The petition is a request for the City to vacate a portion of Lower 147th Street. Attached is a copy of the notice of completion of the vacation of a public street which was completed by the City Council in January, 1970. At that time, Lower 147th Street was called Hyland Street and the City vacated the south 27'/2 feet of Hyland Street for Lot 60 which is where the Totai Station is today. At that time no mention was made of Lot 61 which is the parcel to the west of the Total Station as'shown on the attached older plat map. There are three parcels identified with the last three digits of the P.f.D. as 010-61; 020-61; and 030-61 which this vacation would effect. After the vacation, the remaining street right-of-way is sixty t60) feet. This request is made to clarify the ownership of the property so that Mr. Vorwerk can sell the property. To vacate this right-of-way we must hold a public hearing providing the opportunity for adjacent property owners to make comments. We are recommending that the public hearing be set for 8:00 p.m. on June 7, 1994. The public notice and mailing list are also attached. RECOMMENDED ACTION: MOTION TO ADOPT A RESOLUTION SETTING A PUBLIC HEARING VACATING A PORTION OF LOWER 147TH STREET. COUNCIL ACTION: 7 , CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 1994 - A RESOLUTION CAUSING A RIGHT-OF-WAY VACATION WHEREAS, the City Councii at its Regular Meeting of May 17, 1994 set a public hearing for a right-of-way vacation described as follows, to-wit: The south twenty-seven and one-half (27'h) feet of Lot Sixty-one (61) of Auditor's Subdivision No. 1, Township 115, Range 19, in the City of Rosemount, County of Dakota, Minnesota. WHEREAS, it appears that it will be for the best interest of the City of Rosemount to vacate said right-of-way as it does not serve a public purpose. NOW, THEREFORE BE IT RESOLVED, that the Public Hearing be scheduled to consider vacation of said right-of-way to be held on Tuesday, June 7, 1994 at 8:00 o`clock p.m. or as soon thereafter as possible, in the Council Chambers of the City HaIL , ADOPTED this 17th day of May, 1994.
