Due to an error in transmitting the notice to the paper, it was not published 10 days prior to the hearing as required by s�ate statute. After conferring with the City Attorney, it was determined that the oniy option in compliance with the requirements of the state statute , is to reset the public hearing. Therefore, Planning staff is asking ' the City Council to reset the public hearing for the May 18 City Council meeting so that notice requirements can be complied with. The applicant has been notified of this problem. Reco�ended Actioa: A MOTION to reset a public hearing for the RCD Real Estate Partnership rezoning petition on May 18, 1993 at 5 : 00 p.m. or as soon thereafter as possible.
