The letters all request specific information and range from one question to 35 questions each. I have copied each of the comment cards and letters to you. I have always intended to give a response to the requests, but not necessarity provide the documents as requested. Instead, however I would invite the requesting party to view the documents at City HaIL Any copies he would request would be made available at the normal fee established by resotution. To- date, I have not made any contact with the requesting party. Response has not been timely enough however and the Department of Administration has besn contacted by the requesting party. The State has been asked to render an opinion on the following: 1. Are the questions and documents asked and requested considered public data? 2. Was the method used to make the request a legitimate one? 3. Did th� �ity respond in a legal and timely manner? The Department pf Administration will be rendering their opinion no later than March 7, 1994. As you can see by reading the State's letter,no legal or binding action is taken by them, but their opinion may be considered by a court should legal action be brought by the requesting party. Mike Milgs and myself will be discussing the situation with Mr. Donald Gemberling prior to the established deadline. We will inform you of our discussion at the meeting Wednesday. The direction I need from Council is how you desire the response to the requesting party to be. Most of the questions will require research. Some of the questions need clarification. All of the questions have a vindictive tone to them. The�consequences of not answering the request in some fashion makes us appear to be hiding or avoiding issues, which we are not. To answer every question in detail will encourage this behavior to continue. My recommendation, as previously stated, is to acknowledge receipt and invite the party in to do his own research. Administration the authority to issue opinions about issues arising out of the Minnesota Government Data Practices Act and other laws relating to data practices. (See Session Laws of Minnesota, 1993, Chapter 192, Chapter 38, copy enclosed.) Both citizens and government agencies, that are subject to the Min.nesota Government Data Practices Act (Minnesota Statutes Chapter 13) and related laws, can request opinions. Aithough these opin.ions are not binding on the government entity whose data is the subject of an opinion, the opinions must be given deference by a court and may offer some legal protection for agencies who act in conformity with the opinion. The new legislation also directs the Commissioner of Administration to give a government entity the opportunity to explain its actions or decisions regarding the issues raised by a citizen who requests an opinion. The purposes of this letter are: to notify you that the Commissioner has received a request for an opinion concerning your position about the release of government data to the public, to give you an opportunity to explain that posirion and the legal basis for the position, and to ask you or attorney to offer any information, legal citations and other support for the City's position that may be helpful in rendering an opinion. This opinion has been requested by Mr. Iarry Wa1sh, a resident of � Rosemount. A copy of his letter requesting the oginion is enclosed. Tn his letter, Mr. Wa1sh describes unsuceessful attempts by him to gain access to government data maintained by the City of Rosemount. He then asks the Commissioner of Administration to provide an opinion on the following issues: Are the questions and dacuments [he asked and requested] considered public data, was the method he used to make lus request a legitimate one, [and] did the City respond in a legal and timely ma.nner. The article also states that the public can attend further commission neetings on this issue, wizich is true because the State of Minnesota forces the city to open these meetings to the public. The question is will the city allow the pLblic to ask qaesticns, r�ake com;�ents or recomendations at these meetings? Will the city answer their questions and give cor_sideration to there comments ox recomendations? Or are they jexking them around and lieing to them like they did with regards to the Special Neighborhood Informational Meeting on Nov. 17, 1993 ? 31 . Further on the article quotes Councilmember Anderson as saying "We have to%rememberfwhat our goals are" and "This project will be good for a lot of people" . will this project be good for the residents and taxpayers of Rosemount? Did Council Member Anderson get tfie H. R.A. to guarantee , that this project will remain a " senior housing" project forever? Did she get a guarantee that the residents of Rosemount, as investors in this project will recive extra considerations should they decide to reside in this building? Since it' s obvious that the city's goals are not those described in the objectives and policies of the Comprehensive Guide Plan 2000, Exactly what are "our goals"?
