In the attached April 5, 1994, memo to Rick Pearson and Ron Wasmund, I
stated in part:
. . . the Rosemount Port Authority entered into a "non-repurchase
agreement" with Repairs, Inc. in February of 1993 . One of the
stipulations of that agreement required the port authority to refund
Repairs, Inc. the rent that had been paid to the city from the time of
the original EDA purchase. That amount is about $13 , 000 .
To earn the refund, however, Repairs, Inc. had to do two things .
First, it had to reopen its business in Rosemount. Second, Repairs,
Inc. had to " . . .comply with all applicable city codes, regulations,
and zoning requirements . "
The April 5 memo to me from Mr. Pearson states that Repairs Inc. is not
presently in compliance with the city' s zoning ordinances . In particular,
Repairs, Inc. is located in the C-2 Community Commercial District, a
district that does not permit automobile related uses .
I have visited also with Paul Heimkes regarding building code issues. Mr.
Heimkes has stated that Repairs, Inc. has taken action to meet all building
code requirements, there are no unresolved issues .
On March 30, however, Arlyn Cope, President of Repairs, Inc. asked the port
authority to " . . , release all funds being held in escrow. " This requires
action by the commissioners.
Mr. Cope should be advised that the port authority must deny his request at
this time but that he should work with the city' s planning commission and
city council to resolve the zoning issue. Upori rectification of zoning
issues, payment could be made.
RECONIlKENDED ACTION: Motion to deny payment to Repairs, Inc. of the
rent escrow until the zoning issue regarding use of the site is
resolved.

RE: Repairs Inc. Code Compliance
As you are aware, the Rosemount Port Authority entered into a "non-repurchase agreement"

authority for payment, I need from both of you written confumation that Repairs Inc. has
complied "... with all applicable city codes, regulations and zoning requirements."

Dear Mr. Pedersen:
As discussed during the occupancy inspection of 14760 South
Robert Trail on November 9 , 1993 , I have attached my memo of the
code requirements for the Rep�irs Inc. project. These
requirements must be addressed as soon as possible. Upon
completion of these issues a reinspection will be necessary. If
all issues are found to be complying during the reinspection a
Certificate of Occupancy will be issued.
If you should have any questions or need clarification on any of
these requirements you may contact me at City Hall at 322-2024 .

III. Fire Code Requirements
1. Install 1 - 20BC fire extinguisher in the repair shop.
2 . Vent the 55 gallon drum waste oil barrel to the outside.
Also provide a spring closing funnel flap on the filler
funnel of the waste oil barrel .
IV. City Zoning Code Requirements
1. The new sign installation requires a sign permit and
must meet the requirements of the sign ordinance.
2 . The auto repair shop is a non-conforming use in the C-2
Zoning District. The Planned Unit Development (PUD)
process must be approved by the Council to establish
conformity for the use. The owner of the property must
apply for and start this process as soon as possible.
3 . The parking and storage of the "U-Haul" rental eguipment
must be maintained so as not to obstruct required
parking or fire/emergency vehicle access .
