this Contract, the public impravements lying within public rights- of-way and easements shall become City property without further notice or action. 16. Warrantv. The Developer warranties all work required to be performed by it against poor material and faulty workmanship for a period of two (2) years after its completion and Wensman6.dev Page 4 of 8 ff- . � � . � . . . . � acceptance by the City. All trees, grass and sod shall be warranted to be alive, of good quality and disease free for twelve (12) months after planting. The Developer shall post maintenance bonds or other security acceptable to the City to secure the warranties. 17. Responsibilitv for Costs. A. Except as otherwise specified herein, the Developer shall pay all costs incurred by it or the City in conjunction with the development of the plat including, but not limited to, Soil and Water Conservation District charges, legal, planning, engineering and inspection expenses incurred in connection with approval and acceptance of the plat, the preparation of this Contract, and all costs and expenses incurred by the City in monitoring and inspecting development of the plat, and the enforcement of this contract. B. The Developer shall hold the City and its officers and employees hannless from claims made by itself and third parties for damages sustained or costs incurred resulting from plat approval and development. The Developer shall indemnify the City and its offieers and employees for all costs, damages ar expenses which the City may pay or incur in consequence of such claims, including attorney's fees. C. The Developer shall pay, or cause to be paid when due, and in any event before any penalty is attached, all special assessments refened to in this Contract. This is a personal obligation of the Developer, Wensmann Realty, Inc., and shall continue in full force and effect even if the Developer sells one or more lots, the entire plat, or any part of it. D. The Developer shall pay in full all bills submitted to it by the City for obligations incurred under this Contract within thirty (30) days after receipt. If the bills are not paid on time, the City may halt plat development work and eonstruetion including, but not limited to, the issuance of building permits for lots which the Developer may or may not have sold, until the bills are paid in full. Bills not paid within thirty (30) days shall accrue interest at the rate of nine percent (9%) per year. E. In addition to the charges and special assessments refened to herein, other charges and special assessments may be imposed such as, but not limited to, sewer availability charges ("S.A.C."), City water connection charges, City sewer connection charges, City storm water connection charges and building permit fees. F. The Developer shall pay all energy costs for street lights installed within the Wensmann Sixth Addition until seventy-five percent (75%) of the lots are occupied. After that, the City will assume the energy costs. 18. Building Permits. Na building permits shall be issued until: A. The site grading has been completed and approved by the City. B. All public utilities must be tested, appraved by the City Engineer, and in service. All curbing must be installed and backfilled, the first lift of bituminous must be in place and approved by the City. Wensman6.dev Page 5 of 8 . � C. The City Public Works Director has cert�ed that the timetable for construction of public improvements is compatible with private home construction and occupancy. D. The Developer, in executing this Agreement, assumes all liability and costs for damage or delays, incurred by the City, in the construction of public improvements, caused by the Developer, its employees, contractors, subeontractors, materialmen or agents. No occupancy permits shall be issued until the public utilities referred to in paragraph 7 are in and approved by the City, unless otherwise authorized in writing by the City Public Works Director. 19. Developer's Default. In the event of default by the Developer as to any of the work to be performed by it hereunder, the City may, at its option, perform the work and the Developer shall promptly reimburse the City for any expense incurred by the City, provided the Developer is first given notice of the work in default, not less than 48 hours in advance. This Contract is a license for the City to act, and it sball not be necessary for the City to seek a court order for permission to enter the land. When the City does any such work, the City may, in addition to its other rer�edies, assess the cost in whole or in part. 20. Miscellaneous. - A. The Develaper represents to the City that the plat complies with all city, county, metropolitan, state and federal laws and regulations including, but not limited to: subdivision ordinances, zoning ordinances and environmental regulations. If the City determines that the plat does not comply, the City may, at its option, refuse to allow constxuction or development work in the pla.t until the Developer does comply. Upan the City's demand, the Developer shall cea.se work until there is compliance. B. Third parties shall have no recourse against the City under this Contract. C. Breach of the terms of this Contract by the Develoger shall be grounds for denial of building permits, including lots sold to third parties. D. If any portion, section, snbsection, sentence, clause, paragraph or phrase of this Contract is for any reason held invalid, such decision shall not affect the validity of the remaining portion of this Contract. E. If building permits are issued prior to the completion and acceptance of public improvements, the Developer assumes all liability and costs resulting in delays in completion of public improvements and damage to public improvements caused by the City, Developer, its contractors, subcontractors, materialmen, employees, agents or third parties. No occupancy permit shall be issued until public improvements in paragraph 7 are in and approved by the City. F. The action or inaction of the City shall not constitute a waiver or amendment to the provisions of this Contract. To be binding, amendments or waivers shall be in writing, signed by the parties and approved by written resolution of the City Council. The City's failure to promptly take legal action to enforce this Contract shall not be'a waiver or release. Wensman6.dev Page 6 of 8 . w G. The Developer represents to the City to the best of its knowledge that the plat is not of "metropolitan significance" and that an environmental impact statement is not required. If the City or another governmental agency determines that such a review is needed, however, the Developer shall prepare it in compliance with legal requirements so issued from the agency. The Developer shall reimburse the City for all expenses, including staff time and attorney's fees, that the City incurs in assisting in the preparation of the review. �i. This Contract shall run with the land and may be recorded against the title to the property. After the Developer has completed the work required of it under this Contract, at the Developer's request, the City will execute and deliver to the Developer a relea se. I. Each right, power or remedy herein confened upon the City is cumulative and in addition to every other right, power or remedy, express or implied, now or hereafter arising, available to the City, at law or in equity, or under any ather agreement, and each and every right, power and remedy herein set forth or otherwise so existing may be exercised from time to time as often and in such order as may be deemed expedient by the City and shall not be a waiver of the right to exercise at any time thereafter any other right, power or remedy. J. The Developer may not assign this Contract without the written permission of the City Council. K. the City assumes no responsibility for the design, construction, maintenance, or longevity of developer installed retaining walls. L. Park Dedication will be a combination of cash and land dedication. A total of 0.83 acres of land will be dedica.ted for park development. Outlot A, Wensmann Sixth Addition will be dedicated to the City. The cash contribution will be in the amount of $47,693.00. M. Sidwalks will be installed by the developer on the north side of the east-west street labeled 151 st Street West and the west side of Danville Avenue. Eight-foot wide bituminous trails will be constructed by the developer south of CSAH 42 and along Shannon Parkway. If construction is deemed premature, then the value of the delayed improvement must be escrowed. 21. Notices.
