In order to confirm the indemnification of Mayor McMenomy in the
McDonough/Sunrise Builders case it is necessary to adopt a formal
resolution in the matter.
A resolution setting out that action is attached and recommended for your
consideration.
RECOMMENDED ACTION:

RESOLIITION 1992 -
A RESOLIITION AFFIRMING INDEt+�JIFICATION OF
CITY ENiPLOYEE LEGAL FEES AND CLAIMS
WHEREAS, the City of Rosemount, Mayor E.B. McMenomy and City
Administrator Stephan Jilk have been named in certain legal
action brought by a Mr. Michael McDonough; and
WHEREAS, these claims cause the individuals named to obtain legal
services to defend themselves and to carry potential liability
depending on the outcome of the consideration of these claims;
and
WHEREAS, the City Council has determined that Mayor E.B. McMenomy
was acting as a "Defacto Official" between November 5, 1991 and
January 1, 1992 in these matters.
NOw, THEREFORE, BE IT RESOLVED, that the City Council agree that
the City of Rosemount will indemnify E.B. McMenomy for legal fees
and potential claims arising out of the Sunrise Builders Supply
Case by Michael McDonough.
ADOPTED this 19th day of January, 1993 .
