CONSENT Prepared By: Bud Osmundson Agendaj��■�1i� � City Engineer • � Attachments: Resolution; Construction Approv d y: Plan; Agreement. � This item is on the agenda due to a request by the Dakota County � Recorder' s office for City recognition of a transfer of City Right-of- Way (ROW) from Lot 1 to Lot 2 in the Broback Industrial Park. The Dakota County Highway Department needed a ditch area which was within City ROW at Diamond Path near 145th Street West as part of the Diamond Path Reconstruction Project (see attached construction plan) , The County staff and City staff agreed to moving the cul-de-sac on Lot l to Lat 2 as shown as long as there was no cost to' the City and that the property owners (Art Broback: Lot 1; Nancy Lynn Broback: Lot 2) agreed. Access to lot 1 is still provided by the cul-de-sae. Lot 1 is now larger and Lot 2 is slightly smaller. There is a signed agreement by the City and the property owners. Because of the legal mechanisms used by the County Highway Department for this transaction the County Recorder' s office must have official authorization from the City Council in the form of a resolution. This resolution vacates the northern cul-de-sac and combines it to Lot 1. It also splits off a portion of Lot 2 to provide a permanent roadway easement for the cul-de-sac. Since this involves a lot split/combination Planning staff has prepared the attached resolution for adoption. [a�liiH6 eiw 1 � � ('T, - ' - • "._-•_-._•• .. . ,`�"'� ,-�'__.�o^_='�_-_ ( � �- ���_...__l_, cz� og Rosn�sovrrT DAKOTA COUNTY, MINNESOTA , RESOLIITION 1993- A RESOLIITION APPROVING A RELOCATION OF AN EXISTING CITY ROAD EASEMENT IN BROBACR INDIISTRIAL PARR AND THE TRA,NSFER OF TITLE OF EASEMENTS WSEKEAS, the City of Rosemount currently possesses a right-of-way for roadway puxposes on Lot 1, Block 1, Broback Industrial Park as described in attached Exhibit A; and WHER.EAS, the City of Rosemount wishes to vacate this right-of-way on Lot 1, Block 1, Broback Industrial Park and acquire right-of-way from Lot 2, Block 1, Broback Industrial. Park, as described in Exhibit B, due to improvements on County Road 33; and WHEREAS, Lot 1, Block 1, Broback Industrial Park is under the ownership of Arthur C. and Delores C. Broback; and WHEREAS, Nancy Lynn Brobaak is the current owner of Lot 2, Block l, Broback Industrial Park; and WHEREAS, both Arthur C. and Delores C. Broback and Nancy Lynn Broback have agreed to accept the transfer of the City' s right-of- way interest in the property identified as Lot 1, Block 1, Broback Industrial Park to Lot 2 , Block 1, Broback Industrial Park. THEREFORE, BE IT RESOLVED, that the City and the property owners have entered into the attached Exchange Agreement to vacate subject right-of-way on Lot l, Block 1, Broback Industrial Park and to encumber said right-of-way onto Lot 2, Block 1, Broback Industrial Park for the purpose of service road easement. THEREFORE, BE IT FURTHER RESOLVED, said encumbrance on Lot 2, Block 1, Broback Industrial Park shall be recorded as described in Exhibit B and as shown on the attached location map. EXCHANGE AGREEMENT This Agreement made and entered into this � �^�� day of ' .�'�� �aC' , � 1992, by and between Dakota County, . a rfunicipal Corporation, ' (hereinafter called the "County") , the City of Rosemount, a Municipal Corporation, (hereinafter called the "City") , Arthur C. Broback and Delores C. Broback, husband and wife, (hereinafter called ' "Broback's") and Nancy Lynn Broback, an unmarried woman, (hereinafter called "Nancy Lynn Broback") . AITNESSETH: WfiEREAS, the City is the owner of an interest in certain real � property situated in Dakota County, Minnesota, more particuiarly described hereinafter and, ' WHEREAB, Nancy Lynn Broback is the owner of an interest in, certain real property situated in Dakota County, Minnesota, more particularly described hereinafter. NOW, THEREFORE, in consideration of the promises, covenants and agreements hereinafter contained it is agreed by and between the parties as follows: 1. City hereby agrees to transfer to Broback's by quit claim deed, its interests in the real property described on attached ; exhibit A situated in Dakota County, Minnesota. Nancy Lynn Broback hereby agrees to transfer to City, by warranty deed, her interests in the real property described on attached exhibit B situated in Dakota County, Minnesota. 3 . Because of redesigning of the service road and cul-de-sac pursuant to mutual agreement, Nancy Lynn Broback agrees to transfer all of her interests in the property described on exhibit B to the City without compensation. Nancy Lynn Broback waives any right to compensation, now and forever, arising from said transfer of interests. 4 . Broback's agree to accept the transfer of the City's interest in the property described on exhibit A with zero dollar payment from the City or any other party. Gity waives any right to compensation, now and forever, arising from said transfer of interest. � � 5. In consideration of above land transfers, the County and �ity agree to construct a gravel cul-de-sac, for the service road, with a diameter meeting City standards on the land transferred in Lot 2 , Block 1 of Broback Industrial Park to replace the existing gravel cul-de-sac at the location on the attached exhibit A referenced in paragraph l above and to reconstru�t, if required by the City, . affected public utilities and to obliterate the unneeded existing portion of service road and cul-de-sac. The project is feasible � from an en ineerin stand oint. This project has been designated as City Project No.235, � . 2.2 Scope - This project provides for the reconstruction of 145th Street from � Shannon Parkway to Cameo Avenue and for Chile Avenue from 145th Street to the Independent School District No. 196 south boundary. The � project also includes the realignment of the Ghippendale/Chile Avenues `� at the 145th Street intersection. � . The sanitary sewer system on 145th Street West was televised to review � the line condition in Februa , 1990. The television inspection revealed rY � that the pipe has failed in some areas and is in poor condition in other areas along the project route. All of the proposed � improvements will take place within the e�sting road right-of-way for 145th Street and Chile Avenue except for the proposed realignment of the � hi i n with 145th Street. The C ppendale and Chile Avenues at the intersect o � entire project is located within Sections 29 and 30. The project location is shown on Drawing No. 1 in the appendix of this report. � � 3.2 Project Zoning - Generaliy the project area is zoned single family and � multiple family residential. However, the sauth side of 145th Street between Chippendale and Cimanon Avenues is zoned convenience � commercial. � 3.3 Project History - Prior to October, 1975, 145th Street was known as Ash � Street. The len th of roadwa between State Hi hwa 3 (previously State g Y g Y � Trunk Highway No.218) and the Dodd Boulevard intersection was Dakota County Highway No. 42. (Dodd Boulevard also was a part of County � Road 42 . This ortion was reconstructed b the Coun in 1956 and had ) P Y tY � a 1-1/2" bituminous overlay installed in 1968. :� � OSM Project No. 4438.60 Page 4 � � The length of roadway between the Dodd Boulevard intersection and the � west ed e of Rosemount was desi ated as County Road No. 33. This g � � length of raadway was built to a rural section in 1962 and the length of roadway west of Shannon Parkway was built to an urban section in 1992 � as art of Ci Pro'ect No. 206. P tY J � These roadways were revoked as County State Aid Highways as of �` October 21 1975. The then became the res onsibili of the Ci of � Y P tY tY � Rosemount. Numerous bituminous patches have been installed as ' required since 1975. � � A Feasibility Report which recommended a new alignment for the Chippendale/Chile Avenues and 145th Street intersection (City Project � No. 179) was presented to the City Council in April, 1988. There is an existing bituminous trail located on the west side of Chile Avenue. � � 3.5 ZYaffic Analysis - A traffic analysis was conducted in the 145th Street project area and a letter report was submitted to the City Engineer on � A ril 16 1992 and was reviewed at the Ci Council Meetin on A ril 21, P , tY � P � 1992. The purpose af the analysis was to determine the road section required for the 145th Street reconstruction as part of Gity Project No. � m h letter are included 206. A copy of the average daily traffic map fro t e � in the Appendix of this report (Drawing No. 3). � The results of the capaeity analysis indicate that the existing two lane � faciiity operates at satisfactory levels of service. In the future the amount � of traffic on 145th Street is expected to increase. However, when Conemara Trail is connected to State Trunk Highway 3 it will reduce the � traf�c demand on 145th Street. It was determined, for City Project No. � 206, that a 40' wide urban roadway section (2 driving lanes) would be constructed on 145th Street from Diamond Path to Shannon Parkway with � arkin allowed on one side of the street. The t ) P g � proposed street section will consist of appro�mately 4 1/2" of bituminous surface and 8" of Class 5 gravel and will be flanked on both sides with � B618 concrete curb and tter. The ro osed roadwa will be lowered 8� P P Y � approximately 2 to 3 feet from Shannon Parkway to the Chippendale/Chile Avenue intersection to facilitate drainage in the area. � From the Chippendale/Chile Avenue intersection to Cameo Avenue the � proposed roadway will be reconstructed appro�cimately to its eacisting location and elevation. � � As shown on Drawing Nos. 4 through 7 in the Appendix of this report turn � lanes will be constructed at Shannon Parkway, Cameo Avenue and at the Chippendale/Chile Avenue intersection. The right turn iane on east � bound 145th Street was extended to include the Super America and Tom � Thumb entrances. � DOT State Aid standards. The proposed roadway section meets Mn/ 1 � � OSM Project No. 4438.60 Page 10 � � The Chippendale/Chile Avenues realignment is praposed to be � constructed as desi ned in the Feasibili Re ort for Ci Pro'ect No. 179 g tY P tY 3 � � completed by Short, Elliot, Hendrickson, Inc., which was accepted by the City Council in April of 1988. As this report explains, the realignment of � this intersection as ro osed will considerabl im rove traffic flow throu h P P Y P g � this area. The cost estimate includes provisions for future signalization of this intersection. The proposed intersection is shown on Drawing No. 8 � in the Appendix of this report. � � A.s part of the intersection realignment it is recommended that the Dodd Boulevard connection onto Chippendale Avenue be terminated by creating � a cul-de-sac adjacent to the Super America driveway entrance. � Eliminating the Dodd Boulevard connection onto Chippendale Avenue will significantly reduce the traffic congestion at the intersection and will , greatly im rove traffic and edestrian safe in the area. Drawing No. 8 P P tY ' in the Appendix of this report shows the proposed Dodd Boulevard cul-de- sac. A second altemative that was reviewed was to allow Dodd Boulevard � to connect to Chi endale Avenue at a roximatel 100' south of it's PP PP Y � existing location. This alternative will require the purchase of addition right-of-way from the parcel located south of Dodd Boulevard at � Chi endale Avenue. ' ' 4.7 Overhead Utilities - As part of the 145th Street Improvement project it is ' proposed to relocate the existing overhead lines. Several alternatives for relocating the existing overhead lines along 145th Street were reviewed � and are listed as follows: � 4.7.1 Electric Utility: � Alternative No. 1 - Bu the existin overhead lines in- lace frorn rY g P ' Chippendale Avenue to Cameo Avenue. This aiternative would require , , OSM Project No. 4438.60 Page 15 ' ' the purchase of a 10' wide utility easement on the north and south side of ' 145th Street to allow for the installation of 2 or 3 lar e el�ctricai "switch g � boxes° (approximate dimensions 8'x 8'). This Altemative would also require that each house service along the project route be revised. The � cost for revisin each house service is estimated at $600.00. This cost g � estimate assumes that the electric service for each house meets current codes and only a minimal amount af work is required. ' ' A separate contractor would need to be hired by each of the property owners to revise their connection from the new buried electric service to , the house including revising the metered connection. A Vista Telephone representative stated that the existing overhead � tele hone lines located on the north side of 145th Street west of P , Chippendale Avenue are on a high priority list to be buried. ' 4.7.3 Cable T.V.: The existin Cable TV line on 145th Street between g ' Chippendale Avenue and Cameo Avenue is located a�erhead on ' ' OSM Project No. 4438.60 Fage 1$ ' , the electric utility poles. If it is deternvned that the e�sting , electric lines are to be buried or relocated, then the Cabie TV lines ' will do the same.The estimated cost for burying the e�cisting Cable TV lines in-place is $15,000. If it is required that the existing poles ' be relocated due to the roadwa construction, then the Cable TV Y ' lines will be relocated with the poles at no cost to the City. , 4.8 Right-of-way and Easements - Most of the work under this project will be ' completed within the existing right-of-way along 145th Street and Chile Avenue.
