Mr. Charles Stauffer wishes to acquire ten feet of land from his
neighbor' s lot which is adjacent to the east. According to the
Subdivision Ordinance the process for allowing this request is
through a common lot boundary relocation. No additional lots or
parcels will be created and, therefore, the procedure is exempt
from the platting requirements .
On August 9, 1994 the Planning Commission reviewed the request and
recommended approval .
Mr. Stauffer' s property (3190 Lower 147th Street West) is currently
63 . 56 feet wide and is part of Auditor' s Subdivision No . 27 which
was recorded in 1928 . The adjacent property (3170 Lower 147th
Street West) is 110 feet wide. Mr. Stauffer' s acquisition of the
additional ten feet of lot width will provide improved access into
his rear yard around his detached garage. He currently has
permission to cross the Rosemount United Methodist Church parsonage
property immediately to the south, but that may change in the
future if it is sold.
Both lots are 150 feet deep and the relocation of the lot line will
not create any non-conforming issues. The remnant lot to the east
will still be 100 feet wide with no hardship created as a result of
approval of this request.
Recommended Action: A MQTION to adopt A RE50LUTION APPROVING THE
COMMON BOUNDARY LOT RELOCATION

CO�ION BOUNDARY LOT LINE RELOCATION REQtTEST FROM

WHEREAS, the City of Rosemount has received a request from Charles
E. Stauffer, property owner of 3190 Lower 147th Street West, to
realign his easterly property boundary line; and
DPHEREAS, the property, located in Auditior' s Subdivision No. 27 and
identified as 3190 Lower 147th Street West, is currently 63 .56 feet
wide; and
DOHEREAS, the adjacent lot to the east, located in Auditor' s
Subdivision No. 27 and identified as 3170 Lower 147th Street West,
is curren,tly 110 feet wide; and
WHEREAS, the relocation of the common lot boundary line 10 feet to
the east will cause the lot identified as 3190 Lower 147th Street
West to be increased to 73 .56 feet wide and the lot identified as
3170 Lower 147th Street West to be reduced to 100 feet wide; and
DPHEREAS, the respective property owners have agreed to a transfer
of property to cause a common lot boundary realignment; and
rnT�iTREAS, the adjustment of a lot line by the relocation of a common
boundary is an exception to Ordiaance XVI2.86, Section 2 AN
AMENDMENT TO THE CITY OF ROSEMOtTNT SIIBDIVISION ORDINANCF XVII.4;
and i
WSEREAS, the lot line adjustment will not create a new lot for
residential use.
NO�T, THEREFORE, BE IT RESOLVED, the City Council of the Gity of
Rosemount hereby approves the Stauffer common boundary lot line
relocation subject to a legally recorded combination of the ten-
foot wide parcel with the 63 .56-foot wide lot.
ADOPTED this 6th day of September, 1994 .
