NoTTCE IS HE�BY G�N, the City Council of the City of Rosemount will hold a Public
Hearing to consider the item listed below on Tuesday, January 4, 1994 in the Council
Chambers of the City Hall, 2875 145th Street West, beginning at 8:00 p.m. or as soon
thereafter as possible. The Public Hearing listed below pertains to property located at 3190
145th Street West, legally described as Lot 8, Auditor's Subdivision No. 27.
The purpose of this hearing is to consider an appeal to a variance gr�nted on November 9,
1993 by the City of Rosemount Planning Cammission sitting as the Boazd of Appeals and
Adjustments. The variance requested is in reference to minimum setback requirements to
allow construction of a garage (accessory structure) as required in Section 7.2
SUPPLEMENTARY REGULATIONS, Subsection A.6. Accessorv $uildings of Ordinance B -
City of Rosemount Zoning Ordinance. The variance approved by the Board of Appeals
and Adjustments was less than that requested by the applicant.
Persons wishing to speak on this variance request are invited to attend the meeting on

Mr. James (Pete} F. Atwood, 3190 145th Street West, wishes_ to
appeal a variance that was granted by the Board of Appeals and
Adjustments on November 9 , 1993 to construct a garage to replace a
nonconforming barn on his property. Because the variance does not
allow Mr. Atwood to build the garage in the same location as the
barn, he would like to appeal the variance decision to the City
Council.
The requested variance was nonconforming with three setback
standards. After considerable discussion, the Board of Appeals and
_ Adjustments g:ranted a variance that was- nonconforming with only one
setback standard, yet provided a practical solution with a reduced
impact on the neighborhood.

Mr. Atwood is requesting the variance so that he can tear down an existing "bus bam" on his
praperty on the southeast comer of 145th Street and Canada Avenue, and replace it with a
residential detached garage.
Discvssion
The "bns barn" is nonconforming in three setbacks and is out of context in the residential
neighborhood being slightly larger (1090 sq. ft.) than the house (I070 sq. ft.).
Mr. Atwood's corner lot is SS ft. wide which is also nonconforming in lot width requirements.
The standard for corner lot width is 95 feet resulting in a forty foot deficit. Given that the
typical corner lot has an additional twenty feet of required setbacks, Mr. Atwood would have
a code consistent building "footprint" of 15 ft. x 90 ft. The lot was platted in 1928 as part of
Auditor's Subdivision No. 27.
��NDINGS ,
The Board of Appeals and Adjustments and the City Council; upon appeal, must find as
follows in the granting of a variance from this ordinance: -
1. Granting a variance will not adversely affect the public health, welfare and safery and will
nor be detrimenral or injurious to property or improvements in the neighborhood.
2. Strict interpretarion or enforcement would result in a practical dif,j�culty or unnecessary
hardship inconsistent with the intent of this ordinance and the Comprehensive Guide Plan.
3. There are exceptional or eztraordiruiry circumstances or conditions applicable to the
property, use or faciliries that do not apply generally to other properties in the same :�,
dismct.
4. Strict ar literal interpretation would deprive the applicant of the use and enjoyment of his
property in a manner similar to other owners in the same district.
5. Granring of tlie varianee will not allow a use which is otherwise not a permitted use in tlie
zoning district in quesnon.

F[JRTHER DISCUSSION
The Supplementary Yard Regulations Section 7.2 C., requires that the average setbacks of
front yards in developed neighborhoods be used and that same figure is to be used for the
street-side yards on corner lots. The average front yard setback along the south side of 145th
Street West between Canada and Cameo Avenues is 27 ft. By comparison, the average
setback along Canada is 29.6 feet including the existing "bus barn".
The applicant uses the space belund the barn as his rear yard and would prefer to continue to
do so with the proposed garage. The adjacent houses along Canada Avenue to the south, front
along Canada so that the adjacent yard separating the gara.ge from the lot line is treated as a
side yard instead of a rear yard.
The new garage would require a 23 ft. (approx.) street-side variance and a 6.75 rear-yard
variance if approved according to the petitioner's request. The petitioner also has an RV that
he would park alongside of the new garage that would be next to the neighbor's front yard.
The RV would be parked on the remaining concrete slab left over from the demolished barn.
Several alternatives have been explored by the Planning Staff resulting in a recommendation
that wouid only require a five foot street-side variance. The garage would have to be placed
five feet west of the east property line, and 25 feet north of the south property line. As a
result, a useable back yard would be available, two trees woula still be saved, and the
presence of the garage (and RV alongside) would be minimized relative to the front yards
along Canada Avenue.
CONCLUSION
Planning Staff believes that the size of the corner lot and evolution of the neighborhood results
in a hardship for the property owner when the current zoning standards are applied which is
consistent with findings 2-5. There is also the opportunity to have a large nonconforming
strueture removed fram this area which may be considered currently detrimenta.l with the
surrounding residential uses, consistent with the first finding.
However, Planning Staff believes that repositioning of the proposed garage as discussed above
will further reduce neighborhood impact and not deprive the petitioner of reasonable use of the
property. Specifically, a code consistent rear yard would be available, that sufficient space in
front�of the ;arage would enhance off-street parking out of the Right-of-way, and enhance the
Canada orienteti front yards.
RECOMA�NDATION
MOTION to grant a street-side yard variance for 3190 145th Street West cvnditioned on the
proposed 28 ft.x 24 ft. gara.ge being located five feet from the east property line and 25 ft. �`'
north of the south property line.

Thank you for your recent letter reminding me of my right to
appeal the decision made on the varience I requested--
(Hearing held November 9th) to remove an existing garage

Dear Mr. Atwood:
As you recall, the City of Rosemount Planning Commission acting
as the Board of Appeals and Adjustments granted you a variance on
November 9 , 1993 so that you can build a garage on your property �
replacing the °bus barn�� .
As you also know, the variance permits the garage oniy if it is
placed 25 feet north of your southern property boundary, and five
feet from your east property line.
Because the variance is not what you had preferred, this letter
is a reminder of your right to appeal the Planning Commission
dPcision to the City Council. Should you decide to exercise your
right of appeal, you must do so in writing within thirty days of
the original action. There is also a fee of $100 for the appeal
to cover the cost of another public hearing.

NOTICE IS HEREBY GIVEN, the City Council of the City of Rosemount will hold a Public
Hearing to consider the item listed below on Tuesday, January 4, 1994 in the Council
Chambers of the City Hall, 2875 145th Street West, beginning at 8:00 p.m. or as soon
thereafter as possible. The Public Hearing listed below pertains to property located at 3190
145th Street West, legally described as Lot 8, Auditor's Subdivision No. 27.
The purpose of this hearing is to consider an appeal to a variance granted on November 9,
1993 by the City of Rosemount Planning Commission sitting as the Board of Appeals and
Adjustments. The variance requested is in reference to minimum setback requirements to
allow construction of a garage (accessory structure) as required in Section 7.2
