The McDonoughs have accepted the offer far settlement. Richard Ostlund of Lindquist & '
Vennum has prepared a settlement agreement document for Council considera.tion.
Recommendation: to adopt resolution authorizing the City Administrator to enter into a final
settlement agreement on behalf of the City.

A RESOLIITION AUTHORIZING THE CITY ADMINISTRATOR
TO ENTER INTO A FINAL SETTLE�ENT AGRE�lEEN'T
ON BEHALF OF THE CITY
REGARDING THE bSCDON0UG8 LITIGATION
DJHEREAS, McDonough, Rosemount and McMenomy are all parties to
legal proceedings entitled Michael McDonough, plaintiff v. The
City of Rosemount, a Municipal Corporation, E.B. McMenomy, onlv
in his individual capacity, and Stephan Jilk, in his individual
capacity, defendants, Dakota County District Court File No. C7-
92-6327 (the McDonough Litigation) ; and
WHEREAS, the City of Rosemount hired Lindquist and Vennum,
Attorneys At Law to negotiate for the McDonough Litigation; and
WHEREAS, Attorney Richarcl T. Ostlund from Lindquist and Vennum
has proposed a settlement agreement which has been accepted by
Michael McDonough; and
�PIiEREA5, the City Administrator is authorized manager of the
. City of Rosemount.
N0�1, THEREFORE, BE IT RESOLVED by the City Council of the City
of Rosemount that it authorizes the City Administrator to enter
into a final settlement agreement on behalf of the City for the
McDonough Litigation.
ADOPTED this 19th day of July, 1994 .
