Mr. James (Pete) F. Atwood, 3190 145th Street West, is appealing a v�riance that was granted for his property. On November 9 , 1993 the Planning Commission, acting as the Board of Appeals and Adjustments, granted a variance to Mr. Atwood to allow him to construct a detached garage on his property. The Board' s decision was to modify Mr. Atwood' s request and allow a variance permitting the encroachment of the structure into the street side yard setback by five feet. Mr. Atwood' s requested variance would have increased the street side yard encroachment to about 18 feet. �It would also create a rear yard encroachment of about ten feet. The Board of Appeals and Adjustments' intent was to grant as minimal a variance to ordinance standards as possible to reduce the impact to adjacent properties along Canada Avenue. I would indeed like to appeal this decision and am writing to formally request this. I understand that there is another $100. 00 fee for this and have enclosed a check for this amount. As you also know, the variance permits the garage only if it is placed 25 feet north of your southern property boundary, and five feet from your east property line. Because the variance is not what you had preferred, this letter is a reminder of your right to appeal the Planning Commission decision to the City Council. Should you decide to exercise your right of appeal, you must do so in writing within thirty days of the original action. There is also a fee of $100 for the appeal to cover the cost of another public hearing. If you have any questions I can be reached at 322-2052 .
