The Planning Commission discussed the cemetery proposal at their,
July 28, 1992Regular Meeting. Although the Planning Commission
expressed concerns about future street and utility improvements,
their discussions were generally in support of the proposal Rick
Pearson, of my staff, will be present to overview this proposal
with the City Council.
Planning staff, requests that the Council discussion identify any
issues or concerns regarding this proposed land use and
implications it may have relative to previous assumptions of future
development in this Location.
The representatives of the Islamic community will be present for
Council's questions and are expecting to begivendirection as to
whether they should proceed with their proposal:

Cemetery Concept PLD
Approximately 15 acres between Biscayne Avenue and the Soo Line Railroad,
across from Rosemount Woods
RECOMMENDED MOTION: No action is requested at this time, however, the Islamic
Community is proposing the cemetery concept PUD for discussion to determine whether
the City would consider a cemetery as an acceptable land use in this location.
NATURE OF PROPOSAL:
Mr. Mohammed Elakkad representing the metro area Islamic Community, has requested that the
City consider a cemetery Planned Unit Development that will ultimately serve the burial needs
for the members of the Islamic Community that live in the metro area.
DISCUSSION:
The Islamic Community currently has 60 burial plots in Dawn Valley Cemetery in Burnsville.
They propose to develop a cemetery for their needs that would be available by 1996. The
ultimate capacity of the cemetery could exceed 4000 burial spaces and would provide for their
needs for several hundred years. That projection is based upon a relatively flat growth curve
relative to the size of the Islamic Community.
The 15 acre parcel is currently zoned Agricultural (AG) and is consistent with the current
Comprehensive Guide Plan designation. After the year 2000, the existing Guide Plan
designation becomes urban residential. Ongoing guide plan discussions suggest this property is
somewhere on the perimeter of the year 2000 MUSA line.
Currently the City of Rosemount Zoning Ordinance does not explicitly permit cemeteries.
Planning staff has reviewed the zoning requirements for cemeteries in surrounding communities
and has recommended to Mr. Elakkad that a rezoning would be necessary. Initial discussions

have suggested that the Public zoning district would be most appropriate. The concept of
requiring cemeteries as a conditional use was discussed and Planning staff feels this concept has
merit. These issues, however, can be dealt with more specifically after a determination is made
about the appropriateness of this land use.
The proposed use would require Public or Quasi -Public zoning and a Guide Plan designation for
Public/Institutional use to be consistent with other cemeteries in the City. The burials would be
intended exclusively for the Islamic Community and not for sale. The religious affiliation
would cause the cemetery to be tax-exempt.
The proposal includes a Mosque that would accommodate 300 people to be built sometime
between 2001-2005. In the interim, a washing room and burial preparation facility would be
built (prior to any burials) in 1995. Islamic burial practices do not require embalming, but
caskets and vaults are used in accordance with State requirements. Burials take place usually
within 12 hours of death, and there is no funeral, visitation or wake that involves the presence
of the body of the deceased.
Planning staff recommends that this proposal will require approvals of the following in order to
proceed:
1) A Zoning Ordinance text amendment to make cemeteries a use -of -right in the Public or
Quasi -Public district.
2) A Planned Unit Development for the various phases of the proposal.
3) A Guide Plan Amendment for the change in land use.
4) Rezoning from Agricultural to Public or Quasi -Public.
In addition, all buildings would require Site Plan review prior to issuance of a building permit
In our preliminary staff discussions about this concept for this particular property two
noteworthy items have been identified. This property is the likely alignment for the future
Brockway interceptor and the potential alignment for Connemara Trail. Serious consideration
should be given to the City's ability to accomplish these infrastructure improvements without
interfering with the cemetery. Given the proposed phasing plan and ultimate development
scenario of the cemetery, it appears that the infrastructure improvements could be
accommodated on this property. Consideration of these items will be necessary prior to any
final PUD approval.
Given all of the fees associated with the approval process, Planning staff suggested that the
representatives of the Islamic Community proceed with the concept PUD to find out from if the
Planning Commission and ultimately, the City Council would support the scenario of a cemetery
in this location. Associated issues include:
1) Is the City of Rosemount willing to convert land that will be guided in the future for
urban residential use to a cemetery?
2) If so, is the proposed location an appropriate one for a cemetery? (between the SOO Line
railroad tracks and Biscayne Avenue)
Discussion of these issues should give the representatives of the Islamic Community enough
information and direction to decide if they should proceed with the proposal.
