This year when the operators of two paintball businesses in Eastern
Rosemount requested review of �heir annual permits, they indicated
that they wished to operate on a year round basis rather than on a
seasonal basis. It waS decided that prior to allowing these uses to
operate on a more� permanent basis, they needed to come into
compliance with the Zoning Ordinance. Both businesses are located in
different zoning districts and neither district would permit this
type of use. The paintball operators have jointly petitioned the
City to amend the Zoning Ordinance. The Planning Commission has
studied this request and is recommending that this use be permitted
by Iiiterim Use permit.
The Commission is drafting the final ordinance and asks the Council
to set a public hearing for September 21 to consider that ordinance.
Recommended Action: MOTION to schedule a public hearing on
September 21, 1993 at S : OO p.m. or as soon thereafter as possible
to consider a Zoning Ordinance Text Amendment allowing 0utdoor
Commercial Recreation as an Interim Use in the Agricultural and
General Industrial District.

ORDINANCE B - CITY OF ROSEMOUNT ZONING ORDINANCE
FOR COlYIl�IERCIAL OUTDOOR REC�tEATION USES
TO WHOM IT MAY CONCERN:
NOTICE IS I3EREBY GIVEN, the City Council of the City of Rosemount will hold a
public hearing to consider the items listed below on Tuesday, September 21, 1993 in the
Council Chambers of the City Ha.11, 2875 145th Street �Vest, beginning at 8:00 p.m. or as
soon thereafter as possible.
The purpose of this hearing is to consider a text amendment to Ordinance B - City of
Rosemount Zoning Ordinance that will result in allowing commercial autdoor recreational
uses by interim use permit in the Agriculture District (AG) or in the General Industrial
District (IG). This provision is being developed to regulate paintball facilities located in
eastern Rosemount. The text amendment has been petitioned by Splatball, Inc. and The
Adventure Zone.
Copies of the proposed amendment are available for review and comment at City Hall
located at 2$75 145th Street West, between the hours of 7:30 a.m. to 4:00 p.m., Monday
through Friclay,
Persons wishing to speak on these proposed amendments are invited to attend this public
hearing on TuesdaY, September 21, 1993 at 8:00 p.m. Written comments will also be
accepted prior to the meeting date. Please forward all comments and inquiries to the City
of Rosemount Planning Department.

ZONING ORDINANCE TEXT AMENDMENT FOR COh�VVIERCIAL OUTDOOR RECREATION
BACKGROUND
On August 10, 1993, the Planning Commission directed Planning Sta�ff to proceed with assembling
ordinance language and a recommendation regulating commercial outdoor recreation with an Interim
Use Permit (IUP). The Zoning Ordinance requires that the ItTP meet or exceed the performance
standards in the ordinance as well as other applicable City ordinances. �
DISCUSSION
The Planning Commission directed Planning Staff to draft an amendment with built-in modification
ability. After reexamining the performance standards, modification is cunently possible only
through variance procedures. The alternative is to amend the IITP Section (Section 14.10) to allow
the Planning Commission to make findings that could modify the standards.

The uses generate traffic and must be paved according to standards. This is consistent with all uses
in the City with the anly exceptions being single family and agricultural uses. Protection of public
. infrastructure includes rural section ditches, streets and controlling erosion and storm water quality
issues.
BUII,DINGS
The commercial uses are essentially public and regulated by the Uniform Building Code (UBC).
Any building will have to comply with standards spec�ecl by the t7BC and meet typical
handicapped and sanitary standards. Use of a trailer in conner.tion with a commercial use wouid
require permanent footinbs, sanitary facilities and handicapp�d accessibility.
The context of creating flexibility within the IUP process that does not exist elsewhere in the zoning
ordinance follows the Planning Commission direction for a non-permanent use. The findings will be
specific to the individual use and not setup a precedent in other situations. The following
subparagraphs would be intended to accomplish the desired flexibility enhancement.

Commercial Outdoor Recreation - A commercial recreational use available the general public that
depends upon a natural, relatively undevelopeci setting.

E. Findings for Interim Use Pennits
1) The extent, location and intensity of the use will be in substantial compliance with the
Comprehensive Guide Plan.
2) The use will provide adequate ingress and egress to minunize traffic congestion in the public
streets.
3) The use will not be detrimental to the existing character of the development in the immediate
neighborhood or endanger the public health, safety and general welfare.
4) The use will not impede the nannal and orderly development and improvement of the
sunounding property for uses permitteti in the district.
5) The use shall, in all other respects, conform to the applicable regulations of the district in
which it is located.
The Planning Commission, after public hearing, may modify standards or eonditions required
for the IUP, when strict application of such standards or conditions would unreasonably limit or
prevent otherwise lawful use of a property or an existing structure and would result in
exceptional undue hardship to the owner of such property or structure; provided, that such
modification will not impair the intent and purpose of such standards or conditions and is
consistent with reasonable enjoyment of adjacent property.
