To maintain an acceptable level of service in the building department and be able to sustain the interest to build in Rosemount`I would request authorization to renew the contract for inspection help. Attached for your review is a copy of Mr. Fricke's contract for an additional term of 6 months. I will be happy to discuss any questions you may have. RECOMMENDED ACTION: Motion to renew the Building Inspector Contract. COUNCIL ACTION: Agreement for Independent Contractor Services Between Michael Fricke and City of Rosemount, Minnesota This agreement for Independent Contract Services is between the City of Rosemount (hereinafter "the City") and Michael Fricke (hereinafter "the Contractor") to perform duties relating to building inspection. Building inspection, plumbing and HVAC inspections as well as plan reviews and all other projects as directed by the City. The City and the Contractor understand and agree as follows: 1. The Contractor will be paid per project at an hourly rate of $14.00. In addition, the Contractor will be responsible for all expenses, including, but not limited to, transportation, insurance, Workers' Compensation, errors and omissions, Social Security and tax obligations. 2. The Contractor is expected to complete, submit or file any pertinent forms required by the City or City ordinance, state or federal law to the appropriate authorities. 3. The Contractor will report to the Building Official on a regular basis regarding inspections, plan review and project assignment and status. Such reports will be for purposes of establishing entitlement to payment. 4. The Contractor is expected to comply with any and all applicable instructions or requirements dictated by ordinance, state or federal law or regulations. 5. The Contractor is expected to supply whatever materials and supplies that may be needed in order to satisfactorily perform the services herein. 6. The Contractor is free to decide and direct the manner and methods for completion of the Agreement projects. Work hours shall be at the discretion of the Contractor with approval by the City. 7. The Contractor is not expected to devote full-time to any of the Agreement projects. 8. This Agreement is not exclusive and shall not preclude the Contractor from engaging in similar, related or simultaneous services for any other entity. 9. The City understands that the Contractor holds itself out to the general public on a continuing basis to provide services such as those identified herein and will supply its own office facility, if one is needed. 10. The City has the right to discharge the Contractor for non- performance or default of this Agreement. 11. The Contractor agrees to satisfactorily complete the Agreement projects and is liable to the City for any failure to complete any job herein identified. The contractor shall be liable to the City for any costs, damages and reasonable attorneys' fees incurred by the City as a result of the Contractor's breach of this Agreement. 12. The City shall not be responsible for any negligence, personal behavior or work actions of the Contractor in its contacts with the general public in performance of the services herein. 13. The Contractor is not required to attend meetings unless specifically requested to do so. 14. This contract shall be re -negotiated by either party at 6 months. 15. This contract can be terminated by either party with 30 day advance notice. Signature of this document by both parties shall indicate that the terms of this Agreement are acceptable.
