This phase encompasses 16 .8 acres, situated east of Shannon Parkway at approximately 14].st Street West . The property was zoned R-1 Single Family Residential in 1989 , The plat appears to be consis�ent with the PUD Agreement and preliminary plat approved in 1989 and as amended in 1990 and 1992. The PUD requires that all lots meet the minimum lot width of 75 feet on interior lots and 90 feet an corner 1Qts . All of the lots in this addition me�t or exceed the current ardinance 1ot width dirnension in size standards. Other issues r�lated to this plat are discussed in more detail in the Planning Commission Review. Mr. Fitermann has petitioned the City to install public improvements for this phase. The petition was received and the feasibility study was ordered a� the February 16, 1993 Regular City Council. Meeting. A public hearing an the improvement pro�eet wili be held at this meeting. The Planning Commission rev�.ewed this final plat at the May 5, i993 Regular Meeting and recomrnended approval sub�ect to the faur �anditions listed in the resolution, A development contract has been prepared and ineludes the customary securiCy requirements. The erosion contral requirements have been upgraded to refle�t Best Management Practices mandated by the M�tropolitan Council . DEVELOPMFNT, INC., a 1Vli.nnesota corporation, (the "Developer°). 1. Request for Plat Approval. The Developer has asked the City to approve a plat of iand to be known as SHANNQN HILLS STH ADDTTION (alsa referred to in this contract as the "plat"). The land is legally described as follows; OUTLOT A, SHANNON HILLS 4TH ADDITION 2. P.U.D. Approval. The City has approved the Shannon Hills Planned Unit Developrnent in an agreement, dated August 29, 1989; Shannan Hills Planned Unit Development, I Addendum No. 1, dated Octaber 2, 1990; and Shannon Hills Planned LTnit Development � Addendum No. 2, dated Oetober 6, 1992. 3. Conditians of Plat Approval. The City h�reby appraves the plat on condition (1) Park ' Dedication fee of$21,320 cash contribution; (2) detailed plans and speeificatians and grading plan to be approved by the City Engineer; (3) installation of the siclewalk/trail on the east side af Cobbler Avenue; and (4} an executed Subclivisian Development Agreement, 4. Phased Develo�ment. The City rnay refuse to approve final plats c�f subsequent additions of the plat if the Developer has breached this Gontract and the breach has nc�t been remedied. Development of subsequent phases may not groce�d until Deveiopment Contracts for such phases are approved by the Gity. Terms in this Development Contract and Development Cantracts for subsequent phases shall be consistent with the Shannan Hills Planned Unit Develapment. 5. Effect of Subdivision A�proval. For two (2) years from the date of this Contract, no amendments to the City's Comprehensive PIan, except an amendment placing the plat in the cunent urban service area, or official controls shall apply ta or affeet the use, development density, lot size, lot layout ar dedications of the approved piat �anless required by state or federal law or agreed to in writing by tne City and the Developer. Thereafter, notwithstanding anything in this Contract to the contrary, to the full extent permitt�ci by state law the City may require cornpliance with any amendments to the City's Comprehensive Guide Plan, off'zcial eontrols, platting ar dedication requirements enacted after the date of this G�ntract. 6. Deveiopment Plans. The plat shall be developed in accordance with the following ptans, The plans shall not be attached to this Ccantract. With the exception of Plan A, the plans may be prepared, subject to City approval, after entering the Contract, but before commencement of any work in this p�at. I#"the plans vary from the written terms of this Contract, tt�e written terms shall contral. The plans are: Flan A -- Plat Plan B -- Soil Emsion Control Plan and Schedule Plan C -- Drainage and Storrnwater Runoff Plan Plan D -- Plans and Spec�cations for Public Improvements Plan E -- Grading Plan and House Pad Elevations Plan F -- Street Lights 7. Installation b�Dev_elo.�er. The Developer shall insta:ll or ca:use tca be installed and pay for the following: A. Street Lights B. Setting of Lot and Black Manuments C. Surveying and Staking of work required to be perfoarmed by the Deveioper. D. Gas, Electric, Telephone, and Cable Lines E. Site Grading F. Landscaping 8. Time of Performance, The Developer shall install all required impravements enum�rated in Paragragh '7 which will serve the Flat by September l, 1994: The I3eveloper may, however, request an e�tension of time to the City. �f an-extension is grantecl, it shall be conditivned upon updating the security pasted by the Developer to reflect eost increases and the extended completian date. 9. Public Improvements. The follc�wing improvements, known as City Project #234, shall be designed and installed in the plat by the City: A. 5anitary Sewer B. Water C. Storm 5ewer D. Streets B. Sidewalks Public improvements to be installed by the City shall be substantially campleted by September 30, 1993. Z 1Q. Assessment,o� Costs. The City shall assess the cost af the public impravements referred to in Paragraph 9 together with administrative, pianning, engineering, capitalized interest, legal and bonding costs against the plat. By executing this Agreement, the Developer agrees to pay the ass�sSments and other costs specified in this paragraph. The assessments shall be paid over a ten-year period without deferment, together with interest at a rate set by the City. Before the City issues a Certificate of Occupancy for a structure built on a lot, all of the aforementioned assessments against the lot must be paid in full. The Developer waives any and all procedural and substantive abjections ta the installation of the public imprc�vements and the special assessments, including, but not limited ta, hearing requirements and any claim that the assessments exceed the benefit to the progerty. The Developer waives any appeal rights otherwise available pursuant to M.S.A. §429.0$l. 1L Securitv. To guarantee compliance with the terms of tYus Agreement, payment af the costs of all public i:mprovements and construction of all public improvements, the Developer shall furnish the City with a cash escrc�w or irrevocable letter of credit firam a bank {"security") for �307,292. The letter of credit shall be for a term ending December 31, 2Q04. In the alternative, the letter of credit may be for a one{1) year term provided it is automatically renewable for successive one year periods from the gresent or any future expiratian dates with a final expiration date of December 31, 2403, unless sixty (60) days prior to az� expiration date the bank not�es the City that it elects not to renew for an additional periad. The letter of credit shall secure compliance with the terms of this Contract and all financial obligations of the Developer under it. The City may draw down on the letter flf czedit without natice upan receiving notice that the letter of credit will be allowed to lapse l�efore December 31, 2Q02. In the event of a default under tlu� Development Contract by the Developer, the City shall furnish the Developer with written notice by certified mail of Developers default(s) under the terms of this Development Contract. If the Develoger does not remove said default{s} within two (2} w�eks of receiving notiee, the City may draw on the letter c�f cretiit. With City appmval the letter of eredit may be reduced from tirne to time as fmancial obligations are gaid and public improvernents are completed to City's requirements. 12. Gradin� Plan/Site Gradin,g. The Developer shall submit to the City a site grad'mg and drainage plan for the entire plat acceptable to the City showing the grades and drainage for > each lot prior to installation of the improvements. Site grading shall be completeci by the Developer at its cost and approved by the City Public VJorks Director prior to the awarcling of the contract by the City for installation Qf utilities. Developer shall furnish the City ' Public Works Director satisfaetory proof af payment for the site grading work and shall submit a certificate of survey of the development to the City after site grading, with street and lot grades, prior to the awarding of the contrdct of installation of utilities. All improvements to the lots and the final grading shall comply with the grading plan as ' submitted and shall be the respon�ibility of the Deveioper. 13. License. The Develo er hereb rants the Cit , its agents, employees, officers and P Y � Y contractars a license ta enter the plat to perform all work and inspections deemed appropriate by the City during the installation of public improvements by the City. T'he license shall expire after the plat has been developed. 14. Erosion Control. Prior to site grading, and before any utility canstruction is eommenceci or building permits are iss�ed, the erosion contral plan, Pian B, shall be impiemented, inspected and appraved by the City. All areas disturbed by the excavation and backfilling operations shall be reseeded within 72 hours after the completi4n of the work in that area. E�ccept as otherwise provided in the erasion control plan, seed shall be rye grass or ather fast-growing seed suitable to the existing soil to provide a temporary ground cover as rapidly as possible. All seeded areas shall be mulcheci and dise anchored as necessary for seed retention. All basement and/or f4undatzon exc�.vation spoii piles shall be kept completely off City right-of-way and shall be campletely surrounded with an appraved erosion eontrol silt fence. The City also requi�es that appraved erosion control fencing be installed around the perimeter of each lot at the time of building permit issuance and remain in place until the lot is seeded or sodded. A 20 foot opening will be all4wed on each iot for construction deliveries. 4 The parties recognize that time is af the essence in controlling erosian. �f the plat develapment does not eomply witt� the erosion contrcrl plan and schedule or supplementary instructions received fram the City, the City may take such action as it deems apprapriate ta cantrol erosion. This right also applies to the required erosion control for basement and/or foundation excavation spoil piles. The City will endeavor to notify the Developer in advance af any proposed acti�n, but failure af the City to do so will not affect the Developer's or City's rights or obligations hereunder. If the Developer does nat reimburse the City for any cost the City incurred for such work within thirty (30) days, the City may draw down the letter of crec�it to pay any costs. No development will be allawed and no building permits will be issued untess the plat is in full complianee with the erosion contral requirements. 15. Planting and Seeding. Prior ta the City allowing occupancy, the Developer sh�ll plant one (1) twa-ineh caliper deciduous tree on each street frontage of eaeh lot and the Developer shall also sod the boulevards, all a�t its awn cost. 1S. Clean uu. The Deve2aper shall clean dirt and debris from streets that has resulted from construction work by the Develaper, its agents or assigns, The City will inspect the site an a weekly basis and determine whether it is necessary to take additianal me�sures ta clean dirt and debris from the streets. After 2� hours verbal natice to the developer, the City will complete or contract to complete the clean-up at the Aeveloper's expense as per the conditions under Paragraph 14. 17. Ownershi,.p of Lnprovements, Upon completion and City acceptance of the work and cvnstruction required by this Contract, the public improvements lying within public rights= of-way and easements shall be�ome City property without further notice or action. 18. Warrantv. The Develaper wamants all work required to be performed by it aga.inst poar material and faulty workmanship for a periad of twa (2} years after its completion and acceptance by the City, All trees, grass and sod shall be warranted ta be alive, af good quality and disease free for tweive (12) rnonths after planting. The Developer shall pc>st maintenanee bonds or other security acceptable to the Gity ta seeure the warrdnties. 19. Responsibilitv for Costs, A. Except,as o#herwise specified herein, the Developer shall �ay all cc�sts ineurred by it or the City in eonjunction with the dev�lopment of the plat including, but not limited to, Soil and Water Gonservation District charges, le�a1, planning, engineering and inspection expenses incurred in cann�ction with approval and acceptance of the plat, the preparatior► of this Contract, and all costs anci expenses incurred by the City in manitoring and i.nspecting development of the plat. B. The Developer shall hold the City a�d its officers and employees harmless from claims made by itself and third garties for damages sustained or �osts incurred resuiting frarn plat a.pproval and develc�gment. The Developer shall indemnify the City and its officers and �mployees for all costs, damages or expen�es which the City may pay or incur in consequence of such claims, including attorney's fees. 5 C. The Developer shall reimburse the City for costs incuned in the enforeement of this Contract, inciuding engineering and attorney's fees. D. The Developer shall pay, or cause to be paid when due, and in any event before any penalty is attached, all special assessments referred to in this Contract. This is a personal obligatian of the Developer, Gmund Iae�velopment, Inc., and shall continue in full force and effect even if the Developer sells ane ar more lots, the entire glat, or any part of it. E. The Developer shall pay in full all bills submitted to it by the City for obligativns '' incurred under this Cantraet within thirty (30) days after receipt. If th� bills are nat paid on time, the City may halt plat development work and construction including, but nat limited to, the issuance of building permits for lots which the Devetoper may ar may not have sold, until the bills are paid in full. Bills nc�t paid within thirty (30) days shall accrue interest at the rate of nine percent {9�) ger year. F. In addition to the charges and special assessments referred to herein, other charges and speciai assessments may be imposed such as, but not limited to, sewer availability charges (°S.A.C."), City water connection charges, City sewer connection charges, City stormwater connection charges and buiiding penmit fees. G. The Developer shall pay all energy costs for street lights installed within the plat until seventy-five percent (75�) of the lots are occupied. After that, the City will assume the energy costs, 20. Buildin�Petmits. No building permits shall be issued until: A. The site grading has been completed and approved by the City. B. All public utilities mu�t be tested, approved by the City Engineer, and in service. All curbing must be installed and backf'illed, the first lift of bituminous must be in place and approved by the City. However, this requirement may be waived by the Gity Director af Public Works in the euent Developer provides an alternative acc�ss to the building site. Alternative ac�esses instalied and maintained by Developer must provide all weather access ta the building site for puhlic safety, constructic�n, inspection, and construction delivery purposes. C. The City Public VJorks Directar has certified that the timetable for cflnstructipn of public impravements is compatible with private home canstzuction and occupancy. D. The Developer, in executing this Agreement, assumes all liabiliry arid costs for da.rnage or delays, incurred by the City, in the construction of public impmvements, caused by the Developer, its empioyees, contractvrs, subcdntr�ctors, materiatmen or agents. No occupancy permits shall be issned untii the public streets and utilities referred to in paragraph 7 and $ are in and apprt�ved l�y the City, unless atherwise authorized in writing by the City Public Works T)isector. 6 21. Developer's,De€autt. In the event of defauit by the Developer as to any of the work to be perf'ormed by it hereunder, the City may, at its option, perform the work and the Developer shall promptly reimburse the City for any expense incurred by the City, grovided the Developer is first given notice af the work in default, not less than 48 hours in advance. This Contract is a license for the City ta act, and it shall not be necessary for the City to seek a court order for permission to enter the land. When the City does any sueh work, the �ity rnay, in addition to its ather remedies, assess the cost in whole or in part. 22. Miscellaneous. A. The Developer represents to the City that the pl:at complies with all city, county, ' metropfllitan, state and federal laws and regulations including, but not limited to: subdivision ordinances, zoning ordinances and environmental: regulatians. If the City deterrnines that the plat does not comply, the City may, at its aptian, refuse to allow construction or develapm�nt work in the plat until the Develoger does camply. Upon the City's demand, the Develaper shall cea.se work until there is compliance. B. Third parties shall have no recourse against the City under this Contract, C. Breach of the terms of this Contract by the Developer shall be gmunds for denial Qf building permits, including lots sold to third parties. D, If any portion, section, subsection, sentence, clause, para.graph t�r phrase of this Contract is for any reason held invalid, such decision shall not affect the validity of the remaining portion of this Contract. E. If building permits are issued prior to the completion and acceptance of public improvements, the Deve�oper assumes ali liability and casts resulting in delays in carnpletivn af public improuernents and damage to gublic arnprovements caused by the City, Develaper, its contractors, sube.ontractors, materiaLmen, employees, agents or tlurd parties. No occupancy permit shall be issued until public improvements in paragraph 8 are in and appraved by the City. F. The action or inaction af the City shall not constitute a waiver or amendment to the provisions of this Contract. To be binding, amendments or waivers shall be in writing, signed by the p�rrties and app�oved by written resolution of the City Cc�uncii. ' The City's failure to promptly take iegal action to enforce this Contract shall not be a waiver or release. G. The Developer represents ta the City to the best of its kr�owledge that the plat is nat of "metropolitan significance" and that an environmental impact statement is not required. If the City or another governmental agency determines that such a review is neetied, however, the Developer shalI prepare it in compliance with legal requirements so issued from the agency. The Developer shall reimburse the City for all expenses, including staff time and attomey's fees, that the City incurs in assisting in the preparation of the review. 7 H. This Contraet shall nan with the land and may be recorded against the title to the pro�rty. After the Developer has cvmpleteci the work required af it under this Contract, at the Develaper's request, the City will exeeute and deliver to tYte Developer a release. I. The existing oak trees have been located and identified as shown on the grading plan. TYie location of these trees are excTusively on Lots 4 & 5, Block 1 of the future Shannon Hills bth Aedditian. In orc�er to protect these existing trees, we have revised the praposed lot lines/building pads af Lots 2, 3, 4, & 5, Block 1. The proposed dimension at the thirty foot (30") setback is a minim�n of seventy-fiue feet (75') fQr Lots 2, 3, & 4, Black l. Therefare, this would result in Lot 5, Bl�k 1, having a width of approxircr�tel.y cme hundred and fourteen feet {114') across the front and will lae 3.eft as a custvm graded lot. Th� paclding siZe and proposed outiet far Pond BIR 149 was previously designed by Brian Bourassa with p,S.M, to be a cambination of additionai excava�:ion and a sto�m sewer structure with pumping capacity. Since 'oar meeting, i have had verbal camnunication with yew requesting that the ponding area -a� Pond BIR 149 should have a volume of storage equal to 13.0 Acre-Feet.
