As of May 1, 1994, the MnDot State Aid for Local Transportation
Division requires that only certified technicians be used on a11 State
Aid work. They have initiated, within the past year, a techn.ical
certification program for al1 technicians either working for a
municipality directly or as consultants for a municipality. For the
City of Rosemount the certification training for our two technicians
requires six (6) classes on subjects from grading and base, bituminous
and concrete. The total cast to train the two engineering technicians
amounts to approximately $2, 000.00 . The technicians have begun these
classes within the last year and both will complete their
certification by 1995 .
By having certified technicians, it allows the City to use our
technicians to °inspect" State Aid projects instead of paying for
consultants on these type of projects, thereby saving core costs.
MnDot has now determined that the tuition costs for the required
classes are eligible for reimbursement from the administrative account
of N1nDot for any class taken between the time period of November l,
1992 and before December of 1995 . Each local agency, such as the
City, will be limited to a total reimbursement of $5, 000. 00 . The
requirement to be eligible for this reimbursement program is to pass a
resolution authorizing the attached agreement between MnDot and the
City. This agreement must then be sent to the State Aid office.
After each class has been taken and passed, the State Aid office will
reimburse the cost to the City. Staf�f recommends the adoption of the
attached resolution and the signing of the agreement.

A RESOLUTtDN AUTHORIZING AN AGREEMENT WITH
THE STATE OF MINNESOTA THROUGH THE COMMISSIONER OF
THE MINNESOTA DEPARTMENT OF TRANSPORTATION (MNDOT)
FOR THE REIMBURSEMENT OF CERTAIN TECHNICAL TRAINING COSTS
WHEREAS, the City is eligible for and utifizes State Aid Funding for eligible street
construction projects; and
WHEREAS, the State is authorized to administer the State Aid Administrative Account
pursuant to MN Statute 162.06, Subd. 2; and
WHEREAS, the Division of State Aid requires all personnel working on State Aid work be
certified; and
WHEREAS, the certification of technicians wiN ensure consistent inspection and high quality
roads and bridges; and
WHEREAS,the City recognizes the importance of building high quality roads and bridges; and
WHEREAS, the State Aid Office of MnDot has determined that the tuition cost for classes
to certify technicians is eligible for reimbursement from the MnDot Administrative Account
for certain classes taken between November 1, 1992 and December 31, 1995 in an
estimated receivable amount not to exceed $5000.00.
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Rosemount as follows:
That the agreement between MnDot and the City for the reimbursement of technical
training costs incurred by the City in the MnDot Technical Certification Program, be
approved and that the Gity Cierk and City Engineer be authorized to sign the
agreement on behalf of the City of Rosemount.

MNDOTiROSEMOUNT AGREEMENT
REIlVIBURSEMENT OF TECffi�TICAL TRAINING COSTS
THIS AGREEMENT is made by and between the State of Minnesota, acting by and
through the Commissioner of the Minnesota Department of Transportation
(hereinafter referred to as °MN/DOT" ) and ROSEMOUNT (hereinafter referred
to as "Recipient" ) .
WHEREAS the State is authorized to administer the State Aid Administrative
Account pursuant to MN Statute 162 .06, Subd. 2;
WHEREAS the Division of State Aid requires all personnel working on State
Aid work be certified;
WHEREAS the certification of technicians will ensure consistent inspection
and high quality roads and bridges;
NOW, THEREFORE, in consideration of the mutual covenants and agreements as
hereinafter set forth, the parties to this Agreement mutually agree as
follows:
I . Term of Agreement
This agreement shall be effective upon sueh date as it is executed as
to encumbrance by the Commissioner of Finance, and shall remain in
effect until all obligations set forth in this agreement have been
satisfactorily fulfilled or December 31, 1995, whichever occurs first,
by which time all requests for reimbursement must be received in the
State Aid Office.
II . Conditions of Agreement
All personnel working on State Aid work, including but not limited to
construction inspectors, and field testers, must be certified through
the Technical Certification Program on a11 work beginning on or after
January l, 1994 .
III . Reimbursement by MN/DOT
MN/DOT agrees to reimburse the Recipient an amount not �to exceed more
than $5, 000 . 00 total tuition costs incurred for personnel working on
State Aid work for the successful campZetion of classes taken between
November 1, 1992 , and July 31, 1995 . Recipient agrees ta pay all
costs not included in, or which exceed, said amount .
A: Recipient must submit a resolution from the City Council
approving the agreernent.
B: Request for reimbursement must be submitted on Recipient' s
letterhead indicating each participant' s name, title of eaeh
course taken, and amount to be reimbursed for each course.

C: Recipient must submit a copy af payment voucher or a copy of the
canceled check as proof of payment for each course.

Audits
IV. All records, books, documents, and accounting procedures and practices
relevant to this agreement are subject to audit and examination by
MN/DOT and either the Legislative Auditor or State Auditor as
appropriate.
Termination of this Agreement
V. MN/DOT may withhold payment or terminate this Agreement at any time if
the Recipient does not comply with the provisions of this Agreement .
General Provisions� -
VI . The Recipient agrees to indemnify and save and hold 'the State, its
agents and employees harmless from any and all claims or causes of
action arising from the performance of this agreement by Recipient' s
participants or employees . This clause shall not be construed to bar
any legal remedies Recipient or its participant' s have for the State' s
failure to fulfill it' s obligation pursuant to this agreement.
VII . Any amendments to this agreement shall be in writing and shall be
approved by MN/DOT and tne Recipient.
