The City has received a petition from the Port Ruthority to construct the improvements in the
first phase of the Business Park. This is a formality that Bond counsel has advised us to
proceed with so that when land is sold in the Business Park the assessments can be transferred
over to the buyer if they desire that type of financing versus cash up front. This will give the
City a more secure position in the case of default by a buyer of the land.
RECOMMENDED ACTION:
Motion to adopt A RESOLUTION RECEIVING THE PETITION FOR THE ROSEMOUNT
BUSINESS PARK PHASE 1 IMPROVEMENTS CITY PROJECT #256.

PETITION FOR LOCAL IMPROVEMENTS

To the City Council of Rasemount, Minnesota:
We, the undersigned, being the oWners of all the real property
legally described as follows:
Rosemount Business Park, First Addition
hereby petition the city council to undertake vithout a public
hearing under Minnesota Statutes, Section 429. 031, the follorring
improvements to such property and agree to pay for all costs for
the preparation of the feasibility report for these improvements
in the event the impravements are not ordered in:
X Sanitary Sewer X Walkways
X Watermain X Streets
X Storm Sewer X Curb & Gutter
X Streetlights X Other Landscaping
and to pay the entire assessable costs thereof against our
property encompassing or abutting said improvements based on
benefits received without regard to cash valuation.

We also agree to guaranty payment for the preparation of plans
and specifications for the above petitioned improveme�r►ts in order
that the plans and specif ications may be prepared simultaneously
with the feasibility report.

A RESOLUTION RECEiVING THE PETITION FOR THE
ROSEMOUNT BUSINESS PARK PHASE 1 IMPROVEMENTS
CITY PROJECT #256
WHEREAS, the City Council of the City of Rosemount has received a petition from
the Rosemount Port Authority conce�ning the improvements for the first phase of
the Rosemount Business Park.
NOW, THEREFORE BE IT RESOLVED, by the City Council of the City of Rosemount
as follows:
(1) the aforesaid petition represents the owners of the affected property;
(2) the property owners request in the petition that the improvements be
constructed and that the entire cost for their share less the City's
share of the cost of improvement be assessed against the prope�ty;
13) the aforesaid petition is approved and placed on file.
ADOPTED this 10th day of June, 1994.
