The City has received an appeal to defer assessments on the parcel adjacent to the 1 st
Baptist Church which is owned by the Anna Wachter estate. This area is labeled orange
on the attached map with the letter. The assessments against that property for the
145th Street Project, City Project #206, amounted to 521,079.
As summarized in the Ietter from Ms. Janet Wilebski, Attorney from Bannigan & Kelly for
the 1 st Baptist Church, the Church would like to receive title to the property from the
Anna Wachter estate. However, they want to defer the assessment amount due to their
own assessments against the Church property in the amount of $52,000 which is for
both the 145th Strset Project and Diamond Path Project.
The City has many options #or this property. If the City does nat defer the assessments
and the Anna Wachter estate allows the property to ga tax forfeit, the assessment would
stay with that parcef and be paid when the property is sold. There are some questions as
to the appropriateness of other types of property uses for that parcel. tt is currently .
zoned agricultural because it was totally subject to a Dakota County highway easement.
Staff's understanding is that a new property owner would have the option of requesting a
zoning change wMich would match area land uses. The area to the north is zoned Public
and the area to the south is fndustrial Park.
The second option is to grant a deferment in which case the assessments woutd be
guaranteed to the City by the 1 st Baptist Church when they haue acquired the property.
The question remaining then is to carry the assessments with interest and in what form.
Staff recommends that the Council authorize Staff to negotiate a deferment with interest.
The first offer should be that the City be paid in a lump sum, principal plus accumulated
interest, due in the 10th year or sooner if the property is developed in any manner, ie.
buildings, parking lots, signage or plantings, etc.
RECOMMENDED ACT{ON: MOTION TO AUTHORIZE STAFF TO NEG�TIATE A DEFERMENT
WITH INTEREST AND TO BRING SUCH DEFERMENT BACK TO COUNCIL FOR APPROVAL

'. . . We were missing each other by return telephone calls this past week. WI�pn I called on
Tuesday, January 11, I spoke with Mr. Boyd Baiiey. A,fter explaining the purpose of my call, Mr.
Bailey suggested that I submit a letter to you outlining the request of my client, First Baptist
Church of Rosemount. _
As you are likely aware Dakota County, in conjunction with its realignment of County
Road 33, released part of an easement it holds over a portion of the southwest corner of the
South 1/2 of the NW 1/2 of Section 30, Township 115, Range 19. Part af the portion released
accrues to the property of First Baptist Church of Rosemount, The balance beiongs to Anna
Wachter (deceased).
The heirs of Anna Wachter do not want to take title to the released portion of the caunty
easement that belongs to Anna's estate. Rather, they wish to pass the title from An.na Wachter's
estate to the First Baptist Church af Rosemount and to have the Church accept the obligation
of existing assessments and all future storm water fees. The Wachter heirs are unwilling to
assume the expense of the assessments and have advised me that they would allow the properiy
to go tax forfeit if First Baptist does not take the title.
As I discussed with Mr. Bailey, First Baptist Church of Rosemount is willing ta take title
to the property a.nd also to take on the assessment which is $21,079. However, the Church also
has.additional assessments an the Church property in excess of$52,000. -Taking on an additional
$21,000 at this time would be extremely burdensome on First Baptist. � ° � � � �

On behalf. of First Baptist Church, I am hereby requesting that if the Church takes title
to the Vi'achter parcel, that the city grant First Baptist a defenal of payment of the assessments
due for a period of ten years or to such time as the Church applies for development of the
property whichever occurs first.
The most beneficial use of the property would be assembled with the abutting Church
property. As you can see from the map enclosed, the area highlighted in green is being released
to First Baptist Church (their fee interest went to the center line of the old County Raad 33);
and the Wachter estate is the fee owner of the areas highlighted in yellow and arange. The `
orange-highlighted area is the portion that the county is releasing and will accrue to the Wachter
estate. The yellow highlighted area remains subject to county easement.
It is my understanding that a future owner/developer would have to seek a rezone of that
area. In addition, the size of the orange-highlighted area is so small that a.n owner would have
extremely Iimited space for a.ny improvements after eomplying with necessary setbacks from the
Church's property and from the county's easement. Although it is a desirable locati4n, the size
of the parcei severely limits its usefulness unless assembled with adjacent land. The possibility
of development as an independent parcel is remote.
We believe that the best disposition of this praperty is to transfer the title to the Church,
with a deferred assessment obligation. The Church would be obligated for any future
assessments pertaining to that property and would be obligated to pay the storm water fees for
the Hawkin's Pond watershed.
