Minutes of March 2, 1993 Closed Executive SessionROSEMOUNT PORT AUTHORITY PROCEEDINGS D ����CLOSED EXECUTIVE SESSION MARCH 2, 1993 Pursuant to due call and notice thereof a closed executive session of the Rosemount Port Authority was duly held on Tuesday, March 2, 1993 at 5:36 p.m. in the Council Lounge of City Hall, 2875 - 145th Street West. Chairperson Dunn called the session to order with Commissioners Anderson, Carroll, Edwards, McMenomy, and Sinnwell present. Also present were Attorney David Allgeyer, Lindquist and Vennum, Executive Director Jilk, and Economic Development Coordinator Miller. The purpose of the meeting was to discuss the report from West Suburban Mediation Service in regard to A and G Autobody's mediation session held on Friday, February 26, 1993. Because litigation had been threatened and the members were seeking legal advice, the session was closed. Discussion ensued regarding the report's two recommendations which were; 1) pay no more than the $20,000 maximum relocation payment, or 2) pay $17,388 more than the previously approved $20,000 based on the written note from Lee Smith, a Dakota County HRA employee, under contract to the Port Authority. In regard to the written note from Lee Smith, Attorney Allgeyer explained that he did not feel that it was an enforceable contract because the Halberts had not accepted it, and in fact, requested more than the $37,388. Allgeyer further explained that the Port Authority had the authority to pay additional benefits if they chose, but he advised that they would be breaking their own policy of approving a maximum payment of $20,000. Allgeyer recommended paying only the maximum relocation payment of $20,000. The closed executive session adjourned at 5:55 p.m. Respectfully submitted, Deborah Widstrom Recording Secretary
