DRAFT APPROVED BY: 1994 LEASE AGREEMENT Rosemount Floral leased the "old post office land remnant" from the port authority for the period of May 7 through May 21 of 1993 . Phil Tobey, proprietor of Rosemount Floral, used the parcel to erect a tent as part of his Mother' s Day promotion. A copy of that lease agreement is attached for your review. Mr. Tobey would like to do a similar promotion this year, leasing the land from May 1 through May 10 . Mother' s Day is May 8 . As there were no problems with Mr. Tobey' s use of the land last year, the staff recommendation is for approval of the request . In fact, there were several positive comments from other business owners that Mr. Tobey' s promotion brought color and added activity to the downtown. RECOMMENDED ACTION: Motion to approve the lease agreement for Rosemount Floral permitting use of the old post office land remnant for a Mother' s Day promotion. PORT AIITHORITY ACTION: ' � � q43 LEASE AGREEMENT This agreement is made and entered into this � day of April, 1993, by and between the Rosemount Port Authority, a public body corporate and politic under the laws of the State of Minnesota ("Authority"), and Rosemount Floral, a proprietorship (Tenant). 1. Lease. The Authority hereby leases to Tenant, subject to the terms and conditions of this Agreement and the Tenant hereby leases from the Authority land described as the eastern 31 feet of Lot 36 of Auditors Subdivision No. l. i i� 2. Terms. This lease shall commence May 7, 1993 and terminate May 21, 1993. 3. Rent. The Tenant shall pay $1.00 and other valuable consideration to the Authority. 4. Tenant's Covenants. Tenant hereby agrees as follows: (a) The site shall be used for the erection of a tent as part of a mother's day sales promotion. (b) There shall be no encroachment on the public right-of-way. (c) The property shall be restored to its original condition. (d) The Authority shall be held harmless for any liability resulting from the sales promotion or actions of the tenant.
