I am a United States citizen and the duly qualified Clerk of the City of Rosemount,
Minnesota.
On March 24, 1994, acting on behalf of the said City, I posted at the City Hall, 2875 145th
Street West, Rosemount, Minnesota, and deposited in the United States Post Office,
Rosemount, Minnesota, a copy of the attached notice of a Public H�aring for consideration
of the O'Leary's Hills Seventh Addition Rezoning Petition for property located within the
City of Rosemount as described in the Public Notice, enclosed in sealed envelopes, with
postage thereon fully prepaid, addressed to the persons listed on the attached listings at the
addresses listed with their names.

TO WHOM IT MAY CONCERN:
NOTICE IS HEREBY GIVEN, the City Council of the City of Rosemount will hold a public
hearing on 'hiesday, April 5, 1994 in the Council Chambers of the City �iall, 2875 145th Street
West, beginning at 8:00 p.m. or as soon thereafter as possible:
The purpose of this hearing is to receive public input and comments on the O'Leary's Hills
Seventh Addition Rezoning Petition. The public hearing pertains to a single family residential
development that will extend the existing 153rd Street easterly to Chokecherry Avenue on
property legally described as follows:
That part of the South Half of the Northeast Quarter (S'/z of NE'/a) of Section 31, Township
115, Range 19, Dakota County, Minnesota lying southerly and easterly of O'LEARY's Ha.�.s
FIFTH ADDITION, according to the recorded plat thereof; easterly of O'LEARY's Ha,L.s
Fo[.r1tTx ADDrr1oN, according to the recorded plat thereof, and north of the following
described line: Commencing at the southeast corner of said O'LEARY's Hu.Ls F�'rx �
ADDrr�oN; thence South 00 degrees 44 minutes 26 seconds West, assumed bearing, along the
east line of said South Half of the Northeast Quarter{S'h of NE'/a) 355.02 feet to the point
of beginning of the line to be described; thence North 89 degrees 46 minutes 31 seconds
West 1436.84 feet to the east line of said O'LEARY'S HILLS FOURTH ADDiTION and said Iine

The purpose of this hearing is to consider the rezoning of the above described property from
AG Agriculture to R-1 Single Family Residential to allow for the development of the fmal
addition of the O'Leary's Hills Planned Unit Development (PUD). The subject property is
designated Urban Residential (UR) in the City of Rosemount Comprehensive Guide Plan:
Updcrte 2000. The developer is proposing to develop a housing development consisting of 32
single family homes.
Persons wishing to comment on the O'Leary's Hills Seventh Addition rezoning request are
invited to attend this meeting on 1'uesdav, April 5. 1994 at 8•04 p m.

Mr. Tim Broback is requesting a rezoning of land that will be
developed into 32 single family lots as 0' Leary' s Hills 7th
Addition. The property is currently in the Agriculture District
and must be rezoned to R-1 Single Family Residential (Detached) . '
The Comprehensive Guide Plan Land Use Designation is Urban
Residential which is consistent with the rezoning request. The
plat is in the Empire Waste Water Treatment Plant Service Area.
On March 8, 1994, the Planning Commission recommended approval of
the rezoning.

O'LEARY'S HII�LS EIGHTH ADDI'TION: FINAL PLAT AND REZONING
Mr. Tun Broback, President of Parkview, Inc. Developers of O'Leary's I3ills Residential
Planned Unit Development is requestin� final plat approval and rezoning for the last two
additions that would complete the PUD. The Residential PUD was originally approveti in
August, 1987 and variously amended since. The design of the last two additions is consistenr
� with the PUD in terms of street and lot design. The lots are typically in conformance with
cuirent standards for lot width, depth and area after revisions were made responding to lot
with standards increasing from 75 ft. to 80 ft. Most of the lots aze five to nine feet lon�er '
than the standard. ,
This last phase is an "infill" project.that fills the vacant land between the First Addition and �'�
the Fifth Addition. Because of this, there is no flexibility to change lot dimensions because I
of the already defined street connections. The Developer was forced to "give up° lots on
each block to conform with the larger lot width standard wherever possible.
Utility locations and associated easements add additional constraints to plat modifications.
The easement separating lots 8 and 9, block 3 in the Seventh Addition will have to be
modified somewhat ta accommodate connections with the new Carrousel Plaza South plat
east of Chippendale. The two lots aze still buildable and the Developer has no objection to
the easement modificadons.
Sidewalks will be required on the south side of 153rd Street West and the east side of
Chokecherry-Avenue. A cash contribution of$36,400 will satisfy the park dedication
requirement:

O'LEARY'S HILLS SEVENTH ADDTTION
REZONING PETITION
TO WHOM IT MAY CONCERN:
NOTICE IS HEREBY GIVEN, the City Council of the City of Rosemount will hold a public
hearing on 'Ihesday, April 5, 1994 in the Council Chambers of the City Hall, 2875 145th Street -
West, beginning at 8:00 p.m. or as soon thereafter as possible:
The purpose of this hearing is to receive public input and comments on the O'Leary's Hills
Seventh Addition Rezoning Petition. The public hearing pertains to a single family residential
development that will extend the existing 153rd Street easterly to Chokecherry Avenue on
property legally described as follows:
That part of the South Half of the Northeast Quarter (S lh of NE'/a) of Section 31, Township
115, Range 19, Dakota County, Minnesota lying southerly and easterly of O'LEARY's Hr[,L.s
FIFTH ADDTTION, according to the recorded plat thereof; ea.sterly of O'LEARY's Hrt..L.s
FOURTH ADDITION, according to the recorded plat thereof, and north of the following
described line: Commencing at the southeast comer of said O'LEARY'S HII.LS FIFTH
ADDTTION; thence South 00 degrees 44 minutes 26 seconds West, assumed bea.ring, along the
east line of said South Half of the Northeast Quarter (S�/z of NE'/a) 355.02 feet to the point
of beginning of the line to be described; thence North 89 degrees 46 minutes 31 seconds
West 1436.84 fe�t to the east line of said O'LEARY'S HILLS FOURTH ADDITION and said line
there terminating.
The purpose of this hearing is to consider the rezoning of the above described property from
AG Agriculture to R-1 Single Family Residential to allow for the development of the fmal
addition of the O'Leary's Hills Planned Unit Development (PUD). The subject property is
designated Urban Residential (UR) in the City of Rosemount Comprehensive Guide Plan:
Update 2000. The developer is proposing to develop a housing development consisting of 32
single family homes.
Persons wishing to comment on the O'Leary's Hills Seventh Addition rezoning request are
invited to attend this meeting on 1�esday. April 5. 1994 at 8:00 .�m.

CITY OF ROSEMOUNT ZONING ORDINANCE
O'Leary's Hills Seventh Additiort
THE CITY COUNCIL OF THE CITY OF ROSEMOUNT, MINNESOTA ORDAINS AS FOLLOWS:
Section 1. Ordinance No. B, adopted September 19, 1989, entitled "City of Rosemount Zoning
Ordinance," is hereby amended to rezone from AG Agriculture to R-1 Single Family Residential the
following described property located within the City of Rosemount, Minnesota to-wit:
That part of the South Half of the Northeast Quarter (S'h of NE'/4) of Section 31, Township 115,
Range 19, Dakota County, Minnesota lying southerly and easterly o� O'LEARY'S HILLS FIFTH
/�DDITION, according to the recorded plat thereof; easterly of O'LEARY'S I-�ILLS FOURTH ADDITION,
according to the recorded plat thereof, and north of the following described line: Commencing at the
southeast corner of said O'LEARY'S HILLS FIFTH ADDITION; thence South 00 degrees 44 minutes 26
seconds West, assumed bearing, along the east line of said South Half of the Northeast Quarter (S'h
of NE'/) 355.02 feet to the point of beginning of the line to be described; thence North 89 degrees
46 minutes 31 seconds West 1436.84 feet to the east line of said O'LEARY'S HILLS FOURTH ADDTTION
and said line there terminating.
Section 2. The Zoning Map of the City of Rosemount, referred to and described in said
Ordinance No. B as that certain map entitled "ZONING MAP OF THE CITY OF ROSEMOUNT", shall
not be republished to show the aforesaid rezoning, but the Clerk shall appropriately mark the said
zoning map on file in the Clerk's office for the purpose of indicating the rezoning hereinabove
provided for in this Ordinance and all of the notation references and other information shown
thereon are hereby incorporated by reference and made a part of this Ordinance.
Section 3. This ordinance shall be effective immediately•upon its passage and publication
according to law.
