MnDot and the County Highway Department were contacted and information was provided to us by those agencies. We utilized their information and merged it with the existing Park and Recreation Park Program to arrive at the attached documents. The procedure for the program is to be as follows: The requesting party must complete the permit application form and pay for the sign (optional) prior to actually picking up litter. The Pubfic Works Department provides safety vests and trash bags to the requesting party and picks up the bags at the arranged time. The program will begin on June 1 , 1994. Boyd Bailey, Maryann Stoffel, and the Park and Recreation Department are to be commended for their efforts in putting this program together. Also, Cindy Jensen from Dakota County Highway Department provided greatly appreciated assistance. The group agrees to pick up litter on a segment of City Street setected in consultation with the Rosemount Public Works Department. Recommended length is two miles. At Rosemount's discretion, certain streets may not be eligible if the safety of the volunteers would be jeopardized. 2. The group shall review the safety training materials before each pickup and shall alert each participant to the hazards and precautions of working on a street right-of-way. 3. The group shall pick up litter during daylight hours only. Special restrictions may apply to certain roadways subject to heavy traffic conditions. 4. The group shall provide adequate supervision to participants eighteen years of age or younger. 5. Work shall be limited to the area between the curb or outer shoulders and the right-of-way boundary. Work may not be done on the roadway itself. 6. The group shall arrange litter pickup date(s) with the Rosemount Public Works Department. The group shall obtain City-provided supplies during regular business hours. (7;30 A.M. to 4 P.M.) 7. The group shall place filled trash bags on the shoulder slope close to the ditch bottom or not closer than 10' from the roadway curb. Groups are encouraged to recycle appropriate materials. 8. Vests and any unused supplies provided by the City shall be returned to the Rosemount Public Works Department within two working days. The Rosemount Public Works Department agrees to: 1. Provide high visibility vests, trash bags, and safety training materials. 2. Arrange to remove filled trash bags from the adopted street. 3. Arrange to remove large, heavy or hazartlous material from the adopted street. 4. If requested and paid for by the applicant, fabricate and erect a sign on the street in colors a�d design approved by the Department with up to two lines (18 characters maximum per line) reserved for the name of the volunteer group. s. ROSEMOUNT PUBLIC WORKS DEPARTMENT ADOPT-A-STREET PERMIT Adopt-a-street without signs (no charge): The group agrees to pick up litter at least three times a year for a minimum of two years. Adopt-a-street with signs tS150 charge per sign): The group agrees to pick up litter at least three time a year for a minimum of two years. Name to appear on sign Pick-a-street: The group agrees to pick up litter one time only. We request permission to pick up litter on between and for a total of miles. (Recommended length is 2 miles - ending at intersections) The City of Rosemount reserves the right to refuse, cancel, or revise this ,agreement if in its sole judgement the nature of the group ofi its sign is political, controversial, or in questionable taste, or if the group is not meeting the terms and conditions of this agreement. By signing this agreement, the group acknowledges the hazardous nature of the work and agrees to comply with the terms and conditions herewith to the satisfaction of the City of Rosernount, Public Works Department. Except for the negligent acts of the City of Rosemount, its agents, and employees, the volunteers or their agents shall assume all liability for, and save the City of Rosemount, its agents and employees, harmless from any and all claims for damages, actions, or causes of action arising out of work to be done herein. Any and all volunteers of the group, or other persons while engages in the performance if any work or service performed under this agreement, shall not be considered employees of the City of Rosemount, and any and all claims that may or might arise under the Worker's Compensation Act of Minnesota on behalf of said employees or other persons while so engaged, and any and all claims made by any third party of the group's volunteers or other persons while so engaged on any of the work or services to be rendered, shall in no way be the obligation or responsibility of the City of Rosemount. It is the responsibility of the group representative to distribute copies of this agreement to all members of the group.
