Permit.
Mr. James Lathrup of Splatball, Inc. is requesting approval of an
Interim Use Permit (IUP) for Commercial 0utdoor Recreation in the
Agriculture District. The IUP will be operated on the west side of
Fahey Avenue, one-half mile north of State Trunk Highway 55 .
On March 22 , 1994, the Planning Commission recommended approval of
the IUP and setting a public hearing by City Council to consider
this request.
The owners of Splatball Inc. would like to commence activities
prior to the public hearing for the IUP. Administrative Assistant
Susan Walsh and I have discussed this and felt a recommendation to
issue a temporary permit similar to past years' permits would be in
order. It is our recommendation that the permit have a $25 . 00 fee;
require $500, 000 . 00 liability insurance and be effective for six
weeks or issuance of the IUP, whichever occurs first.
Attached is the permit for your review and approval . This owner
has been cooperative in working with staff to meet the IUP
requirements, but unfortunately the public hearing for
consideration of the IUP will not be held until two and one-half
weeks into their season.
Based upon good business practices in the past and their
cooperation, we recommend a six-week permit be issued.
Recommended Action: MOTION to set a Public Hearing for April
19, 1994 at 8 : 00 p.m. , or as soon thereafter as possible, to
consider an Interim Use Permit and to approve issuance of a six
week permit subject to the owner meeting the conditions of the
permit.

INTERIM USE PERMIT
TO WHOM IT MAY CONCERN:
NOTICE IS HEREBY GIVEN, the City Council of the City of Rosemount will hold a public
hearing on Tuesday, April 19, 1994 in the Council Chambers of the City Hall, 2875 145th
Street West, beginning at 8:00 p.m. or as soon thereafter as possible. The public hearing
listed below pertains to the property generally located west of Fahey Avenue, one-half mile
north of Trunk Highway 55 and legally described as follows:

The purpose of tYus hearing is to consider a request from the owners of Splatball, Inc. for
approval of an Interim Use Permit that would allow them to conduct a Commercial Outdoor
Recreational Use in the Agriculture District. The Splatball, Inc. Interim Use Permit
requires execution of an Interim Use Permit Agreement between the City and the operator
which specifies the conditions of the permit. The permit is subject to renewal on a yearly
basis.
Persons wishing to speak on this issue are invited to attend and be heard at this meeti.ng on
Tuesday. April 19, 1994 at 8:00 p.m. Formal written comments will also be accepted
prior to the meeting date. Please forward all comments and inquiries to the Planning
Department.

PERMIT
C�RMIT issued this day of , 1994, by the CITY OF ROSEMOtTNT the
" ty") to Splatball, Inc. (
1• The City hereby issues a permit for Splatball, Inc.
2• This permit is issued subject to the following conditions:
a• The permit is valid only on Tax parcel Number 34-02100-011-50.
b• A permit fee of twenty-five ($25.00) dollars shall be paid by the perrnit holder.
�• The permit holder shall take out and maintain in force general liability insurance for
at least five hundred thousand dollars ($500,000). The form of the policy and the
insurer shall be subject to approval by the City Administrator. The City shall be
named as an additional insured on the policy. The policy shall further provide that
the City shall be given ten (10) days advance notice of cancellation. Proof of this
insurance (certificate of insurance) will be presented as part of the approval process of
the permit.

Sunday, 8:00 a.m, to dusk. y g
e• The permit for operating shall continue from April 6, 1994 through May 18, 1994.
f• The permit holder shall police the area for litter after each game and shall insure th
a nuisance is not created as a result of noise, littering, traffic, or disorderly conduct t
g. Beer, wine and intoxicating liquor is prohibited.
3• This permit may be revoked for violation of its terms or viola.tion of any ordinance or
statute.
