Staff has reviewed the need for the storm water holdin pond project
known as Valley Oak Pond Outlet, Project #197. As you may recall, the
project was originally scheduled to be constructed in 1990 but has
been delayed because of difficulties obtaining easements for Pond
Number 4.
Upon completion of the review, Staff and our Consulting Engineers have
concluded that the project should proceed now as a phased project.
Phase I including everything except Pond Number 4. This would allow
for acquisition agreements for Pond Number 4 to be reached. Phase II
would be Pond Number 4.
Proceeding with Phase I now allows the City to preserve the commitment
for monetary contribution from Ducks Unlimited. It provides for
additional run-off storage which is critically needed and eiiminates a
high maintenance eye sore from developed rear yards. We are asking
for your support to proceed with this project.

This item is on the agenda to update the Gouncil on the VaHey Oak Pond Outlet Project.
Dave Simons, P.E., the project manager #or Short, Elliott, Hendrickson (SEH} has provided you
with the attached memorandum which explains the technical aspects of the project, Dave and
Staff will be at the meeting to present the proposed improvements and answer any questions
Council may have.
Tfiis project as originally planned would have provided the ultimate outlet for drainage in Section
31 and specifically the Winds Crossing area. As you may be aware, the original design of the
existing pond in Winds Crossing was to be a "dry" pond which is rather aesthetically
unappealing. The project was to be assessed over a large area but was later changed to be
funded totally from the storm water utility. The proposed project had the existing pond in
Winds Crossing draining through two ponds south of it on the Gergen property, north of 160th
Street, into a fourth pond in Empire Township within the Empire Aggregate property south of
160th Street. Negotiations for storm water ponding easements were undertaken with the
Gergens and Empire Aggregate. The Gergen property has been acquired, however the Empire
Aggregate property negotiations did not come to any conclusion. The Empire Aggregate
Company has mineral rights and wanted a large sum of money for those rights that they would
lose due to ponding water. Negotiations were then undertaken with an adjacent property
owner to the east for the purposes of a final outlet pond. However, these negotiations have
also not come to fruition due to estate and trust issues. We will continue to pursue the
easement for the fourth pond which is needed for the ultimate development of Section 31.
However, we feel it is imperative to move #orward on this project for an number of reasons.
First and foremost is that we can greatly increase the amount of storage of storm water for the
existing pond. As you may be aware, we have pumped this pond numerous times in the past
few years. This is a costly maneuver. Secondly, the residents surrounding the pond have
expected the project to be undertaken in the last couple of years and Ducks Unlimited has set
aside (through Koch Refinery), 530,000 for making these ponds wildlife areas. The suggested
schedule for the project would be as follows:
May 4, 1993 Council Update
May 10, 1993 Utility Commission Update
May 12, 1993 Meeting with Affected Residents
May 18, 1993 Accep� Plans & Spec's/Order Ad for Bid
June 11, 1993 Bid Letting
June 15, 1993 Award Contract
June 28, 1993 Start Construction
September 1, 1993 Substantial Completion
Staff recommends that we move forward on this project following the above schedule. We will
bring this item back to Council for pian and specification approval on May 18.

above referenced prc�ject.Phase I of the praject will in�iude all work north of I64th Street,
and Phase II will include the remaining work located south af 16C}th street- The purpose
of this memorandum is to provide you with infaxmation on �.ie added level of storm
water protection which can be expected with construction of Phase L

The project Iocation is shown in Exhibit A. Phase i of the praject includes construction of
Ponds 2 and 3, and the interconnecting piping. Some grading work will also be done in
Pond 1 under this phase of the praject.
Pond 4 and the connectivn beiween P4nds 3 and 4 will be canstzu�ed under Phase II.
Phase II will be �onstructed as soon as easement negotiations for Pond 4 are camplete.
Currently, only Pond 1 is in place. The �onnection between Pond 1 and Pond 2 is also in
place, but is bulkheaded at both ends. Therefore, Pond 1 curren�lY functians as a
landlocked basin with no autlet. There is a larg;e watershed contributing storm wat�r to
this small landlociced basin. 7his has resulted in the oecasional n�ed to pump the pond
down to protect the hames which fixlly suz�round the pond_

Using the existing low floor elevation adjacent eo the pond, and the 5 foot fre�board
requirennent f4r landlocked basins,the existing availabl�storage in Fond 1 is estimated to

be about 5.6 acre-feet. A�ter construc#ion of Ponds 2 and 3 in Phase i, the total available
storage will incr2ase to about 29.9 acre-feet. This will not satisfy #1ie ultimate storage
requirement of I21 acre-feet,but it wiXX increase tlse ava:7able sfr�rage by over404 percerat•
The ultimate storage requirement of I2'� aae-feet will be obtauted when Phase II of the
project is coxztiplEted. Construction of Phase I will greatly redu�e the frequ�ncy of
pumping in nand Z.
