INTERIM USE PERMIT
TO WHOM IT MAY CONCERN:
NOTICE IS HEREBY GIVEN, the City Council of the City of Rosemount will hold a public
hearing on Tuesday, April 19, 1994 in the Council Chambers of the City Hall, 2875 145th
Street West, beginning at 8:00 p.m. or as soon thereafter as possible. The public hearing
listed below pertains to the property generally located north of State Trunk Highway 55,
just east of Spectro Alloys, and legally described as follows:
Part of the Southeast Quarter of the Northwest Quarter of Section 20,
Township 115, Range 18, Dakota County, Minnesota; and excepting
railroad rights-of-way.
The purpose of this hearing is to consider a.request from the owners af The Adventure
Zone for approval of an Interim Use Permit that would allow them to conduct a
Commercial Outdoor Recreational Use in the General Industrial District. The The
Adventure Zone Interim Use Permit requires execution of an Interim Use Permit
Agreement between the City and the operator which specifies the conditions of the permit.
The permit is subject to renewal on a yearly basis.
Persons wishing to speak on this issue are invited to attend and be heard at this meeting on
Tuesda�April 19. 1994 at 8:00 p.m. Formal written comments will also be accepted
prior to the meeting date. Please forward all comments and inquiries to the Planning

1994 Interim Use Permit Conditions
for
The Adventure Zone
A Commercial Outdoor Recreation Use located in the General Industrial District
This Interim Use Permit (IUP) is valid only for that part of the Northwest Quarter of
Section 20, Range 18 West, Townslup 115 North lymg north of the nght-of-way for
Staxe Trunk I3ighway 55 and east of Pine Bend Branch railroad right-of-way.
1. This permit allows the operation of an interim use with modifications to standards
specified by the City of Rosemount Zoning Regulations as approved by resolution
adopted by City Council on April 19, 1994.
2. This permit shall be reviewed prior to renewal in 1995 for conformance with
these conditions. Thereafter, the City Council will determine the appropriate
time interval for the subsequent renewal procedure.
3. Violation of any specified IUP condition or otherwise unlawful activity may
result in immediate revocation of the IUP.
4. Site improvements, as required, must be completed and accepted by the city
engineer within sixty (60) days of the date of City Council approvaL
5. The hours of operation shall be limited to 8:00 a.m. to sunset.
6. No parking is allowed in the Minnesota Department of Transportation (MnD01�
Staxe Trunk Highway (STT� 55 right-of-way.
7. All permits required by other applicable agencies must be obta,ined and copies
submitted to the City. This requirement includes MnDOT driveway/access
permit to STH 55. �
8. Conformance with setback and dimensional standards with variance to front yard
setbacks granted only for the purpose of preserving existing vegetaxion. I
9. Parking areas must consist of a minimum of six (6) inches of compacted, crushed ',
limestone or other such material accepta.ble to the city engineer. '
10. The entry drive must be thirty-two (32) feet wide, in conformance with MnDOT !
requirements and a culvert must be installed, if required by MnDOT, to facilitate '',
ditch runoff.
11. All structures must conform with the Uniform Building Code and City of ,
Rosemount Zoning Ordinance requirements for materials and aesthetics.
12. Conformance with Dakota County Health standards for portable sanitary
facilities. �
13. Conformance with the City of Rosemount Sign Ordinance.

General Industrial Districts
6a. The Adventure Zone - Interim Commercial Outdoor Recreational Use in the General
Industrial District located across from U.S.P.C.I. on the north east side of TH S5.
6b. Splatball Inc. - Interim Commercial Outdoor Recreational Use in the Agriculture
District located on the west side of Fahey Avenue, one half mile south of Pine Bend
Trail.
Both of the proposed interim uses are "paint ball" games conducted on land that provides a
natural setting with vegetative cover. Typically land in a pre-development stage. Last year, a
Zoning Text Amendment was adopted to create a process for interim comrnercial outdoor uses
in the Agriculture and General Industrial District. The process for review should start with
application of typical standards for site improvements such as setbacks and parking. Then,
given the transitory nature of the use the City Council may modify the standards that originate
from the City.
An IUP Agreement will be executed by the City, the operator and the property owner that will
specify the conditions of the permit. The permit will have a termination date with opportunity I�,
for renewal. The permit may also have a regular timed review to monitor compliance with the i,
IUP. ��
DISCUSSION �I
Planning Staff believes that the requirements for landscaping and paving may be waived for �I
both uses. However, parking areas should have an aggregate surface along with other �'�,
appropriate measures to inhibit erosion. Setbacks for buildings and parking should still be I,
applied. The Uniform Building Code (LTBC) has been adopted by the City and will be ��
enforced. Planning Staff would also suggest that building materials conform with aesthetic '',
standards especially when visible from public right-of-way (ROW) or adjacent property. In �',
both cases, the Sign Ordinance should be enforced as well. • '',
Splatball Inc. essentially operates out of a booth and trailer being pra.ctically a "portable" use. ��
There are portable outhouses and a parking area. The City Engineer has recommended that six '',
inches of 100% crushed class 5 limestone would be an accepta.ble alternative to paving given I
that Fahey Avenue is unpaved. There is a culvert that must be cleaned out and possibly
extended at Fahey Avenue to maintain the surface water runoff in the ditch. i

The Adventure Zone has more of a permanent appearance and a higher level of visibiliry. The
first comment is because there is a trailer on site sunilar to the types used on construction sites.
The txailer as such is not allowed by the Zoning Ordinance. The trailer and the steps up to the
trailer will have to be brought into conformance with the UBC as well as aesthetic
requirements. The site plan indicates that the parking area lines up with the ROW of TS55
even though the setback is 40 feet. If the Planning Commission and City Council is willing to
waive this setback, it only should be done to save trees.
Evidence of a MnDOT access or driveway permit must be provided as well.
CONCLLISION
A permit agreement will be executed for each of the IUP's. The duration of the permit should
be defined as well as a regular review process. Planning Staff recommends that the IUPs be
reviewed after the first year for compliance with the conditions of the permit. Violation of
conditions could trigger a revocation process at any time as well. After the first annual review,
the timing of subsequent regular reviews could be expanded to two or three year periods if no
serious issues develop over the first year.
RECOMMENDATION
MOTION to recommend that the Ciry Council approve the Interim Use Permits for both The
Adventure Zone and Splatball Inc. subject to:
1. Conformance with setback and dimensional standards with variance to front ya.rd setbacks
granted only for the purpose of preserving existing vegetation;
2. Parking lots and entry drives must be approved by the City Engineer;
3. All permits required by other applicable agencies must be obtained by the operators of
the NPs with relevant documenta.tion provided to the City;
4. All structures must conform with the Uniform Building Code and City Zoning standards
for rnaterials and aesthetics;
5. Complete conformance with the City of Rosemount Sign Ordinance; and
6. F�ecution of IUP agreements specifying the conditions of the permits.

NoTTCE IS HEx�BY G��t, the City Council of the City of Rosemount will hold a public ',
hearing on Tuesday, April 19, 1994 in the Council Chambers of the City Fiall, 2875 145th ',
Street West, beginning at 8:00 p.m. or as soon thereafter as possible. The public hearing �,
listed below perta.ins to the property generally located north of State Trunk Highway 55, !,
just east of Spectro Alloys, and legally described as follows: �
Part of the Southeast Quarter of the Northwest Quarter of Section 20, �
Township 115, Range 18, Dakota County, Minnesota; and excepting ',
railroad rights-of-way. ',
The purpose of this hearing is to consider a request from the owners of The Adventure '
Zone for approval of an Interim Use Permit that would allow them to conduct a '
Commercial Outdoor Recreational Use in the General Industrial District. The The
Adventure Zone Interim Use Permit requires execution of an Interim Use Permit
Agreement between the City and the operator which specifies the conditions of the permit.
The permit is subject to renewal on a yearly basis.
Persons wishing to speak on this issue are invited to attend and be heard at this meeting on
Tuesdav. April 19. 1994 at 8:00 p.m• Formal written comments will also be accepted
prior to the meeting date. Please forward all comments and inquiries to the Planning '
Department.
