All costs are in and the project is ready to assess. City Project #223 was initiated through a petition from Rosemaunt Development Corporation for the construction of public streets and utilities for the West Ridge 4th Addition. The public hearing was held on February 18, 1992 . The Feasibility Report project cost estimate was $365, 000. The project was completed in August of 1993 . The final project costs totalled $309, 592 and are itemized on the , spreadsheet entitled Breakdown Report. The total cost included , $34, 638 attributed to the Sanitary Sewer Core Fund and $11,599 to the Storm Sewer Core Fund. The xemaining cost is assessable to the benefitting property which is the West Ridge 4th Addition. The final assessable cost to the project was $263, 355 which is $8,230 per lot compared to the Feasibility Report estimate of $9 ,400 per lot. f r Staff is recommending declaring cost and setting a public hearing o October 19, 1993 at 8 :00 p.m. or as soon as possible thereafter. COUNCIL ACTION: 2 � i CITY OF ROSEMOIINT DAKOTA COUNTY, MINNESOTA ' RESOLIITION 1993 - A RESOLUTION DECLARING COST TO BE ASSESSED AND ORDERING " PREPARATION OF PROPOSLD ASSESSMENT, AND CALLING FOR HEARING ON THE PROPOSED ASSESSMENT WEST RIDG}3 4TH ADDITION STREET AND UTILITY IMPROVEMENTS CITY PROJECT #223 WHEREAS, a contract has been let for West Ridge 4th Addition Street and Utility Improvements and the contract price for such improvement is $234,472 .26, and the expenses incurred or to be incurred in the ma.king � of such improvement amount to $75, 119 .74 so that the total cost of the improvement will be $309,592 . NOW, TBEREFORE, BFs IT RESOLVED by the City Council of Rosemount Minnesota: 1. The portion of the cost of such improvement to be paid by the Cit� is hereby declared to be $46,237 and the portion of the cost to be assessed against benefited property owners is declared to be $263, 355. � 2 . Assessments shall .be payable in equal annual. installments extending � over a period of 10 years, the first of the installments to be payable with general taxes for the year 1993, and shall bear interest at the rate of 2% points per annum above the interest �ate paid by the City for its bonds from date of the adoption of the assessment resolution. 3 . The City Clerk, with the assistance of the Public Works Director shall forthwith calculate the proper amount to be specially assessed for such improvement against every assessable lot, piece or parcel of land within the district affected, without regard to cash valuation, as provided by law, and he shall file a copy of such proposed assessment in his office for public inspection; and BE IT FIIRTHER RESOLVED by the City Council of -Rosemount, Minnesota: 1. A hearing shall be held on the 19th day of October, 1993, in the City Hall at 8:00 p.m. , or as soon thereafter as possible, to pass upon such proposed assessment and at such time and place all persons owning property affected by such improvement will be given an opportunity to be heard with reference to such assessment. 2 . The City Clerk is hereby directed to cause a notice of the hearing on the proposed assessment to be published once in the official newspaper at least two weeks prior to the hearing, and she shall state in the notice the total cost of the improvement. She shall also cause mailed notice to be given to the owner of each parcel Resolution 1993 - described in the assessment roll not less than two weeks prior to the hearings. BE IT FIIRTHBR RESOLVED by the City Council of Rosemount, Minnesota: � The owner of any property so assessed may, at any time prior to eertification of the assessment to the County Auditor, pay the whole of the assessment on such property, with interest accrued to the date of payment, to the City, except that no interest shall be _ charged if the entire assessment is paid within 30 days from the adoption of the assessment. The owner may at any time thereafter, pay to the County Auditor the entire amount of the assessment remaining unpaid, with interest accrued to December 31 of the year in which such payment is made. RIGHT OF APPEAL: An owner of property to be assessed may appeal the assessment to the district court of Dakota County -- pursuant to Minnesota Statutes, Section 429.081 by serving notice of the appeal upon the Mayor or Clerk of the City within 30 days after the adoption of the assessment and filing such notice with the district court within ten days after service upon the Mayor or Clerk. LIMITATION ON No appeal may be taken as to the amount of APPEAL: any assessment adopted by the City Council unless a written objection signed by the affected property owner is filed with the Clerk prior to the assessment hearing or : presented to the presiding officer at the hearing.
