At the February 15, 1994 regular council meeting, the City Council reviewed
a draft ordinance regulating sexual conduct and nudity in Rosemount
businesses. City Attorney Mike Miles advised you that the Council could
regulate this type of conduct through zoning or by tying the regulation to
' businesses which hold intoxicating and nonintoxicating liquor licenses.
The attached ordinance and the one discussed at the last meeting provides
regulation through the city's liquor ordinance.
Following discussion at the last council meeting, direction was given to
format the draft ordinance into final form. I am presenting'this final
draft for your adoption and recommend its approval.
RECOMMENDED ACTION: MOTION TO ADOPT ORDINANCE NO. XVI.28, AN ORDINANCE
AMENDING TITLE 3 PERTAINING TO LIQULDIREGOR SEEKINGOINTOXICATINGDANp �D
SEXUAL C4NDUCT IN ESTABLISHMENTS HO
NONINTOXICATING LIQUOR LICENSES IN ORDER TO PRESERVE ORDER AND PROTECT
THE PUBLIC WELFARE AND TO AVOID THE SECONDARY EFFECTS ATTENDANT UPON
ALLOWING SUCH ACTIVITY IN SUCH ESTABLISHMENTS

a. The licensee, owner or manager of any
licensed establishment permitting or allowing any
� live nudity to occur on the licensed premises.
b. The licensee, owner or manager of any
licensed establishment permitting or allowing any
live sexual conduct to occur in the licensed
establishment.
3. The City Council may suspend or revoke or refuse
to issue a license for violation of this section upon a
finding that the licensee has failed to comply with
this section. No suspension or revocation shall take
effect until the licensee has been afforded an
opportunity for a hearing.
Section 2: This Ordinance shall be effective immediately
upon its passage and publication.
