PRQPOSAL
Mr. Trey Wasser has petitioned far a variance to the Shoreland Overlay Regulations to
construct a 962 sq. ft. addition to his house that will encroach further into a buildinb setback
standard for a body of water designated by the Departmem of Natural Resources (DNR) as
"Natural Environment Waters.°
DISCUSSION
Mr. Wasser's house is surrounded on three sides by a series of water bodies that are
connected in high water situations and together are considered to be classified Natural
Environment Waters by the DNR. The property is in the Rural Residential D�strict and is
unsewered. The overlay district standards call far a building setbaek from "4rdinary High
Water Elevation" (OFiWE) to be 200 feet. Mr. Wasser's hause is setback approximately 60
feet to the north, 14fl feet ta the east, and 160 feet to the sc�utheast from the OHWE. As
such, the house and most of the prQperty is non-conforming with the standards.
The addition propased for the house would extend the current northwest corner of the house
further into the setback area (currently nonconforrning by 120 feet) approximately another 3fl
feet. The resulting encraachment would be 16Q feet into a 200 faot setback standard. The
house would be approximately forty feet fram the OHWE.
The Purpose and Intent of the Sh�reland Overlay Regulations section is "to unpose restrictions
in additian to those required by the underlying zoning for the protection of shoreland areas,
the preservation and enhan�ement of the quality of surface waters and the wise utilization of
water and related land resourees."
Mr. Fat Lynch of the DNR has indicated that the change in elevatian of approxunately eight
feet from the proposed addition site to the OHWE mitigates much of the negative effects of the
setback eneroachment. However, increasing the amount of runoff from the added roof area
coupled with the reduced amount of surface area next to the banks above the water could

result in increased erosion of the bank, as well as erosian resultirrg from construction forty feet
from the water edge / OHWE. Furthermore, existing vegetation in the bank area rnay be
disturbed during the construction pracess that may be difficult to reestablish on a shady and
relatively steep slape within thirty feet of the �HWE,
REQUIRED FINDINGS
The Planning Commission acting as the Board of Appeals and Adjustments must make the
following findings in order to grant a variance:
1) Granting a variartce will not atiuersely affect the publi� healrh, welfare and safery will not
be detrimental or injurio�cs to properry or improvements in the neighborhood.
2) Strict interpretation or enforcement would result in a pracrical dif�`'iculry or unnecessary
luzrdship inconsistent with the intent of this ordinarcce and the Comprehensive Guide Plan.
3) Tfzere are exceprional or extraordinary circumstances or candirions applicable to tlae
property, use or faciliries that do not apply generally to other properties in the saane
district.
4) Strict or literal interpretarion would deprive the applicc�rct af the use and enjoynient af his
properry in a nuznner similar to atlier owners in the same district.

zoning district in quesrion. �
CONCLUSION
The Shareland Overlay Regulatians have rendered all of the buildings on Mr. Wasser's property
to be non-conforming to the setbacks established by the DNR for buildings to the Ordinary High
Water Elevatian (OHWE). The property is an established rural residential use and as such, the
fourth finding regarding deprivation of the use does not apply. The property seems to offer an
appealing setting biven the various water bodies that define three of it's edges.
Planning Staff recognizes that a property owner shouid haue some ability to improve his
property in a manner that is sympathetie ta the limitations of the landscape as well as protective
of the vulnerable qualities that are regulated by the established Ordinance standards.
The property has exceptional or extraordinary circumstances because it is surrounded on three
sides by water bodies that are protected by the Shoreland Regulations cansistent with the second
required fmding. The north wall is generally parallel to the closest shoreline 60 feet away.
The Planning CQmmission may eonsider granting a variance that wauld allow an additi4n that
extends the northern line af the building further west towards Chinchilla Court that would not
impact the 6p foot area separating the water from the building as much as the petitioned
variance would. '
RECOMMENDED ACTTON
Motion to grant a variance to Section 9.1 Shoreland Overlay Regulations for the property
located at 12290 Chinchilla Court giving the property owner the ability to construct an addition
to the west side of his house within the required setback area but nat to encroach any closer to a
regulated water body Ordinary High Water Elevation than the cunent non-conforming setbacks
of the north, east and south sides of the existing principle strueture.

NOTTCE IS HEx�sY G1vEN, the Planning Commission of the City of Rosemount will
hold a Fublic Hearing to consider the item listed below on Tuesday, May 25, 1993, in the
Council Chambers of the City Hall, 2875 145th Street West, beginning at 5:30 p.m., or as
soon thereafter as possible. The Publie Hearing listed below pertains to property located at
12290 Chinchilla Court, legally described as follows:
That part of the South Half of the Northwest Quarter (S'fz of NV✓lk) of Section l�, Township
115, Range 19, described as follows: Commencing at the Norrhwest corner of said South
Half of the Northwest Quarter (S'i4 of NW',�; thence North 87 de;rees 29 minutes 10 seconds
East (assumed beazing) along the North line thereof a distance of 835 feet; thence South 02
degrees 30 minutes 50 seconds East a distance of 40 feet to the point of beginning; thence
South 87 degrees 29 minutes 10 seconds V✓est a distance of 3$2.9 feet; thence South 16
de�rees 28 minutes 40 seconds West a distance of 212.38 feet to its intersection with a 60 �
foot radius cu1-de-sac whose center of radius bears Sauth 30 degrees 57 minutes 20 seconds
West; thence atong the circumfersnce of said cul-de-sac, concave to the Southwest central
