The new lot combines 75 feet of Mr. Mullikin' s property and 21 feet of vacated Shannon Parkway right-of-way. The subdivision resulting from a combination should be a plat according to the Subdivision Qrdinance. In order to accommodate Mr. Mullikin' s request, a variance to the Subdivision Ordinance was processed. On April 5, 1994, the Planning Commission acting as the Board of Appeals and adjustments granted Mr. Mullikin a Variance allowing him to proceed with a subdivision without platting. The resulting corner lot as well as the remnant property meet or exceed the lot area, lot width, and lot depth standards required by the Zoning Ordinance. In addition, no setback encroachments are created by the subdivision. RECOb�IENDED ACTION: MOTION to adopt A RESOLUTION APPROVING THE SUBDIVISION FOR MR. LEROY NNLLIKIN AT 4060 145TH STREET WEST. COIINCIL ACTION: CITY OF ROSEMOUNT DAROTA COUNTY, MINNESOTA RESOLIITION 1994 - A RESOLUTION APPROVING THE MIILLIKIN SIIBDIVISION/COMBINATION WSLREAS, the City of Rosemount has received a request from Leroy Mullikin, property owner, to subdivide the following described property; Lot 1, Block 1, Evergreen acres combined with: Commencing at the northwest corner of said plat of SHANNON PAR.K iST ADDITION; thence South 0 degrees 31 minutes 38 seconds West (bearing assumed) along the west line of said plat of SHANNON PAR.K 1ST ADDITION, said west line also being the west line of Shannon Parkway, a distance of 50 . 00 feet to the point of intersection with the easterly production of the north line of Lot l, Block l, EVERGREEN ACRES, according to the recorded plat thereof on file in the office of the County Recorder, Dakota County, Minnesota, said point of intersection being the point of beginning of the parcel to be described; thence North 89 degrees 48 minutes 59 seconds East a distance of 21.95 feet along said north line produced easterly to the point of intersection with the northerly production of the east line of BROBACK SECOND ADDITION as said east line. is shown on the recorded plat of SHANNON PARK iST ADDITION; thence South 1 degree 02 minutes 34 seconds East a distance of 140 . 06 feet, along the northerly production of said east line, to the point of intersection with the easterly production of the south line of said Lot 1, Block 1, EVERGREEN ACRES; thence South 89 degrees 49 minutes 03 seconds West a distance of 20 . 69 feet, along the easterly production of said south line, to the point of intersection with said west line of Shannon Parkway; thence North 00 degrees 31 minutes 38 second East along said west line of Shannon Parkway to the point of beginning. WHEREAS, the Board of Appeals and Adjustments granted a variance to the City of Rosemount Subdivision Ordinance allowing the Subdivision/Combination to occur without platting. D�HEREAS, the Planning Commission reviewed this request at their April 5, 1994 Regular Meeting and has recommended approval of the Mullikix�. Subdivision/Combination. WSEREAS, the Mullikin Subdivision meets minimum ordinance standards and subdivision requirements for two single family detached residential lots; RESOLUTION 1994 - NOW, TSTREFORE, BE IT RESOLVED, the City Council of the City of Rosemount hereby approves the Mullikin Subdivision subject to: 1) One driveway access to the newly created lot will be allowed and that it shall be as far from the intersection as practical; and 2) Payment of Park Dedication for one residential unit in the amount of $560 . ATTACI3MENTS: Survey, Variance petition 6a. and 7. PUBLIC HEARING - I.eroy Mullikin, 4060 145th Street West - Variance to Subdivision Ordinance No XVII.4 SUBD. 7.2 a. Simple Lot Divisions. PETTTTON Mr. Mullikin has petitioned for a variance to the Subdivision Ordinance so that he can get approval of a simple lot division that will create a new lot for single family use. The Subdivision Ordinance allows for divisions of a platted lot of record that results in simple � legal descriptions and meet all zoning requirements. Mr. Mullikin's proposal depends upon vacated right-of-way that must be combined with his lot in order to meet standards. DISCUSSIQN The vacated ROW is approximately 21 feet wide and 140 feet long. It was quit claimed by the Shannon Park First Addition Association having been isolated by Shannon Parkway. The best way to accomplish the combination and division is through platting. A strict interpretation of the Subdivision Ordinance would conclude that platting is the only legal method of accomplishing the combination/ division. Mr. Mullikin believes that platting is economically onerous and unnecessary. Planning Staff believes that any risk resulting from avoiding platting would be Mr. Mullikin's. The incentive to the City of having the vacated parcel combined with Mr. Mullikin's property is to eliminate a parcel that is unbuildable by itself and is located on the corner of two collector streets. SUBDIVISION ISSUES The combined parcel can be subdivided to create a new corner lot that meets all standards in terms of size, width and setbacks. There is even enough area so that the division could occur independent of the vacated ROW. The advantage of utilization of the vacated parcel is that the lot line can be 31 feet from the existing house instead of ten feet. By itself, the vacated ROW would be unbuildable. The vacated ROW parcel is entirely within typical corner setbacks. The sale of the new lot will relieve Mr. Mullikin of some assessments that are pending for 145th Street improvements. Board of Appeals and Adjustments - Mullikin Subdivision Variance April 12, 1994 Page 2. FINDINGS The Board of Appeals and Adjustments and the City Council, upon appeal, must fmd as follows in the granting of a variance from this ordinance: 1. Granting a variance will not adversely affect the public health, welfare and safery and will not be detrimental or injurious to property or improvements in the neighborhood. 2. Strict interpretation or enforcement would result in a practical difficulty or unnecessary hardship inconsistent with the intent of this ordinance and the Comprehensive Guide Plan. 3. There are exceptional or extraordinary circumstances or conditions applicable to the pmperty, use or facilities that do not apply generally to other properties in the same district. 4. Strict or literal interpretation would deprive the applicant of the use and enjoyment of his property in a manner similar to others in the same district. 5. Granting of the variance will not allow a use which is otherwise not a permitted use in the zoning district in question. CONCLUSION � Planning Staff believes that the realignment of Shannon Parkway is the cause of the vacated parcel and that it should be combined with the property owned by Mr. Mullikin. There is obvious benefit to Mr. Mullikin as a result, but there is no practical alternative. Mr. Mullikin did not cause the parcel to be vacated and therefore feels that he should`not incur the expense of platting. Sta.ff believes that findings can be made to grant the variance to the Subdivision Ordinance allowing Mr. Mullikin to proceed with the combination / split as long as he assumes any risk that may result from not replating the parcels. RECOMMENDATTON MOTION to grant a variance to the Subdivision Ordinance Section 7.2 Exceptions to platting requirements to allow Mr. Mullikin to combine the vacated ROW with Lot 1, block 1 Evergreen Acres without replating the property; and, MOTION to recommend a recommendation of approval of the Mullikin subdivision to the City Council subject to; 1. Only one driveway access to the newly created lot will be allowed and that it shall be as far from the intersection as practical. 2. MULLIKIN REQUEST FOR LOT COMB[NATION/DIVISION 4060145th Street West TO WHOM IT MAY CONCERN: NO'r�CE IS I3EREBY G�vE�t, the Planning Commission, acting as the Board of Appeals and Adjustments, of the City of Rosemount will hold a Public Hearing to consider the item listed below on Tuesday, April 12, 1994, in the Council Chambers of the City Hall, 2875 145th Street West, beginning at 6:00 p.m. or as soon thereafter as possible. The public hearing pertains to property bordered on the east by Shannon Parkway along the south side of 145th Street West. The petitioner is proposing a lot realignment causing the combination of Lot 1, Block l, Evergreen Acres and vacated excess right-of-way of a portion of Shannon Parkway; and further, the division of the resulting combined lot into two � � residential lots that meet minimum standards. The purpose of this hearing is to consider a variance to Subdivision Ordinance XVII.4, Section l, Subd. 1.4 which requires formal platting of all parcels less than five acres in area or 300 feet in width. If granted, the variance will permit the City ta proceed with a simple lot divisionlcombination.
