This organization provides review and management of stormwater planning in the Vermillion River Watershed. The process for selecting commissioners (5 positions) is such that each city and township in the organization is grouped by size and geographic area. Public Works Director/City Engineer Bud Osmundson is a current board member. Attached are letters from Attorney Roger Knutson, who is legal counsel for the Vermillion River Watershed Management Organization. The June 28, 1994 letter requests that the City Council eonsider reappointing Commissioners Jim Robinette and William Wendler, whose terms have expired. The letter dated August 10, 1994 requests that Council approve the appointment of Apple Valley City Engineer Dennis Miranowski. His appointment would fill the vacancy created by the resignation of Apple Valley City Administrator John Gretz. The terms of Commissioners Jim Robinette and William Wendler have expired. Both have requested reappointment. Rules of the State Board of Water and Soil Resources ("B.W.S.R.") require that the B.W.S.R. be notified of the vacancies and that notice also be published in a local newspaper. I hav� notified the B.W.S.R. of the vacancies and will arrange for the enclosed legal notiee to ue published in tne Dakota County Tribune. _ Paragraph 6, Subd. l, of the Joint Powers Agreement, copy enclosed, explains how the ten member townships make an appointment: • each City Council must select a delegate to select the new commissioner. • the delegates so selected are required to meet upon 10-days advance notice given by the Lakeville City Clerk. • the delegates by majority vote select the new commissioner. To make the process easier and without meaning to be presumptuous, the Boazd suggests that Jim and Bill be reappointed. If your City Council concurs,please notify me of your concurrence in writing. This would alleviate the need for a meeting of the city delegates. You should not act, however, until the 20th day of August, 1994, to allow interested persons to respond to the notice of vacancies that will be published in the Dakota County Tribune.
