M E M O R A N D U M T0: Ed Dunn, Chair and Members of the Rosemount Port Authority FROM: Mike Miles ��� DATE: October 29 , 1993 RE: Update on Mu11er Theatre Project At your meeting of October 19 , 1993, you directed me to work with the Mullers ' attorney, Dan Tyson, in the development of a draft Purchase Agreement between the RPA and the Mullers for acquisition of the tract of land for their praposed theater complex. Accordinqly, I have had numerous discussions with Mr, Tyson culminating in a lengthy meeting with him on Thursday, October 28, 1993 . At the conclusion of that meeting, Mr. Tyson spent a considerable time conferring with his client by telephone, and I believe you will be very interested in the outeome of that conversation. Essentially, Mr. Tyson reported the following to me: 1 . The Mullers have decided to praceed with construction of the theater complex in the Business Park {assuming they receive City authorization to do so) , regardless of whether another movie complex is constructed in Rosemount. 2 . Having reached that conclusion, the Mullers do not believe that the "fast track" approach that they have been advocating is necessary. Therefore, the Mullers are willing and desirous of proceeding with the negotiation process in a more traditional manner. In other words, the Mullers are prepared to wait until all necessary approvals (i .e. , rezoning, text amendments, etc . } have been obtained prior to entering into a Purchase Agreement with the RPA. 3 . The Mullers will be in attendance at the RPA' s meeting on W�dnesday, November 3, 1993, to express their desire to proceed in this more conventional fashion and to attempt to do some "team building" with the RPA, so that the proposed pro}ect may proceed as positively as possible. This is a very encouraging development, and one that should make some members of the RPA more comfortable with the process. I will plan on giving you a more detailed update on this matter at next week' s meeting, but please contaet me at any time if you wish to further discuss this projeet. JMM:gmo
