Mr. "Pete" Atwood is appealing a variance he was granted for a
garage by the Planning Commission on November 9 , 1993 . The City
Council conducted a public hearing on January 4, 1994 for the
appeal . Action on the appeal was tabled for consestedtland that
possible compromise between the variance, as requ
which was granted by the Planning Commission.

Dear Richard;
Thank you for your recent letter reminding me of my right to
appeal the decision made on the varience I requested--
{Hearing held November 9th) to remove an existing garage
from my property and build a new one in approximately the
same location. I would indeed like to appeal this decision
and am writing to formally request this. I understand that
there is another $100. 00 fee for this and have enclosed a
check for this amount. I will look forward to hearing from
you setting dates for this action.

Hearina to consider the item listed below on Tuesday, January 4, 1994 in the Council
Chambers of the City Hall, 2875 145th Street �est, b b�inning at 8:00 p.m. or as soon
thereafter as possible. The Public Hearing listed below pertains ta property located at 3190 -
145th Street West, legally described as Lot 8, Auditor's Subdivision No. 2�.
The purpose of this hearing is to consider an appeal to a variance �ted on November 9,
1993 by the City of Rosemount Planning Comrnission sitting as the Board af Appeals and
Adjustments. The variance requested is in reference to minimum setback requirements to
allow construction of a Qarage (accessory structure) as required in Section 7.2

Mr. Atwood is requesting the variance so that he can tear down an existing "bus barn" on his
property on tne southeast corner of 14�th Street and Canada Avenue, and replace it with a
residential detached gara�e. _

The "bus barn" is nonconzorn-iin� in thre� setbacks and is out or context in the residential
n�ighborhood bein� sliahtly laraer (1490 sq. ft.) than the house (1070 sq. f�.).
Mr. Atwood's corner lot is �� ft. wide which is also noncanfarmin� in lot «�i�th requirements.
. Th� standard for corn�r lot w�idth is 9� feet resulting in a forty foot deficit. Given t}�at the

The applicant uses the space behind the barn as tlis re:ar yard and wo�ld pre�er to continue to
c�o so ��ith th� pr�pose.d �arage. Th� adjacent houses alang Ganada ���enue to the sout}Z, front
alonb Canada so that the adjacent yard separatin� the �a.�-a�e frorn the lot lin� is treatpd as a
side yard instead of a rear yard.
� The ne�- garaae would require a 23 ft. (approx.) street-side variance and a 6.7� rear-yard
variance if approved according to the petitioner's request. The p�titioner also has an RV that
