Not. , Mail Lis�, Assess Roll On May 18, 1993 a Public Hearing was held to consider the assessments for Project No. 191. The Public Hearing was continued to a later date while appraisals were completed which would estimate the benefits of the public improvement. We have received the appraisals which were completed by Racine Appraisals and a copy of the 3 are in your packet. The following table summarizes the findings of the appraisals: P.I.D. We are recommending to continue the public hearing for this project on October 19, 1993 . The three property owners previously had objected to the assessments and a copy of that objection is included in your attachments. At that time, Council may decide on the assessments. We are sending out the same information in regards to assessment calculations as was previously noticed to the property owners. Council can then determine if a change in the assessments is appropriate:_. _ RECOI�IENDED ACTION: MOTION TO ADOPT A RESOLUTION CALLING FOR THE CONTINUATION OF THE PUBLIC HEAR.ING ON THE PROPOSED ASSESSMENT, CHIPPENDALE AVENUE IMPROVEMENTS, CITY PROJECT #191. ` COIINCIL ACTION: 11 . r , CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 1993 - A RESOLUTION CALLING FOR THE CONTINUATION OF THE PUBUC HEARING ON THE PROPOSED ASSESSMENT FOR ' CHIPPENDALE AVENUE IMPROVEMENTS CITY PROJECT #191 WHEREAS, the City let a contract for CHIPPENDALE Avenue Improvements, City Project No. 191, and WHEREAS, on April 20, 1993 the City Council declared the cost of those improvements and the contract price for such improvement is $143,722.00, and the expenses incurred or to be incurred in the making of such improvement amount to 548,251.00 so that the total �ost the improvement will be $191,973.00 and WHEREAS, the City Council held a public hearing to consider the proposed assessments on May 18, 1993 and WHEREAS, the City council ordered staff to obtain an appraisal for the benefits from the improvements for the three (3) parcels proposed to be assessed and to continue the public hearing until such time that this appraisal was completed and WHEREAS, staff has received this appraisal for benefits and has distributed this appraisal to the City Council, NOW,THEREFORE,BE IT RESO�VED that the City Co�ncil of Rosemount Minnesota has received the appraisal� and the date for continuation of the public hearing is hereby established to be-0ctober 19, 1993 at 8 p.m., or as soon thereafter as possible for consideration of the final assessment rolL ADOPTED this 21 st day of September, 1993. You were previously provided a project history for this project. � � The total cost of the project was $191,973 . Water Core funds paid $9, 116. �i'he remaining cost is being distributed over three (3} parcels on a per acre (unit) basis. The owner and cost to each parce� has been provided to you for your review. The original public hearing held June 5, 1990 informed the progerty owners that up to $130, 000 would be assessed for this project. The - current and final amount to be assessed is $182, 857. Short, Elliott, Hendrickson, Inc_ was the engineering fiYm far this project. Staii will provide a brief overview of the project and answer any questions you or the public may have regarding t?-.is it�m. Staff recommends setting a public assessment hearing for May 18, 1993 . The initial plan was to construct Chippendale Avenue to a 48' wide, Mu:�icipal State Aid (MSA) street in compliance with MSA Standzrds, . plus required public utilities for this segment. The project cost estimate for this design was $Q50, 000. The Engineering Plans w�re completed for this 48' design. However, tre project was delayed due to lack.'of MSA funding and 1�TDOT delay of the Trunk Highway 3 - Improvements, which are just now being constructed.� (Chippendale was �o be used as a detour route during the T.H. tt3 construction. ) TY+e project scaled down to provide a minimum wid�h paved surfacs w�t?: a cost �stimate of $270, 000, which was reported to Council oz N'�y 10, 1990. An Assessment Hearing was neld on Octob�r 20, 1992 but no action was taken due to a decision by the City Attorney that a new Public Kearing should be held due to an increase in the amount of assessments from the original Public H�aring I�Totic�. The new notice with the new total cost is attached for your review. Stat. 429.061, and thereby a reservation of a11 rights of appeal pursuant to Minn. Stat. 429.�81, - the undersigned property owners formally object to the assessment of September 29, 1992 as excessive and inconsistent for the followinq reasons: I. As the Supreme Court of Minnesota stated in the 1977 case of Continental Sales and E ui ment Co. v. Town of Stuntz, 257 N.W.2nd 546, the only factor to be considered in determining the amount of the assessment is the "increase in the fair market value" of. -the affected property. On September 29, �1992, the City of Rosemount assessed the property of Edward B. McMenomy, Jr. and Katherine L. McMenomy, Louis Geronime and Thomas Geronime in the amount of One Hundred Eighty Two Thousand Eight Hundred Fifty Seven and no/100ths Dollars ($182,857.00) . The purpose of this assessment was to cover the improvements for Chippendale Avenue (City Project No. 191) . However, the city's own prior statements show that this current assessment is excessive. In two prior notices of assessment for this same project, th� costs of the assessment were estimated at One Hundred Sixteen Thousand ($116,000.00) and One Hundred Thirty Thousand Dollars ($130,000.00) respectively. Both of these assessments included the following proposed improvements: "Sanitary sewers, water mains, storm sewers, aggregate bases, select granular, burrow modified, bituminous surfacing, concrete curbing and gutter, and lighting unit", (see attached copy of Public Notice of Proposed Improvements) . Now that the project is complete, the only improvements which the city claims to have performed, and therefore the only improvements which the current assessment can be based on are the sanitary sewer, water main, storm sewer and street improvements. There is no showing that these improvements increased the fair market value of the McMeno�►y and _ Geronime properties by One Hundred Eighty Two Thousand Eight Hundred Fifty Seven Dollars ($182,857.00) and accordingly, the current assessments are excessive and inconsistent with the city's earlier assessments. II. The September 29, 1992 assessment is also improper because it does nat comply with Minn. Stat. §429.061 which requires that all notices af assessment shall state °the general nature, of the improvement". Such an admission renders the September 29, 1992 assessment invalid. Based upon the foregoing and reserving all rights, objections, and arguments relating the amount of the current assessment, and all earlier assessments, the undersigned, on behalf of the above-named property owners, respectively objects to the current assessments as excessive, inconsistent, improper, and invalid.
