Mr. Brett Harvey and Wayne Passon, owners of Adventure Zone, are requesting approval of an Interim Use Permit (IUP) for Commercial Outdoor Recreation in the Agriculture District. The IUP will be operated on the west side of Fahey Avenue, one-half mile north of State Trunk Highway 55 . On March 22, 1994, the Planning Commission recommended approval of the IUP and setting a public hearing by City Council to consider this request . The owners of Adventure Zone would like to commence activities prior to the public hearing for the IUP. Administrative Assistant Susan Walsh and I have discussed this and felt a recommendation to issue a temporary permit similar to past years' permits would be in order. It is our recommendation that the permit have a $25 . 00 fee; require $560, 000. 00 liability insurance and be effective for six weeks or issuance of the IUP, whichever occurs first . Attached is the permit for your review and approval . This owner has been cooperative in working with staff to meet the IUP requirements, but unfortunately the public hearing for consideration of the IUP will not be held until two and one-half weeks into their season. Based upon good business practices in the past and their cooperation, we recommend a six-week permit be issued. Recommended Action: MOTION to set a Public Hearing for April 19, 1994 at 8 : 00 p.m. , or as soon thereafter as possible, to consider an Interim Use Permit and to approve issuance of a six week permit subject to the owner meeting the conditions of the permit. Harvey d/b/a The Adventure Zone. 1. The City hereby issues a permit for The Adventure Zone. 2. This permit is issued subject to the following conditions: a. The permit is valid only on Tax parcel Number 34-02000-010-25. b. A permit fee of twenty-five ($25.00) dollars shall be paid by the permit holder. c. The permit holder shall take out and maintain in force general liability insurance for �' at least five hundred thousand dollars ($500,000). The form of the policy and the insurer shall be subject to approval by the City Admuustrator. The City shall be '' named as an additional insured on the policy. The policy shall further provide that '� the City shall be given ten (10) da.ys advance notice of cancellation. Proof of this insurance (certificate of insurance) will be presented as part of the approval process of ' the permit. d. The hours and days of operation shall be limited to the following: Monday through Sunday, 8:00 a.m. to dusk. e. The permit for operating shall continue from April 6, 1994 through May 18, 1994. f. The permit holder shall police the area for litter after each game and shall insure that a nuisance is not created as a result of noise, littering, traffic, or disorderly conduct. g. Beer, wine and intoxicating liquor is prohibited. 3. This permit may be revoked for violation of its terms or violation of any ordinance or statute.
