RECOMMENDED ACTION: Motion to deny Mr. Franz's requests for the Port
Authority "to act as liaison with the City Planning Department to
upgrade current zoning to C-4" and "...involvement in acquiring one of
the buildings from across Highway 3 for use as a maintenance facility."

Please include the following as an agenda item at the next Port Authority meeting on Tuesday, April 6:
South Metro Auto Brokers would like the Port Authority to act as a liaison with the
City planning department to upgrade current zoning to C4.
South Metro Auto Brokers would like the Port Authority s involvement in acquiring
one of the buildings from across Hwy 3 for use as a maintenance facility for our site.
We will be bringing in a site plan and documentation for the committee's review. Thank you for your

RE: Development Request from Todd Franz
It is my understanding that Mr. Franz wants to intensify his land use (and auto sales and
residential rental) at 13942 South Robert Trail. Presently Franz is classified as a legal non-
conforming land use. In this regard, he wants the Port Authority to do two things:
1. Aid him in rezoning his property to C-4, "General Commercial District." In this
district he would be a permitted use and could intensify his land use.
2. Sell him one of the buildings from the armory property to allow for auto repair at the
site.
As you can see, Mr. Franz's correspondence indicates he will be bringing more material to the
April 6 meeting.
I have visited with Mr. Franz about his requests and suggested some alternatives to him for his
property all of which, I believe, would be financially rewarding. He has also been reminded that
within the last month he appeared before the City Council and asked for a comprehensive plan
amendment that would have initiated a land use change to a more intensive use of the property.
That request was not honored by the council.
I also advised Franz that the Port Authority had approved demolition specifications at its last
meeting and that salvage rights were given to the demolition contractor. Franz was advised to
contact the approved contractor and inquire about purchasing any building from that firm. Still
Mr. Franz persisted in his request to be on the Port Authority agenda.
I am recommending to you denial of the request to become involved in the rezoning of the
property. There are two reasons for this:
1. This is not a Port Authority initiated or supported project.
2. The rezoning would be contrary to the comprehensive plan.
I am also recommending to you denial of the request to sell one of the armory property buildings
to Mr. Franz. There are two reasons for this:
i . The demolition specifications specifically give the contractor all salvage rights. The
documents have been submitted to contractors and sufficient time does not exist to
approve and distribute an addendum.
2. To sell Franz a building would imply support for an expanded South Metro Auto
Brokers where in fact Franz has not had the land rezoned and does not have a City
approved site plan.
I have advised Mr. Franz these would be my recommendations.
