On March 22, 1994 the Planning Commission reviewed the xequest and recommended approval . The activity is essentially °paintball�� played in a naturally wooded area one-half mile north of STH 55, west of Fahey Avenue. There is a parking area, portable outhouse, and booths . Because of the low impact on the site and temporar�r nature of the use, the City Council has the ability to modify standards or requirements with the language in Section F. of Ordinance B-33 . The city engineer has found that 6" of crushed rock is a reasonable substitute for a paved parking lot in this case, as long as other standards would still apply. Planning staff recommends that the IUP be reviewed after one year. If at that time performance is satisfactory then the review interval could be extended to 2 to 5 years. (Commercial Outdoor Recreation) I1v'TERIM USE PERMI'r TO WHOM IT MAY CONCERN: NOTICE IS HEREBY GIVEN, the City Council of the City of Rosemount will hold a public hearing on Tuesday, April 19, 1994 in the Council Chambers of the City Hall, 2875 145th Street West, beginning at 8:00 p.m. or as soon thereafter as possible. The public hearing listed below pertains to the property generally located west of Fahey Avenue, one-half mile north of Trunk Highway 55 and legally described as follows: Part of the North Half of the Southwest Quarter (Nlh of SW1/a) of Section 21, Township 115, Range 18, Dakota County, Minnesota. The purpose of this hearing is to consider a request from the owners of Splatball, Inc. for approval of an Interim Use Permit that would allow them to conduct a Commercial Outdoor Recreational Use in the Agriculture District. A Commercial Outdoor Recreation Use located in the Agricultural District This Interim Use Permit (IUP) is valid only for that part of the Southwest Quarter of '' Section 21, Range 18 West, Township 115 North lying north of the right-of-way for State Trunk Highway 55 and west of Fahey Avenue. 1. This permit allows the operation of an interim use with modif'ications to standards spec�ed by the City of Rosemount Zoning Regulations as approved by resolution adopted by City Council on April 19, 1994. 2. This permit shall be reviewed prior to renewal in 1995 for conformance with these conditions. T'hereafter, the City Council will determine the appropriate time interval for the subsequent renewal procedure. 3. Violation of any specified IUP condition or otherwise unlawful activity may result in immediate revocation of the IUP. 4. Site improvements, as required, must be completed and accepted by the city engineer within sixty (60) da.ys of the date of Ciry Council approval. 5. The hours of operation shall be limited to 8:00 a.m. to sunset. 6. All permits required by other applicable agencies must be obtained and copies submitted to the City. 7. Conformance with setback and dimensional standards with variance to front yazd setbacks granted only for the purpose of preserving existing vegetation. 8. Parking areas must consist of a minimum of six (6) inches of compacted, crushed li.mestone or other such material acceptable to the city engineer. 9. The Adventure Zone - Interim Commercirxl Outdoor Recreational Use an the General Industrial District locrz�ed across from U.S.P.C.I. on the north east side of TH S5. 6b. Splatball Inc. - Interim Commercial Outdoor Recreational Use in the Agriculture I3istrict located on the west side of Fahey Avenue, one half mile south of Pine Bend Trail. Both of the proposed interim uses are "paint ball" games conducted on land that provides a � natural setting with vegetative cover. Typically land in a pre-development stage. Last year, a Zoning Text Amendment was adopted to create a process for interim commercial outdoor uses in the Agriculture and General Industrial District. The process for review should start with application of rypical standards for site unprovements such as setbacks and parking. Then, given the transitory nature of the use the City Council may modify the standards that originate from the City. � An IITP Agreement will be executed by the City, the operator and the property owner that will specify the conditions of the permit. The permit will have a termination date with opportunity for renewal. The permit may also have a regular timed review to monitor compliance with the IUP. DISCUSSION Planning Staff believes that the requirements for landscaping and paving may be waived for both uses. However, parking areas should have an aggregate surface along with other appropriate measures to inliibit erosion. Setbacks for buildings and parking should still be applied. The Uniform Building Code (UBC) has been adopted by the City and will be enforced. Planning Staff would also suggest that building materials conform with aesthetic standards especially when visible from public right-of-way (ROW) or adjacent property. In both cases, the Sign Ordinance should be enforced as well. � • Splatball Inc. essentially operates out of a booth and trailer being pra.ctically a "porta.ble" use. There are portable outhouses and a pazking area. The City Engineer has recommended that six inches of 100% crushed class 5 limestone would be an accepta.ble alternative to paving given that Fahey Avenue is unpaved. There is a culvert that must be cleaned out and possibly extended at Fahey Avenue to maintain the surface water runoff in the ditch. � a,;med on,Kvc�edWaoe. containing 30°'0 posr<onsumer marerials. Adventure Zone/Spiatball, Inc. I[TPs � P.C. Reviews 3/22/94 - Page 2 The Adventure Zone has more of a permanent appea.rance and a higher 1eve1 of visibility. The first comment is because there is a trailer on site similaz to the types used on construction sites. The trailer as such is not allowed by the Zoning Ordinance. The trailer and the steps up to the trailer will have to be brought into confonnance with the UBC as well as aesthetic requirements. The site plan indicates that the parking area lines up with the ROW of TH55 even though the setback is 40 feet. If the Planning Commission and City Council is willing to waive this setback, it only should be done to save trees. Evidence of a MnDOT access or driveway permit must be provided as well. CONCLUSION A permit agreement will be executed for each of the IUP°s. The duraxion of the permit should be defined as well as a regular review process. Planning Staff recommends that the IUPs be reviewed after the first year for compliance with the conditions of the permit. Violation of conditions could trigger a revocation process at any time as well. After the first annual review, the timing of subsequent regular reviews could be expanded to two or three year periods if no serious issues develop over the first year. RECONIMENDATION MOTION to recommend that the City Council approve the Interim Use Permits for both The Adventure Zone and Splatball Inc. subject to: 1. Conformance with setback and dimensional standards with variance to front yard setbacks granted only for the purpose of preserving existing vegetation; 2. Parking lots and entry drives must be approved by the City Engineer; 3. All permits required by other applicable agencies must be obtained by the operators of the IUPs with relevant documentation provided to the City; 4. All structures must conform with the Uniform Building Code and City Zoning standards for materials and aesthetics; 5. Complete conformance with the City of Rosemount Sign Ordinance; and 6.
