The easements necessary for the construction of City Project 235, consist
of three major easement or right-of-way acquisitions plus three temporary
grading easements.
The germanent ri�ht-of-way or easement acquisitions consist of three
separate properties and the negotiations are summarized as follows:
1. Fred Uitdenbogerd - The acquisition of approxima.tely 1,262 square feet
in the front yard area of Mr. Uitdenbogerd's property, which will be used
for the alignment change of the Dodd Boulevard intersection with
Chippendale Avenue. Mr. Uitdenbogerd has verbally agreed to our offer.
2 . Mrs. Regina R. Rahn Rei�ert - Mrs. Reigert has a somewhat different
situation in that we are trying to acquire 663 square feet of the sideyard
adjacent to Chippendale Avenue due to the realignment of the Chili-
Chippendale Avenue intersection with 145th Street. Mrs. Reigert has
verbally agreed to our monetary offer with one stipulation. The
stipulation hinges on the� fact that she would like to clear up the
ownership of the former podd Road right-of-way adjacent to her property.
Upon further research., it appears that the City took steps to vacate that
area or a portion thereof on September 20, 1977. However it appears that
this vacation was never recorded at the County offices. More investigation
by Staff will be completed on this subject and hopefully be clarified in
the near future. I am optimistic that the negotiations for this right-of-
way acquisition will be accomplished within the next two to three weeks.
3 . The ma.jor property acquisition necessary for the realignment of Chi1i
Avenue is a portion of Outlot A of the Carrollton Addition. City Staff inet
with the Carrolls numerous times in the past and had ma.de a farmal offer to
them. There are numerous other issues with which the Carralls have brought
to the table. Last week, City Attorney Mike Miles and myself inet with the
Carrolls and their attorney and did receive a counter offer from the
Carrolls . At this time we are far apart. However, I am optimistic that we
can close an agreement with the Carrolls in the next month.
We have three temporary grading easements we need to aequire from the
Rosemount Green Apartment Buildings, the Rosemount Woods Apartment
Buildings and the vacant 1ot at the intersection of Cimarron and 145th
Street. The acquisition of these easements is to assure that aesthetics
and drainage to the street are accomplished. Contacts have been made with
the owners of these parcels. Failing to acquire these temporary grading
easements will not stop this project.
