The Carlson Properties of Rosemount have reque ted a mprehensive
guide plan amendment to redesignate Lots 4, 5, and 6, Block 3 - South
Rose Fark Addition Replat from its existing land use of urban
residential to commercial. The amendment also involves a request to
adjust the Wastewater Treatment Plant service district boundary to
reflect existing utility service connections available to the
northern half of the property and to amend the City' s transportation
system to include an east-west collector street between Chipendale
and State Trunk Highway 3 .
The Planning Commission reviewed the amendment at their regular
meeting on October 12 and recommended that a public hearing be set by
the City Council for the November 2 meeting. The Commission
recommended approval of the land use redesignation and sewer district
boundary adjustmen, but are recommending denial of the collector
street connection. Planning staff is awaiting a complete response
from NIlVDOT and will include a detailed review of this request in the
public hearing packet for November 2 meeting.

Zoning Application
Comprehensive Guide Plan Amendment Application
Ms . Freese:
Attached are our applications for Comprehensive Guide Plan
Amendment and rezoning applications on the Carrousel Plaza South
P.U.D. The property affected by this application is legally
described on Exhibit "A" , attached hereto.
We respectfully request that this application be expedited as we,
wish to secure a grading permit so we may grade this fall . To meet
this goal, we would like to have our application considered at the
September 28th Planning Commission meeting and forwarded on to the
City Council so that they could order a public hearinq on the
matter for their October 19th meeting.
Since it is neeessary for the city's consultant and others to
provide us with baseline information prior to providing you with
a complete P.U.D. package. It is possible that we might nnt have
all of our data in the staff's hands for review by September 17th.
It is our goal, however, to have a complete package in the staff's
hands by September 17th. If we do not, we would ask whether it
miqht be advisable to at least have a concept review session with
the Planning Commission on the 28th of September? .
Thank you in advance for your attention to our request and for your
cooperation.
Yours Very Truly,

TOTfL P.03
October 12, 1993

FR: Lisa J. Freese
RE: Carlson/GTI Theater Proposal
Carlson Properties of Rosemount is requesting an amendment to the
Comprehensive Plan for Lots, 4, 5, and 6, Block 3 South Rose Park
Addition Replat from its existing designation as urban
residential to commercial. The stated purpose for this land use
change is allow the development of a movie theater on the
northeast corner and potentially some other office and service
uses on the remainder of the property. The total site under
consideration is approxima.tely 18 acres.
As you are aware the proposed comprehensive plan is under
modification. It is anticipated that the Planning Commission and -
City Council will accept those changes on October 21 and set a
public hearing on the revisions for some time in early November.
Until this plan is approved by the Metropolitan Council, the City
is not allowed by law to place it into effect. The Planning
Commission should recall that the City Council did adopt the plan
in March it would be my interpretation that it does have more
standing that the old plan. The Metropolitan Council' s concern
focus primarily in the staging of urban service area and this
area is within the NNSA at this time.
The proposal as submitted will require consideration of
amendments to two other elements of the existing comprehensive
plan and/or the proposed comprehensive plan: 1) Sanitary Sewer
Element: the boundary between. the Empire WWTP and Rosemount WWTP
service needs to be adjusted southward to about the middle of the
three lots and 2) Transportation Element: a collector street is
proposed between Trunk Highway 3 and Chipendale Avenue. In
addition to the land use change, both of these requested
modifications rnust be reviewed and recommendation made by the
Planning Commission.
LAND USE DESIGNATION
The land use change requested is from urban residential to
Commercial . The proposed plan (not implemented) designates this
area as business park. The discussion held by the Planning
Commission regarding the implementation of zoning for the
business park suggests a tiered approached to zoning or permitted
uses in the various area of the land designated for business
park. It was the Planning staff interpretation from the Planning
Comrnission discussion that occurred at the special meeting last
Thursday that such a refinement would be consistent with the
intent of the Plan and the Business park. The area under
consideration for commercial uses is just to the south of the
existing commercial area and it seems logical to extend that area
down to these three lots in question.
Based on the conclusion of last Thursday' s discussion the
proposed business park designation could remain and the property
owner could achieve the intended purpose with the subject
property. The property owners, however, have indicated that they
do not wish to wait until Update 2000 is approved and the zoning
amendment in complete (estima.ted completion December, 1993) . If
the planning commission forwards this on to City Council to hold
a public hearing, the earliest that hearing could be held would
be on November 2, 1992 (election night) . If the amendment were
forwarded to the Metropolitan Council by November 5 they have 0
working days to review it. They can determine the amendment
sufficient or return it for additional information. If
sufficient, the amendment could be approved administratively or
it could be requixed to go through the Metropolitan Council for
review (60 days) .
It is Planning staff' s opinion that the time advantage is not
that significant, at most 15 to 20 calendar days. The applicant
can continue with a number of required steps including
preliminary plat, final plat, rezoning and site plan review
during this time period. The only approvals that cannot be
placed into effect until the comprehensive plan is approved would
be the rezoning and final plat. All required procedures can be
occurring during the comprehensive plan review process if the
developer wishes . Although staff has ma.de this fact known to the
applicant, they still wish to proceed with a separate
application.
TR.ANSPORTATION ELEMENT: add a collector street
The City is still waiting for MnDOT' s response. The
recommendation below is based on NIlTDOT' s phone response and memo
included in your packet as well as OSM' s traffic Impact Study for
Rosemount Village Sguare. Planning staff will provide an
briefing at the meeting.
SEWER ELEMENT: Adjust boundary of Rosemount WWTP to
approximately the location of the proposed street alignment to
accommodate the natural topography and in place utilities in
carousel .
Planning staff will provide a briefing at the meeting.
Recommended action: A motion to recommend approval of the land
use change from urban residential to commercial for the proposed
theater site on lots 4, 5, and 6, South Rose Park Addition
Replat.
A motion to recommend denial of the change in the transportation
element of the comprehensive plan because l) the collector street
will require the closure of Canada Avenue 2) the collector street
location cause safety concerns and 3) the collector street
access to Chipendale is inconsistent with the City' s street
spacing policies and subdivision ordinance.
A motion to recommend approval in the adjustment of the Rosemount
WWTP boundary to encompass approximately the north half of the
existing lots 4, 5, and 6 .
A motion to recommend that the City Council set a public hearing
regarding this comprehensive plan amendment for November 2, 1993
at 5 : 00 p.m.
