Tim Broback, Park -view, Inc-, is petitioning to rezone the proposed O'Leary's Hills Sixth Addition. This subdivision was originally part of the Seventh Addition in the approved phasing plan of the Planned Unit Development (PUD). These lots, however, have utilities (water and sewer) stubbed ifrom 155th Street West and were included in the Metropolitan UrbELn'Service Area (MUSA) when O'Leary's Hills First Addition was approved in 1987. Prior to approval, of the final plat, the property, must be rezoned to R-1 (Single Family Residential). Presently it is zoned AG (Agriculture). This rezoning is consistent with the Comprehensive Guide Plan and with the Urban Service Area Extension policies. At their regular meeting on September 8, 1992, the Planning Commission recommended approval of the rezoning. As required by t e Zoning Ordinance, the City 'Council 'held a public hearing on this rezoning petition on September 15, 1992. No person testified regarding this petition. Action on the; petition was tabled to enable staff and the developer to work out the details regarding improvements on Chokecherry Avenue. Those issues have been resolved and will be discussed with the O'Leary's 'Hills Sixth Addition final' plat application (Agenda Item #5b.), also secheduled for action on this agenda. Ordinance No. B, adopted September 19, 1989, entitled "City of Rosemo nt Zoning Ordinance," is hereby amended to rezone from AG Agriculture to R-1 S ngle Family Residential the following described property located within the City of Rosemount, Minnesota to -wit: ae north 130.00 feet of the south 305.00 feet of the Southeast uarter of the Northeast Quarter (SEI/a of NEI/a) lying east of the est 943.00 feet thereof; all in Section 31, Township 115, Range ), Dakota County, Minnesota; and, as of the date of City ouncil approval and publication of this ordinance, that property escribed as O'LEARY'S HILLS SIXTH ADDITION. Section 2. The Zoning Map of the City of Rosemount, referred to and described in said Ordinance No. B as that certain map entitled "ZOIvTiNG MAP OF THE CITY OF ROSEMOUNT", shall not be republished to show the aforesaid rezoning, but the Clerk shall appropriately mark the said zoning map on file in the Clerk's officef Dr the purpose of indicating the rezoning hereinabove provided for in this Ordinance and all of the notation references and other information shown thereon are hereby incorporated by reference and made a part of this Ordinance.
