The terms of the agreement are clearly stated. The Community Center Commission recommends City Council approval . RECOMMENDED ACTION: Motion to approve the attaehed agreement with Rosemount High School . COUNCIL ACTION: . �. ROSEMOUNT COMT�IUNITY CENTER ROSEMOUNT HIGH SCHOOL AGREEMENT AGREEMENT made this 23 day of November, 1993, by and between the City of Rosemount ("City") and Rosemount High School ("School"). WITNESSETH: The following terms and conditions constitute an agreement between the City and the School to provide faeilities for hockey and ringette games, practices and taurnaments, at the Rosemount Community Center located at 13885 South Robert Trail, Rosemount Minnesota, for the period cammeneing December 27, 1993 and ending March 18, 1994, to wit: l. The City provides ice tune for practices subject to provisions outlined in the Ice Contract covering the above period. 2. The City operates all concessions and invites the Blue Line Booster Club to participate in cancession operations as outlined in the Concession Contract for the above period. 3. The City collects 50% of gate game receipts, with a minimum of $580 (based on JV & Varsity games piayed back to back). The City hires, trains, and supervises one ticket taker and one ticket seller of which the School reimburses the cost of to the City. The City sends the balance of the gate receipts to the School no later than April 15. 4. The School provides a mutually agreed upon number of crowd control staff. 5. The School provides an event announcer, referees, and game officials if required. 6. The City provides Game Goals. 7. The City provides an On Duty Manager. 8. The School will provide liability insurance in the amount of $1,000,000.00 naming the City as additional insured. 9. The Schooi shall indemnify and hold harmless the City, all its officers, agents, and employees, of and from any and all claims, demands, actions, or causes of actions of whatsoever nature of character arising out of or by any reason of the services and obligations provided for herein and further agrees to defend at its sole cost and expense any action or proceeding commenced for the purpose of asserting any claims of whatsoever character arise hereunder. � s M IN WITNESS WfIEREOF, the City and School have hereunto affixed their signatures this day of , 19 Community Center Manager Athletic Director City Administrator Principal Mayor Accepted by the City of Rose�nount this day of , 19
