The Carl.son Properties of Rosemount have requested a Comprehensive
Guide Plan Amendment for Lots 4, 5, and 6, Blocl� 3 , South Rose Park
Addition Replat. That would be the first step in the process to
enable the construction of a movie theater.
The proposal would require the following three changes to the
Comprehensive Guide Plan:
1) c�ianges the Land Use Designation to Commercial;
2) adjusts the boundary line for the sewer service area so that
the project can be served by the Rosemount Waste Water
Treatment Plant (WWTP) ; and
3) amends the Transportation Element of the Guide Plan by adding
a col3ector street connecting TH3 with Chippendale Avenue.
The Planning Commission reviewed this request on October. 12, 1993
and recommended approval of the land use designation change to
Commercial and the adjustment of the sewer service boundary line.
The Planning Commission recommended denial of the transportation
amendment for the collector street connecting TH3 and Chippendale
Avenue.

WHBREAS, Guetschoff Theaters, Inc. has entered into a purchase
agreement with Carlson Properties, Inc. , to purchase 7. 7 acres of
land to be subdivided from lots 4, 5 and 6 Block 3 in South Rose
Park Addition Replat legally described in Exhibit A; and
D�HEREAS, Guetschoff Theaters, Inc. desires to construct a movie
theater on the property to be purchased; and
WSEREAS, the proposed movie theater is a permitted use in the
General Commercial Zoning District; and
�SEREAS, the Comprehensive Guide Plan currently in force
designates this site to be High Density Residential; and -
�HTREAS, Guetschoff Theaters Inc. and Carlson Properties, Inc.
has requested that the property be redesignated to Commercial as
shown on attached Exhibit B; and
(+�HERrAS, the Planning Commission of the City of Rosemount
considered the proposed redesignation of the site fram High
Density Residential to Commercial on October 12, 1993 and
recommended approval of the amendment to the City Council; and
[+9HEREAS, the City Council scheduled a public hearing, according
to law, to consider the plan amendment and the hearing was held
on November 2, 1993 ; and
WHEREAS, the City Council heard testimony at that hearing
concerning the change of land use designation to Commercial;
NOW, THEREFORE BE IT RESOLVED, the City Council of the City of
Rosemount considers Commercial to be the most appropriate land
use designation for ten acres of land including the 7.7 acres of
land intended for the proposed movie theater because of the
existing developmen� �nd overall eommunity plans; and
BE IT FIIRTBER RESOLVED, that the City Council authorizes this
land use change from High Density Residential to Commercial to be
included in Update 2000 as revised; and '�.

BE IT FINALLY RTSOLVED, that upon approval of this amendment, the
City Council authorizes staff to forward the amendment to the
Metropolitan Council for approval independent of the major
amendment and the Council recognizes that no further action
regarding the property will be possible until the Metrapolitan
Council approves this amendment.

The Carlson Properties of Rosemount have requested a comprehensive guide plan amendment to
redesignate Lots 4, 5, and 6, Block 3 - South Rose Park Addition Replat from its existing
designation as urban residential to commercial. The proposed comp plan designates this area as
Business Park. In reviewing the proposed plan for the ttieater and associated development two other
changes to the City's comprehensive plan will be required. The proposed roadway connecting
Chippendale to Trunk Highway 3 is considered a collector roadway and will require an amendment
to the Transportation Element of the comprehensive plan. The existing Sewer Plan services this
area through the Empire Waste Water Treatment Plant. In reviewing the site plan and plat proposed
for the area it is apparent that the northerly portion of these lots is most appropriately served
through the Rosemount Waste Water Treatment Plant. Therefore, the City will be required to
submit an amendment to the Metropolitan Council and MWCC for this service area change.
Because of the workshop held last Thursday and the delinquency of MnDOT to provide the City
with comments regarding the madway, staff is unable to provide a complete analysis in your
packets. Prior ta the meeting, staff will be providing with a comprehensive analysis of this
comprehensive plan amendment request.
Recommended Action: Recommendation will be provided with memo to be delivered.

Carlson Properties af Rosemount is requesting an amendment to the
Comprehensive Plan for Lots, 4, 5, and 6, Bloek 3 South Rose Park
Addition Replat from its existing designation as urban
residential to commercial. The stated purpose for this land used
change is allow the development of a movie Theater on the
northeast corner and potentially some other office and service
uses on the remainder of the property. The total site under
consideration is approximately 18 acres.
As you are aware the proposed comprehensive plan is under
modification and it is anticipated that the Planning Commission
and City Council will accept those changes on October 21 and set
a public hearing on the revisions for some time in early
November. Until this plan is approved by the Metropolitan
Council the City is not allowed by law to place it into effect.
The Planning Commission should recall that the City Council did
adopt the plan in March i� wauld be my interpretation that it
does have more standing that the old plan. The Metropolitan
Council' s concern focus primarily in the staging of urba.n service
area and this area is within the NNSA at this time.
The proposal as submitted will require consideration of
amendments to two other elements of the existing comprehensive
plan and/or the proposed eomprehensive plan: 1) Sanitary Sewer
Element: the boundary between the Empire WW'I'P and Rosemount WWTP
service needs to be adjusted southward to about the middle ;of the
three lots and 2) Transportation Element: a collector street is
proposed between Trunk Highway 3 and Chipendale Avenue. In
addition to the land use change, both of these requested
modifications must be reviewed and recommendation made by the
Planning Commission.

LAND USE DESIGNATION 4t�
The land use change requested is from urban residential to
Commercial. The proposed plan (not implemented} designates this
area as business park. The discussion held by the Planning
Commission regarding the implementation of zoning for the
business park suggests a tiered approached to zoning or permitted
used in the various area of the land designated for business
park. It was the Planning staff interpretation for the Planning
Commission discussion that occurred at the special meeting last
Thursday that such a refinement would be consistent with the
intent of the Plan and the Business park. The area under
consideration for commercial uses is just to the south of the
existing commercial area and it seems logical to extend that area
down to these three lots in question.
Based on the conclusion of last Thursday' s discussion the
proposed business park designation could remain and the property
owner could achieve the intended purpose with the subject
property. The property owners, however, have indicated that they
do not wish to wait until Update 2000 is approved and the zoning
amendment in complete (estimated completion December, 1993) . If
the planning commission forwards this on to City Council to hold
a public hearing, the earliest that amendmenit could be held would
be on November 2, 1992 (election night) . If the amendment were
forwarded to the Metropolitan Council by November 5 they have 10
working days to review it. They can determine the amendment
sufficient or return it for additional information. If
sufficient; the amendment could be approved administratively or
it could be required to go through the Metropolitan Council for
review (60 days) .
It is Planning staff's opinion that the time advantage is not
that significant, at most 15 to 20 calendar days. The applicant
can continue with a number of required steps inciuding
preliminary plat, final plat, xezoning and site plan during this
time period. The only approvals that cannot be placed into
effect until the comprehensive plan is approved would be the
rezoning and final plat. All required procedure can be occurring
during the comprehensive plan review process if the developer
wishes. Although staff has made this fac� know to the applicant
they sti11 wish to proceed with a separate application.
TRANSPORTATION ELEMENT: add a collector street
The City is still waiting for MnDOT' s response. The
recommendation below is based on N�TDOT' s phone response and memo
included in yaur packet as well as OSM' s traffic Impact Study for
Rosemount Village Square. Planning staff will provide an
briefing at the meeting.
SEWER ELEMENT: Adjust boundary of Rosemount WWTP to
approximately the location of the propased street alignment to
aecommodate the natural topography and in piace utilities in
carousel.

Recommended action: A motion to recommend approval of the land
use change from urban residential to commercial for lots 4, 5,
and 6, South Rose Park Addition Replat
A motion to recommend denial of the change in the transportatian
element of the comprehensive plan because 1} the collector street
will require the closure of Ganada Avenue 2) the collector street
location cause safety concerns and 3) the collector street
access to Chipendale is inconsistent with the City' s street
spacing policies and subdivision ordinance.
A motion to recommend approval in the adjustment of the Rosemount
WWTP boundary to encompass approximately the north half of the
existing lots 4, 5, and 6.
A motion to recommend that the City Council set a public hearing
regarding this comprehensive plan amendment for November 2, 1993
at 8:00 p.m.

hearing on Tuesday, November 2, 1993 in the Council Chambers of the City 'riall, 2875
145th Street West, beginning at 8:00 p.m. or as soon thereafter as possible.
The purpose of this hearing is to receive public input and comments on a proposed
amendment to the City of Rosemount Minor Comprehensive Guide Plan Amendment. The
minor amendment pertains to an 18 acre tract of property located on the southeast corner of
Chippendale a.nd Carousel Way legally described as Lots 4, 5, and 6, Block 3, South Rose
Park Addition Replat.
The purpose of this heari.ng is to consider a minor amendment request to the City's 1980
Comprehensive Guide Plan (as amended) to change the following:
1) Redesignate the land use of approximately ten (10) acres of land in on the north
side of Lots 4, 5, and 6 from Urban Residential (HI2) to Cammercial (COM).
(I3pdate 2000 designates all of Lots 4, 5, and 6, Block 3 as Business Park (BP).
2) Adjust the sewer district boundary of the Rosemount and Empire Wastewater
Treatment Plant so that the northern portion of I.ots 4, 5, and 6 are served by the
Rosemount Treatment Plant instead of the Empire Treatment Plant in accordance
with existing utilities.
3) Add an east-west collector street to the City's transportation plan element
between Chippendale Avenue and State Trunk Highway 3.
Persons wishing to comment on this amendment are encouraged to submit written
comments to the City of Rosemount Planning Department, 2875 145th Street West,
Rosemount, MN 55068 or to testify at this meeting on TuesdaY, November 2, 1993 at
