This item is b�ing discussed on Tuesday night to provide you with the
�ackground necessary tc set a public hearing for vacation of certain public
right-of-way.
The Rosemount Methodist Church has filed a petition for the vacation of th�
public right-of-way whieh extends south from Lower 147th. Street to theix
sauth property line. This is not a through street . This alley serves an:ly
as access to the Church parking lot. One other property owner gets access
t� a detac�ied garage in his rear �ard via this alley. This property owner
i� Mr. Don Ratzlaff.
T�is right-of-way was originally dedicated to the Village to provide access
to the Church when they rented to the School District for classroorn s��.c�.
The right-of-way lies entirely on the lot owned by Church. The Chur�h w�il
grant an access easement to Mr. Ratzlaff so he ean continue to accGss his
�arage.
The Church �esires to improve and expand their parking lot . In the past
they nave asked for and received money from the City to offset the cost of
repair and maintenance to this alley and parking area. The City cioes not
sr_owplow er maintain this alley except on a rare request of the Crurch. By
vacating �he right-of-way. the Church can improve their parking lot without
having to adhere to strict City Standards . They can make the iinprovements
at their schedule and there is no cost to the City or its taxpayers .
To vacate this right-of-way we mzzst hold a public hearing providing
opportunity for adjacent property owners to make camments. I am
recommending that you set the hearing for 8 : OQ p.m. on May 18, 1993

SUBJECT: Rosemount United Methodist Church
On Monday March 29, 1993 I met with Mr. Wes Hasbrouk. He was representing the
Rosemount United Methodist Church. They are in the planning process to reconstruct
and add to their parking lot.�That in and of its self is not a problem. The questions
that arise relate to pubiie right of way that starts at Lower 145 Street and extends
scauth. We have a 60 foot by approximately 639.49 right of way which runs north
and south along the east edge of their lot.
Several (?} years ago the City's public works superintendent always informalfy agreed
to contribute twenty percent of repair costs from City funds. The church board is
now wondering if they can count on participation from the City in this canstruction
praject. My respons� to Mr. Hasbrouk is one of two scenarios neither involving casfi
payment to thern. I feel �ti�e could accept a petition from them do the improvernents
within the public right of way as a public project and assess them the full cost. The
second scenario being my cecommendatian is to simply vacate or sell ihe right ofi
way back to the church and permit them to do what they want to do.
Mr. Hasbrouk seems to be in fauor of the vacation but there are members that are
not. i am going to ask Mike Miles to review the legal description for the right of way
to make sure there are no encumbrances. With your concurrenee I will advise the
church through Mr. Hasbrauk of our desired resolutian for discussion at their April
6, 1993 Board meeting. t will also place this on the agenda for the April 2D, 1993
Council meeting.

NOTICE OF STREET VACATION
TO WHOM IT MAY CONCERN:
NOTICE iS HEREBY GIVEN, that the City Councii of the City of Rosemount will
conduct a public hearing on Tuesday, May 18, 1993, in the Council Chambers of the
City Hall, 2875 145rth Street West, beginning at 8:00 p.m. or as soon thereafter as
possible. The purpose of this hearing is to consider a street vacation affecting the
following legally described property:
The East 60 feet of the North 467.52 feet of Lat Thirteen (13) Auditors
Subdivision No. 27, Tawnship 115, Range 19, in the City of Rosemount,
County of Dakota, Minnesota.
Such persans as desire to�be heard with reference to the above itern will be heard at
this meeting.
