Owners of the Adventure Zone and Splatball, Inc. have again quested to
operate their businesses in Rosemount. Attached is a map identifying the
locations of the businesses.
Adventure Zone has requested to operate on a year around basis. Currently
there are no provisions in the zoning ordinance permitting this use.
Because the use is intensifying, Director of Planning Lisa Freese has
indicated the zoning issue must be resolved. In order to do th.is, the
Zoning Ordinance must be amended to permit such ' facilities. The Adventure
Zone owner, Mr. Harvey, has indicated his intentions to apply for a text
amendment. In order to a11ow Adventure Zone to operate until this zoning
issue is resolved, it is my recommendation to issue a temporary permi�
until June 30, 1993 . This should allow time for the application to be ma.de
and the process completed.
The owners of Splatball, Inc. have also indicated their desire to operate
on a year round basis and therefore I am recommending the permit be handled
in the same manner as the Adventure Zone.
The temporary permit conditions are the same conditions imposed by `the City
in previous years.
At this time I have not received the required certificates of insurance or
$54 fee from either business and issuance of the permits will be eontingent
upon receipt of these items.

PERMIT
PERMIT issued this day of , 1993, by the CITY OF ROSEMOUNT
(the "City") to Brett C. Harvey d/b/a The Adventure Zone.
1. The City hereby issues a permit for The Adventure Zone in accordance with the definition
and rules set forth on the attached Exhibit "A".
2. This permit is issued subject to the following conditions:
a. The permit is valid only on Tax Parcel Number 34-0200-010-25.
b. A permit fee of fifty dollars ($50.00) shall be paid by the permit holder.
c. The permit holder shall take out and maintain in force general liability insurance for
at least five hundred thousand dollars ($500,000). The form of the policy and the
insurer sha11 be subject to approval by the City Administrator. The City shall be
named as an additional insured on the policy. The policy shall further provide that
the City sha.11 be given ten (10) days advance notice of cancellation. Proof of this
insurance (certificate of insurance) will be presented as part of the approval process
of the permit.
d. The hours and days of operation shall be limited to the following: Monday through
Sunday, 8:00 a.m. to dusk.
e. The permit for operating sha11 continue from March 22, 1993 through June 30, 1993.
f. No building or other structure may be erected on the site.
g. The permit holder shall police the area for litter after each game and shall insure that
a nuisance is not created as a result of noise, littering, traffic, or disorderly conduct.
h. Beer, wine and intoxicating liquor is prohibited.
3. This permit may be revoked for violation of its terms or violation of any ordinance or
statute.

and rules set forth on the attached E�chibit "A".
2. This permit is issued subject to the following conditions:
a. The permit is valid only on Tax Parcel Number 34-02100-011-50.
b. A permit fee of fifty dollars ($50.00) sha11 be paid by the permit holder.
c. The permit holder shall take out and maintain in force general liability insurance far
