Mr. Rahn was requesting a variance from the accessory structure size permitted for non-agricultural uses in the AG Agricultural District. The Planning Commission reviewed the petition and determined that the request could not be approved because it could not meet the required findings for granting a variance and would result in the expansion of a nonconforming use. For more _ details please review the minutes and Planning Commission review flated _August 10, 1993 . The Commission initiated a rezoning and text amendment to rectif�r the nonconforming use issue for Mr. Rahn' s Golf course. The Commission sympathized with Mr. Rahn' s need to build this structure, but was concerned about the precedence that granting a variance for a nonconforming use wo�a.ld. set . - Even though the Commission directed staff to proceed immediately with the text amendment, Mr. Rahn exercised his right to appeal the decision. The Zoning Ordinance requires that in order to reverse the Planning Commission' s decision, the City Council must find that the Commission made an error in fact, finding or procedure. Staff has reviewed the case and has found no error made by the Commissian. Therefore, Planning staff recommends that the Council uphald the Commission decision. The Zoning Ordinance amendment is also on this agenda. The Council may wish to discuss these items simultaneously. Recommended Action: MOTION to uphold the Planning Commission' s decisian on the Ray Rahn variance petition and to determine that the Commission followed sound procedure and made adequate findings. RAHN: 3855 14STH STREET EAST, RICH VALLEY GOLF COURSE PUBLIC HEARING: Variance Petition to Section 7.2 A-6 of the Zoning Ordinance limiting maximum aggregate accessory structure square footage to 2,400 sq.ft. PttoPos�, Mr. Raymond A. Rahn, owner of the Rich Valley Golf Course is requesting a variance to construct a 5400 sq. ft. pole barn on his property located north west af the golf course. The property is in the Agriculture District (AG) and the golf course is considered a legal non- conforming use. The Zoning Ordinance limits non-agricultural uses in the AG and Agricultural Preserve (AG-P) Distriets east of Akron Avenue to a maximum aggregate total of 2400 sq. ft. for accessory structures. DISCUSSION The proposed pole barn will be located with existing accessory buildings an the presumed original farmstead that is south of 140th Street Ea.st. The pole barn is intended to provide storage for maintenance equipment for the golf course. Currentiy, four accessory buildings adding up to approximately 7900 sq. ft. are in the immediate area. The new pole barn will replace an existing shed of appro7cimately 1125 sq. ft. As a result, the aggregate total square footage will be about 12,200, about 9800 sq. ft. more than is allowed by the ordinance. The City suspects that a non-conforming excavating business is haused in the e�sting 3800 sq. ft. storage building, complete with office space. Findings The Board of Appeals and Adjustments and the City Council, upon appeal, must find as follows in the granting of a variance from this ordinanee: 1. Granting a variance will not adversely afj`'eet the public health, welfare, and safety and will not be detrimental or injurious to properry or improvements in the neighborhood. � 2. Strict interpretation or enforcement would result in a practical difficulty or unnecessary hardship inconsistent with the intent of this ordinance and the Comprehensive Guide Plan. 3. There are exceptional or extraordinary circumstanees or conditions appticable to the property, use, or facilities thar do not apply generally to other properties in the same district. _ 4. Striet or literal interpretatian would deprive the applicant of the use and enjoyment of his properry in a manner similar to other owners in the same district.' S. Granting of the variance will not allow a use which is otherwise not a permitted use in the zoning district in question. CONCLUSION The golf course is a legal non-conforming use in the AG District and is also non-conforming with regard to accessory structure standards. Per Section 13 {Non-Canforming Uses) of the Zoning Ordinance, structures and uses may not be enlarged ar altered with out bringing them � into conformance. In addition, a separate excavating business apgears to be housed-on tne _ premises. Relative to the findings, the applicant does not meet findings 2,3 or 4. In fact; granting a variance would be in conflict with the Comprehensive Guide Plan by intensifying or enlarging non-conforming uses; the only exceptional circumstances applicable to the property is the '� multiple non-conforming use; and, the applica.nt would not be deprived of the use and enjoyment of his property. Granting a variance may actually directly or indirectly allow for the continuance or expansion of a use which is not a permitted use in the Agriculture District. No hardship has been demonstrated regarding the property, or use that denies ordinance consistent use of the�property. Planning Staff recommends denial of the variance petition because the petition does not meet the findings needed to grant a variance at this time. RECOMl��NDATION _ MOTION to deny the variance to aceessory structure standards in Section 7.2 of the Zoning Ordinance because the petition does not meet the required fmdings of Section 15.2 G of the Zoning Ordinance.
