A draft of two ice rental contracts for the Community Center has been ,
recommended by the Community Center Commission and reviewed by the City
Attorney. These contracts are designed from similar contracts used by the
Burnsville Ice Arena. Other arenas may or may not utilize ice contracts. '
Some use the term � Ice Contract ' and ' Ice Schedule' interchangeably. '
The contract entitled "ICE RENTAL CONTRACT° is designed for the three major
users of ice time, namely Rosemount High School, Rosemount Area Hockey ,
Association, and Eagan Hockey Association. Provisions have been ma:de in ,
this contract to accommodate a monthly billing. Proof of insurance is ,
required, naming the City of Rosemount as an insured in the amount of ,
$1, OOO, Q00 . The contract requires a response and signature from the user '
within 14 days. ,
The contract entitled "CONTRACT AGREEMENT FOR ICE RENTAL° is designed for ,
secondary users, those buying less than 200 hours of ice time per year.
This user is not required to name the City as an additional insured, but ',
does sign a waiver, assuming risks of accident or damage to property. The
secondary user is required to pay a $100 deposit with return of the signed
contract.
RECOb�IENDED ACTION: Motion to adopt the format of the ice rental '�
contract and contract agreement for ice rental as presented by the
Community Center Manager.

AGREEMENT made this day of , 19_, by and between ,
the City of Rosemount ("City") and ("User"). ,
1. The User hereby agrees to pay the City for rental of the Rosemount ,
Community Center And National Guard Arrnory and facilities ("Facilities") a
total of for hours. '
2. The schedule of dates and times are set forth on exhibit A which is attached '
and part of this Agreement. '
3. User hereby agrees that it and its members using the Facilities will abide by ,
the terms of this contract as well as regulations from time to time in effect
governing its use. '
4. User shall indemnify and hold harmless from any claims of whatsoever nature ,
arising from User's rental and use of the Facilities. User must purchase
liability insurance naming the City of Rosemount as an insured in the amount
of $1,000,000.00. User must obtain and furnish to the City'at the time this '
contract is entered into, a certificate of insurance as evidence of covering being '
in force. '
5. The City reserves the right (1) to cancel this agreement for any default by the !,
user in the terms of this agreement, and (2) to reschedule the dates or times of ',
permitted use of the Facilities on fourteen (14) days written notice to the
undersigned mailed to the address set forth below.

6. In the event of inechanical failure of the Facilities equipment, the User will be �
notified by the Facilities staff as soon as possible. The Facilities staff shall I
have the exclusive authority to determine whether the ice sheet is in usable ,
condition, and sha11 not be liable to User for the consequences of any ,
cancellation other than to supply User with substitute ice time.
7. The User hereby agrees to pay the full arnount of ice time charges within thirty
(30) days of billing for the total amount of hours used within the billing '
period. The billing period will extend from the first of each month through
the end of the month. '
8. The User remains liable for a11 hours of ice time contracted �or above. '

CONTRACT AGREEMENT FOR ICE RENTAL
AGREEMENT made this day of , 19 , by and between the '
CITY OF ROSEMOUNT (°City") and ("User").

1. The User hereby agrees to pay the City for rental of the Rosemount Community
Center And National Guard Armory and facilities ("Facilities"), for ,
hours of ice.
2. The schedule of dates and times are set forth on exhibit A which is attached and
part of this Agreement. ,
3. User hereby agrees that it and its members using the Facilities will abide by the ,
terms of this Agreement as well as regulations from time to time in effect ',
governing its use.
4. In consideration of being allowed to use the Facilities, the User for itself and for
each of its members hereby voluntarily assumes all risks o� accident or damage
to its property and to the person and property of said members and hereby ,
indemnifies, agrees to defend, and holds harmless the City, its officers and
employees from any and all claims, liability, or demands of any kind for or on ,
account of any personal injury or damage of any kind sustained by User's rental
and use of the Facilities. '
5. The City reserves the right to cancel this Agreement for any default by the User
in the terms of this Agreement. ,
6. In the event of inechanical failure of the equipment at the Facility, the User will ,
be notified by Facilities staff as soon as possible. The Facili�ies Staff shall have
the exclusive authority to determine whether the ice sheet is in useable condition, ,
and shall not be liable to User for the consequences of any cancellation other than ;
