The City has received a petition from CMC Heartland Partners for public improvements on
Biscayne Avenue between 145th Street and CSHA 42 adjacent to their preliminary plat.
Staff is recommending that this become a part of City Project #249, the Biscayne Avenue
Improvements. The City received a petition from the National Guard for the operation and
maintenance facility which will be located north of the railroad tracks on the west side of
Biscayne Avenue on December 7, 1993. This new petition for improvements is really an
extension of the same project, therefore, Staff is recommending that SEH, Inc. be the firm
to complete this necessary feasibility report. The feasibility report will address the
necessary street and utility work and will also investigate financing alternatives.
Since this is not a petition from 100% of the benefitting properties, it will become a City
initiated project and witl require a four-fifths vote at each step of the Chapter 429
Improvement process.
As a side note, we are meefing with members of the National Guard Operation and
Maintenance Facility design team today, May 17.
Staff recommends the Council receive the petition and add it to the feasibility study.

To the City Councii of Rosemount, Minnesota:
We, the undersigned, being the owners of all of the real property legally described as
follows:
SEE ATTACHED DESCRIPTION
hereby petition the city council to undertake without pubfic hearing under Minnesota
Statutes, Section 429.031, the following improvements for such property and agree to pay
for all costs (not to exceed $2500.00) for the preparation of the feasibility report for these
improvements in the event the improvements are not ordered in:
Sanitary Sewer X Walkways
X Watermain X 5treets
X Storm Sewer X Curb & Gutter
X Streetlights _ Other
and pay the entire assessable costs thereof against our property encompassing or
abutting said improvements based on benefits received equal to the residential equivalent
of the improvements without regard to the cash valuation (but in no event shall such
amount exceed one half (1/2) of the total assessable costs for said improvements).
Notwithstanding the above, petitioning Owner shall not be obligated to pay such
assessable costs unless Owner approves the cost of such improvements (on a
guaranteed not to exceed basis) in writing prior to the commencement of the construction
of said improvements. .

We also agree to guarantee one half (1/2) of the payment for the preparation of plans
and specifications for the above petitioned improvements, provided that we give our prior
written approval of the cost of such plans and specifiications, in order that the plans and
specifications may be prepared simultaneously with the feasibility report.

A RESOWTION RECEIVING PETITION/ORDERING FEASIBILITY REPORT
BISCAYNE AVENUE STREET AND UTILITY IMPROVEMENTS
CITY PROJECT #249
WHEREAS, the City Council of the City of Rosemount has received a petition from
the property owners of fifty per cent of the abutting property owners adjacent to
Biscayne Avenue.
NOW, THEREFORE BE IT RESOLVED, by the City Council of the City of Rosemount
as follows:
(1) the aforesaid petition represents 50% of the owners of the affected
property; r
(2) the property owner requests in the petition that the improvements be
constructed and that the entire cost for their share less the City's share
of the cost of improvement be assessed against the property;
(3) the aforesaid petition is approved and placed on file.
ADOPTED this 17th day of May, 1994.
